PC Res 4187RESOLUTION NO. 4187 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SITE AND ARCHITECTURAL REVIEW PERMIT (PLN2014-157) TO ALLOW THE CONSTRUCTION OF A NEW 5,172 SQUARE FOOT, 113- SEAT RESTAURANT BUILDING ON PROPERTY LOCATED AT 2000 S. BASCOM AVENUE. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to file number PLN2014-157: 1. The project site is zoned C-2 (General Commercial) and designated General Commercial by the General Plan. 2. The project site is located on the east side of S. Bascom Avenue between E. Campbell Avenue and Arroyo Seco Drive. 3. The proposed project is an application for a Site and Architectural Review to allow the construction of a new 5,172 square foot, 113-seat restaurant building. 4. Policies found within the Campbell General Plan articulate a desire to promote and allow change consistent with reinforcing positive neighborhood values and protecting the integrity of the city's neighborhood, encouraging neighborhood serving commercial uses within walking distance of residential uses, and attracting and maintaining a variety of uses that create an economic balance within the city while providing high quality services to the community. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed site is adequately served by streets (S. Bascom Avenue & E. Campbell Avenue) of sufficient capacity to carry the kind and quantity of traffic the use would be expected to generate; 2. The traffic generated from the development should not have adverse effects on traffic conditions on abutting streets; 3. The layout of the site should provide adequate vehicular and pedestrian entrances, exit driveways, and walkways; 4. The arrangement of off-street parking facilities should prevent traffic congestion and adequately meet the demands of the users; Planning Commission Resolution No. 4187 Page 2 of 3 PLN2014-157 - 2000 S. The location, height, and material of walls, fences, hedges and screen plantings should ensure harmony with adjacent development and/or conceal storage areas, utility installations, or other potentially unsightly elements of the project; 6. The project should maximize open space around structures, for access to and around structures, and the establishment and maintenance of landscaping for aesthetic and screening purposes; 7. The project should maximize areas of improved open space to protect access to natural light, ventilation, and direct sunlight, to ensure the compatibility of land uses, to provide space for privacy, landscaping, and recreation; and 8. The project should minimize the unnecessary destruction of existing healthy trees; 9. The project should enhance the overall appearance of the city by improving the appearance of individual development projects within the city; 10. The project should complement the surrounding neighborhoods and produce an environment of stable and desirable character; 11. The project should enhance the city's character and should not have an adverse aesthetic impact upon existing adjoining properties, the environment, or the city in general; 12. The project should promote the use of sound design principles that result in creative, imaginative solutions and establish structures of quality design throughout the city and which avoid monotony and mediocrity of development; 13. The project should promote maintenance of the public health, safety, general welfare, and property throughout the city; 14. The project should be consistent with all applicable design guidelines and special plans; and 15. The project is Categorically Exempt under Section 15303, Class 3 of the California Environmental Quality Act (CEQA) pertaining to the construction of new small facilities and structures. THEREFORE, BE IT RESOLVED that the Planning Commission approves a Site and Architectural Review Permit (PLN2014-157) to allow the construction of a new 5,172 square foot, 113-seat restaurant building on property located at 2000 S. Bascom Avenue, subject to the attached Conditions of Approval (Exhibit "A"). Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, Planning Commission Resolution No. 4187 Page 3 of 3 PLN2014-157 - 2000 S. Pamela Finc air EXHIBIT A CONDITIONS OF APPROVAL Site and Architectural Review Permit (PLN2014-157) Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT Planning Division 1. Approved Project: Approval is granted for a Site and Architecture Review Permit (PLN2014-157) to allow the construction of a new 5,172 square foot, 113-seat restaurant building. The project shall substantially conform to the Project Plans, stamped as received by the Planning Division on January 5, 2015, except as may be modified by the conditions of approval contained herein. 