BEING A RESOLUTION OF THE PLANNING COMMISSION
RECOMMENDING APPROVAL OF A TENTATIVE SUBDIVISION
MAP, FILE NO. TS 93-01, LANDS OF TERSINI, APN: 406-08-012,
ON PROPERTY LOCATED AT 710 W. SUNNYOAKS AVENUE IN
A R-l-6 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT.
After notification and public hearing as specified by law on the application for
approval of a Tentative Subdivision Map as referenced in the above heading;
as per the application filed in the Planning Department on March 26, 1993;
and, after presentation by the Planning Director, proponents and opponents,
the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. TS 93-01:
The proposed subdivision density of 5.1 units per gross acres is consistent
with the low density residential land use shown on the Land Use
Element of the General Plan.
The proposed map is consistent with the minimum lot standards for the
R-l-6 (Single Family Residential) Zoning District.

The proposed subdivision layout subject to the provision of a emergency
easement adequately addresses the access needs of the neighborhood and
the future residents of the subdivision.
o
An initial study was prepared for this project and no significant
environmental impacts were found.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
1. The proposed subdivision is consistent with the General Plan;
The proposed subdivision does not impair the balance between the
housing needs of the region and the public service needs of its residents
and available fiscal and environmental resources;

The design of the subdivision provides, to the extent feasible, for future
passive or natural heating or cooling opportunities.

No substantial evidence has been presented which shows that the
project, as currently presented, and subject to the required conditions,
would have a significant adverse impact on the environment.

Based upon the above findings, the Planning Commission does hereby
recommend approval of this map to the City Council, subject to the
Conditions of Approval attached hereto, as Exhibit A.
Further, the applicant is notified as part of this application that he is required
to comply with all applicable Codes and Ordinances of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.

CONDITIONS OF APPROVAL FOR FILE NO. TS 93-01

The applicant is hereby notified, as part of this application, that he/she is
required to meet the following conditions in accordance with the Ordinances
of the City of Campbell and the State of California. The lead department with
which at the applicant will work is identified on each condition.
Additionally, the applicant is hereby notified that he/she is required to
comply with all applicable Codes or Ordinances of the City of Campbell and
the State of California that pertain to this development and are not herein
specified.
SITE
DESIGN
Approved Project: Approval is granted for a Tentative Subdivision Map
allowing the creation of 37 single family lots. The map shall
substantially conform to the map prepared by Nowack & Associates, Inc.,
dated May 13, 1993, except as may be modified by the Conditions of
Approval herein. (Planning)
Developer to submit a revised map addressing the conditions of
approval, prior to final map submittal.
Emergency Access: Map to provide a 14 foot wide easement from West
Sunnyoaks Avenue to the proposed Capri Drive cul-de-sac and to
improve easement area as required by the Planning Director and Fire
Marshall:
a. A minimum 14 foot width with appropriate radius and appropriate
breakaway gates for fire truck access is required.
b. Property owners adjacent to easement will be responsible for
maintenance of access easement. (Planning/Fire)
LANDSCAPING
3. Tree Preservation: Prior to final map approval, applicant to submit a
tree preservation/mitigation plan to ensure the protection of the Coast
Live Oak between Lots 5 and 6, and replacement of the 37" diameter
Valley Oak tree consistent with equivalent diameter of similar tree type
per WELS standards. The plan must be prepared by a licensed arborist
and approved by the Site and Architectural Review Committee prior to
final map approval. (Planning)

PROPERTY MANAGEMENT/UTILITIES
4. Property Maintenance: The property is to be maintained free of any
combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by
having windows boarded up and doors sealed shut, or be demolished or
removed from the property (Section 11.201 & 11.414, 1985 Ed. Uniform
Fire Code). (Fire)
Santa Clara County Valley Water District: Prior to final map approval,
applicant to provide a clearance letter from Santa Clara Valley Water
District approving abandonment of existing easements and creation of
new easements on the project site.
Street Name: Obtain approval of a new street name by the City Council
upon recommendation of the Civic Improvement Commission prior to
final map approval. (Planning)

Retaining Walls: Retaining walls at property lines are limited to a
height of 15 inches if constructed of wood. (Building)
PUBLIC SAFETY/WELFARE
8. Handicapped Requirements: Applicant shall comply with all
appropriate State and City requirements for the handicapped. (Building)
Underground Utilities: Underground utilities to be provided as required
by Section 20.36.150 of the Campbell Municipal Code. (Public Works)

Utility Boxes and Back-Flow Preventers: Applicant to submit a plan to
the Planning Department, prior to installation of PG&E utility
(transformer) boxes and S.J. Water back-flow preventers, indicating the
location of the boxes and screening (if boxes are above ground) for
approval of the Planning Director. (Planning)
11.
Park Dedication Fee: Applicant to pay Park Dedication In-lieu Fee,
which will be assessed at the time the subdivision map is submitted.

12.
Performance Bond: Applicant to post a faithful performance bond in the
amount of $5,000 to ensure retention of trees prior to commencement of
construction. (Planning)

FIRE DEPARTMENT
13. Provide two fire hydrants, one near lot 12, one near lot 23.
14.
This development provides for a dead end street in excess of 1000 feet.
This street should go through and connect with West Sunnyoaks
Avenue or a 14 foot emergency access shall be provided.
PUBLIC WORKS DEPARTMENT
15. As a condition of approval, the applicant must process and file a final
map.
16. Applicant must obtain approval of Civic Improvement Commission
and County Communications for names of streets within subdivision.
17.
Sewers: Installation of a sanitary sewerage system to serve all lots
within the subdivision in conformance with the proposed plans of the
West Valley Sanitation District. Sanitary sewerage service to be
provided by said district.
18.
Water Service: Installation of a water distribution system to serve all
lots within the subdivision in conformance with the plans of the San
Jose Water Works. Water service to be provided by said water company.
Fire hydrants and appurtenances shall be provided and installed at the
locations specified by the Fire Chief, Fire Department, City of Campbell.
Fire hydrant maintenance fees shall be paid to City at the rate of $195 per
fire hydrant.
19. Subdivision Map Act: Compliance with the provisions of Title 20,
Subdivisions of the Campbell Municipal Code.
20. Storm Drain Fee: Subdivider to pay Storm Drainage Area Fee of $12,881.
21. Surety: Subdivider shall install street improvements and post surety to
guarantee the work.
22.
Dedications: Dedicate additional right-of-way to widen W. Sunnyoaks
Avenue to 30 feet from centerline and dedicate sufficient property to
provide for cul-de-sac extensions.
23. Grading/Drainage Plan: Provide a grading and drainage plan for the
review and approval of the City Engineer.

24. Excavation Permit: Obtain an excavation permit and pay fees and
deposit for all work in the public right-of-way.
25. Park Lands Dedication: Pay a fee of $ 8,242 per lot in lieu of dedication of
land for parks.
