PC Res 2857RESOLUTION NO. 2857 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT ALLOWING OUTSIDE SEATING OF TWENTY SEATS IN CONJUNCTION WITH A PROPOSED RESTAURANT ON PROPERTY LOCATED AT 10 E. HAMILTON AVENUE IN A C-1-S (NEIGHBORHOOD COMMERCIAL) ZONING DISTRICT. APPLICATION OF MS. A. GLOVER, ON BEHALF OF THE FRENCH BREAD COMPANY; FILE NO. UP 93-06(B) After notification and Public Hearing as specified by law on the application of Ms. April Glover, on behalf of The French Bread Company, allowing outside seating of twenty seats in conjunction with a proposed restaurant on property located at 10 E. Hamilton Avenue in a C-1-S (Neighborhood Commercial) Zoning District; as per the application filed in the Planning Department on April 15, 1993; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with regard to File No. UP 93-06(b): A restaurant use is a permitted use in the C-1-S (Neighborhood Commercial) Zoning District. The proposed outside seating area is so situated that it should not adversely impact traffic circulation or adjacent residential neighbors. o The project site is adequately improved to accommodate the proposed 90 seat restaurant use. The project applicant has demonstrated the adequacy of on-site parking improvements. Outdoor seating at this location will add to the architectural interest of this project. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that the facts demonstrate that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Glover Adopted on May 25, 1993 Page 2 The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. o The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 4. The proposed use is compatible with the uses in the area. Approval is effective ten days after decision of approval of the Planning Commission, subject to the following Conditions of Approval, unless an appeal is filed: Project Approval: Conditional Use Permit approval is granted to allow the establishment of a 90 seat restaurant (70 interior/20 exterior) in approximately 3,080 square feet of the commercial building located at 10 E. Hamilton Avenue. Project approval shall substantially comply with project description prepared by Bonesteel Architects, Inc., dated April 15, 1993. Hours of Operation 6:30 a.m. to 10:00 p.m. 6:30 a.m. to 5:00 p.m. Monday through Saturday Sunday o Outdoor Furniture: Prior to installation, proposed outside seating/furniture/and umbrellas to be approved by the Planning Director. (Planning) o Trash Facilities: Applicant is responsible for providing adequate facilities for trash collection and to maintain outside patio area in a clean unlittered state. (Planning) o Sound System: No exterior sound system is allowed unless an acoustical study is provided which demonstrates that such system shall not adversely impact other tenants and/or surrounding residents. (Planning) o Handicapped Access: Provide minimum 48" wide clear path of travel to all exits. (Building) 7. All portions of outside seating to be handicapped accessible from Resolution No. 2857 UP 93-06(b) -- 10 E. Hamilton Avenue -- A. Glover Adopted on May 25, 1993 Page 3 building or main walk way. (Building) 8. Conform to UBC 705 for light, ventilation and sanitation requirements. (Building) 9. Exiting: Exits shall have panic hardware. (Fire) 10. Exits shall have exit signs with two sources of supply. (Fire) 11. Provide exit path lighting with two sources of supply. (Fire) 12. Sprinklers: Modify sprinkler system to this design. (Fire) Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