2. Site and Architectural Review Expiration: The Site and Architectural Review Permit shall be valid for one year from the date of final approval (expiring January 27, 2016). Within this one-year period, applications for building permits must be submitted and substantial construction efforts must commence. Failure to meet this deadline will result in the Site and Architectural Review Permit (PLN2014-157) being rendered void. 3. Restaurant Seating: Total indoor seating shall be limited 113 seats. This total is to be divided between the two tenant spaces, such that the larger 2,650 square foot tenant space facing S. Bascom Avenue shall have no more than 57 seats, and the smaller 2,522 sq. ft. tenant space located interior to the project site shall have no more than 56 seats. No transfer or redistribution of seats between tenant spaces shall be permitted. This seating limitation is also subject to the maximum occupancy capacities of certain rooms as determined by the California Building Code (CBC). It is the responsibility of the business owner to provide adequate entrance controls to ensure that patron occupancy is not exceeded. Maximum Occupancy signs shall be posted conspicuously within the premises. 4. Parking: Prior to occupancy, a total of 77 shared commercial parking spaces shall be provided in accordance with the project plans. 5. Location of Mechanical Equipment: No roof-mounted mechanical equipment, i.e. air conditioning units, shall be located on the roof of the building without providing screening of the mechanical equipment from public view and surrounding properties. Screening material and method shall require review and approval by the Community Development Director prior to installation of such mechanical equipment screening. Building Colors: Prior to building permit issuance, the applicant shall provide a minimum of three paint swatches indicating a slightly warmer, off-white, paint color for the building stucco and a sample of the mid-range "teak" staining treatment proposed for the Ipe wood siding to be reviewed and approved by the Director of Community Development. The applicant shall further be required to paint a small segment of the building in the three, previously provided, paint colors prior to painting the building. The final building colors and staining of the Ipe wood siding are subject to review and approval of the Director of Community Development. 7. Outdoor Storage: No outdoor storage is permitted on the property. Building Division 8. Permits Required: A building permit application shall be required for the proposed Tenant Improvements to the (e) commercial space. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. 9. Construction Plans: The conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 10. Size of Plans: The minimum size of construction plans submitted for building permits shall be 24 in. X 36 in. 11. Plan Preparation: This project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be "wet stamped" and signed by the qualifying professional person. 12. Site Plan: Application for building permit shall include a competent site plan that identifies property and proposed structures with dimensions and elevations as appropriate. Site plan shall also include site drainage details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. 13. Title 24 Energy Compliance: California Title 24 Energy Standards Compliance forms shall be blue-lined on the construction plans. Compliance with the Standards shall be demonstrated for conditioning of the building envelope and lighting of the building. 14. Special Inspections: When a special inspection is required by C.B.C. Chapter 17, the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Official for approval prior to issuance of the building permits, in accordance with C.B.C Chapter 1, Section 106. Please obtain City of Campbell, Special Inspection forms from the Building Inspection Division Counter. 15. Non-Point Source Pollution: The City of Campbell, standard Santa Clara Valley Non- point Source Pollution Control Program specification sheet shall be part of plan Planning Commission Resolution No. 4187 Page 3 of 10 PLN2014-157 - 2000 S. Bascom Avenue Site and Architectural Review Permit -New Restaurant Building submittal. The specification sheet (size 24" X 36") is available at the Building Division service counter. 16. Title 24 Accessibility -Commercial: On site general path of travel shall comply with the latest California Title 24 Accessibility Standards. Work shall include but not be limited to accessibility to building entrances from parking facilities and sidewalks. 17. Title 24 Accessibility -Commercial: This project shall comply fully with the provisions of Chapter 11 B of California Building Code 2013 ed. 18. Approvals Required: The project requires the following agency approval prior to issuance of the building permit: a. West Valley Sanitation District b. Santa Clara County Fire Department c. Santa Clara County Department of Environmental Health d. San Jose Water Company e. City of San Jose Dept. of Environmental Resources 19. P.G.&E.: Applicant is advised to contact Pacific Gas and Electric Company as early as possible in the approval process. Service installations, changes and/or relocations may require substantial scheduling time and can cause significant delays in the approval process. Applicant should also consult with P.G.&E. concerning utility easements, distribution pole locations and required conductor clearances. 20. LEED for New Construction: Applicant shall complete and return Leed Project Checklist prior to issuance of permit. 21. Storm Water Requirements: Storm water run-off impervious surface created by this permitted project shall be directed to vegetated areas on the project parcel. Storm water shall not drain onto neighboring parcels. 22. California Green Building Code: This project shall comply with Non-Residential Mandatory Requirements, Chapter 5 -California Green Building Code 2013 ed. Public Works 23. Response Letter: Upon submittal of the Street Improvement Plans and the Grading and Drainage Plans, the applicant shall provide an itemized response letter verifying that all the Public Works Conditions of Approval have been met or addressed. 24. Proof of Ownership: Prior to issuance of any grading, drainage, or building permits for the site, the applicant shall provide a current Preliminary Title Report, grant deed, or other satisfactory proof of ownership. Right-of-Way for Public Street Purposes: Prior to issuance of any grading, drainage, or building permits for the site, the applicant shall fully complete the process to cause additional right-of-way to be granted in fee for public street purposes along the South Bascom Avenue frontage to accommodate the new sidewalk, unless otherwise approved by the City Engineer. The applicant shall submit the necessary documents for approval by the City Engineer, process the submittal with City staff's comments and fully complete the right-of-way process. The applicant shall cause all documents to be prepared by a registered civil engineer/land surveyor, as necessary, for the City's review and recordation. 26. Grading and Drainage Plan: Prior to issuance of any grading, drainage, or building permits for the site, the applicant shall conduct hydrology studies based on a ten-year storm frequency, prepare an engineered grading and drainage plan, and pay fees required to obtain necessary grading permits. Prior to occupancy, the design engineer shall provide written certification that the development has been built per the engineered grading and drainage plans. In addition, a plan review letter will be required of the Geotechnical engineer for the entire grading and drainage system which should include but is not limited to a review of the subsurface of the non-compacted biotreatment material that may have potential for subsurface failure and surface failure due to vehicle loads. 27. Drainage System: Prior to occupancy clearance, the applicant shall refurbish, remodel, and reconstruct the on-site drainage system, as necessary, to demonstrate that the facilities are functioning normally in accordance with the requirements of the City. 28. Storm Drain Area Fee: Prior to issuance of any grading, drainage, or building permits for the site, the applicant shall pay the required Storm Drain Area fee, currently set at $2,650.00 per net acre, which is $2,517.00. 29. Utilities: All on-site utilities shall be installed underground per Section 21.18.140 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility companies. Utility locations shall not cause damage to any existing street trees. Where there are utility conflicts due to established tree roots or where a new tree will be installed, alternate locations for utilities shall be explored. Include utility trench details where necessary. 30. Water Meter(s) and Sewer Cleanout(s): Existing and proposed water meter(s) and sewer cleanout(s) that are being modified as part of this project shall be relocated or installed on private property behind the public right-of-way line. Utility Coordination Plan: Prior to issuance of building permits for the site, the applicant shall submit a utility coordination plan and schedule for approval by the City Engineer for installation and/or abandonment of all utilities. The plan shall clearly show the location and size of all existing utilities and the associated main lines; indicate which utilities and services are to remain; which utilities and services are to be abandoned, and where new utilities and services will be installed. Joint trenches for new utilities shall be used whenever possible. 32. Pavement Restoration: Based on the utility coordination plan, the applicant shall prepare a pavement restoration plan for approval by the City Engineer prior to any utility installation or abandonment. The pavement restoration plan shall indicate how the street pavement shall be restored following the installation or abandonment of all utilities necessary for the project. 33. Street Improvement Agreements/Plans/Encroachment Permit/Fees/Deposits Prior to issuance of any grading, drainage, or building permits for the site, the applicant shall execute a street improvement agreement, cause plans for public street improvements to be prepared by a registered civil engineer, pay various fees and deposits, post security and provide insurance necessary to obtain an encroachment permit for construction of the standard public street improvements, as required by the City Engineer. The plans shall include the following, unless otherwise approved by the City Engineer: a. Show location of all existing utilities within the new and existing public right of way. b. Relocation of all existing utilities including utility boxes, covers, poles, etc. outside of sidewalk area. No utility boxes, covers, etc. will be allowed in the sidewalk area. c. Removal of existing driveway approach and necessary sidewalk, curb and gutter. d. This project is subject to the City's Streetscape Standards for Bascom Avenue, which requires a 10 foot landscaped park strip with City approved street trees 40 feet on center, and a 7 foot sidewalk along S. Bascom Avenue. e. This project is subject to the City's Streetscape Standards for East Campbell Avenue, which requires a 10 foot wide sidewalk with City approved street trees in 4' x 4' tree wells 30 feet on center. This requirement only applies to the portion of the East Campbell Avenue frontage between South Bascom Avenue and the project's first driveway on East Campbell Avenue. f. Installation of ADA compliant driveways on S Bascom Avenue and East Campbell Avenue frontages, with new City standard curb, gutter, and sidewalk along the frontages between the two driveways. g. Installation of new ADA compliant ramp at the southeast corner of East Campbell Avenue and South Bascom Avenue. Planning Commission Resolution No. 4187 Page 6 of 10 PLN2014-157 - 2000 S. Installation of asphalt concrete overlay per street pavement restoration plan for utility installation and/or abandonment, as required by the City Engineer. Installation of streetlights, conduits, conductors and related facilities in accordance with the City of Campbell's Street Lighting Policies. Installation of traffic control, stripes and signs. Construction of conforms to existing public and private improvements, as necessary. Submit final plans in a digital format acceptable to the City. 34. Street Improvements Completed for Occupancy and Building Permit Final: Prior to allowing occupancy and/or final building permit signoff for any and/or all buildings, the applicant shall have the required street improvements and pavement restoration installed and accepted by the City, and the design engineer shall submit as-built drawings to the City. 35. Maintenance of Landscaping_ Owner(s), current and future, are required to maintain the landscaped park strip and tree wells in the public right of way. This includes, but is not limited to: trees, lawn, plantings, irrigation, etc. Trees shall not be pruned in a manner that would not allow the tree to grow to a mature height. 36. Utility Encroachment Permit: Separate permits for the installation of utilities to serve the development will be required (including water, sewer, gas, electric, etc.). Applicant shall apply for and pay all necessary fees for utility permits for sanitary sewer, gas, water, electric and all other utility work. 37. Additional Street Improvements: Should it be discovered after the approval process that new utility main lines, extra utility work or other work is required to service the development, and should those facilities or other work affect any public improvements, the City may add conditions to the development/project/permit, at the discretion of the City Engineer, to restore pavement or other public improvements to the satisfaction of the City. 38. Stormwater Pollution Prevention Measures: Prior to issuance of any grading or building permits, the applicant shall comply with the National Pollution Discharge Elimination System (NPDES) permit requirements, Santa Clara Valley Water District requirements, and the Campbell Municipal Code regarding stormwater pollution prevention. Specifically the project must include source control, site design and treatment measures to achieve compliance with Provision C.3. of the NPDES Permit. Measures may include, but are not limited to, minimization of impervious surface area, vegetated swales, infiltration areas, and treatment devices. The primary objectives are to improve the quality and reduce the quantity of stormwater runoff to the bay. Resources to achieve these objectives include Stormwater Best Management Practices Handbook for New Development and Redevelopment ("CA BMP Handbook") by the California Stormwater Quality Association (CASQA), 2003; Start Planning Commission Resolution No. 4187 Page 7 of 10 PLN2014-157 - 2000 S. Bascom Avenue Site and Architectural Review Permit -New Restaurant Building at the Source: A Design Guidance Manual for Stormwater Quality Protection ("Start at the Source") by the Bay Area Stormwater Management Agencies Association (BASMAA), 1999; and Using Site Design Techniques to Meet Development Standards for Stormwater Quality: A Companion Document to Start at the Source ("Using Site Design Techniques") by BASMAA, 2003. Upon submission of the grading permit, the applicant shall calculate and submit to the City the amount of impervious surface created by the development including the types of stormwater controls to be used. The applicant shall submit preliminary sizing and design showing stormwater controls meet the City's requirements. Prior to issuance of the grading permit: a. The applicant's designer or engineer shall submit the required certification indicating that sizing, selection, and design of treatment BMP's for the project site has been completed to meet the requirements of the City of Campbell's NPDES permit, No. 01-119, Provision C.3. b. The applicant shall sign the "Covenants for the Operation and Maintenance of Stormwater Facilities" and submit a Stormwater Management Plan. Prior to occupancy: a. A qualified BMP certifier is required to inspect the stormwater management facilities, submit a complete set of as-built drawings to Public Works Engineering, and certify on these drawings that: 1. The stormwater management facilities were constructed in compliance with the approved plans. 2. The as-built drawings show all pertinent constructed dimensions, elevations, shapes, and materials. 3. All variations in construction from the approved design plan have been identified, including omissions to and additions from the approved plan. 4. Any changes are in conformance with local, state, or federal regulations. b. The applicant shall provide security for the operation and maintenance of stormwater pollution prevention measures installed or provided as a part of this project. 39. Private Improvements Agreement: Prior to issuance of any grading, drainage, or building permits for the site, the owner shall execute an "Agreement for Private Improvements in the Public Right of Way". This agreement would be required to allow the existing utility facilities (water meters, backflow preventers, etc.) located in the public right of way along the frontage of this property, and any other non-City standard improvements, to remain. Planning Commission Resolution No. 4187 Page 8 of 10 PLN2014-157 - 2000 S. Bascom Avenue Site and Architectural Review Permit -New Restaurant Building Santa Clara County Fire Department 40. Review: Review of this Developmental proposal is limited to acceptability of site access and water supply as they pertain to fire department operations, and shall not be construed as a substitute for formal plan review to determine compliance with adopted model codes. Prior to performing any work the applicant shall make application to, and receive from, the Building Department all applicable construction permits. 41. Fire Sprinklers: Approved automatic sprinkler systems in new and existing buildings and structures shall be provided in the locations described in this Section or in Sections 903.2.1. through 903.2.18 whichever is the more restrictive. For the purposes of this section, firewalls used to separate building areas shall be constructed in accordance with the California Building Code and shall be without openings or penetrations. An automatic sprinkler system shall be provided throughout all new buildings and structures. Exception: Group A, B E, F, I, L, M, S, and U occupancy buildings and structures that do not exceed 1,000 square feet of building area. NOTE: The owner(s), occupant(s) and any contractor(s) or subcontractor(s) are responsible for consulting with the water purveyor of record in order to determine if any modification or upgrade of the existing water service is required. A State of California licensed (C-16) Fire Protection Contractor shall submit plans, calculations, a completed permit application and appropriate fees to this department for review and approval prior to beginning their work. CRC Sec. 903.2 as adopted and amended by CMC. 42. Hood/Duct Extinguishing Systems: Automatic fire-extinguishing systems installed as an alternative to the required automatic sprinkler systems of Section 903 shall be provided by the fire code official. Automatic fire-extinguishing systems shall not be considered alternatives for the purposes of exceptions or reductions allowed by other requirements of this code. Commercial hood and duct systems. Each required commercial kitchen exhaust hood and duct system required by Section 609 to have a Type I hood shall be protected with an approved automatic fire-extinguishing system installed in accordance with this code. CFC Sec. 904. 43. Water Supply Requirements: Portable water supplies shall be protected from contamination caused by fire protection water supplies. It is the responsibility of the applicant and any contractors and subcontractors to contact the water purveyor supplying the site of such project, and to comply with the requirements of that purveyor. Such requirements shall be incorporated into the design of any water- based fire protection systems, and/or fire suppression water supply systems or storage containers that may be physically connected in a manner to an appliance capable of causing contamination of the portable water supply of the purveyor of record. Final approval of the system(s) under consideration will not be granted by this office until compliance with the requirements of the water purveyor of record are Planning Commission Resolution No. 4187 Page 9 of 10 PLN2014-157 - 2000 S. Bascom Avenue Site and Architectural Review Permit -New Restaurant Building documented by that purveyor as having been met by the applicant(s). 2010 CFC Sec. 903.3.5 and Health and Safety Code 13114.7. 44. Trash Enclosures: Dumpsters with an individual capacity of 1.0 cubic yards [200 gallons (0.76 m3)] or more shall not be stored in buildings or placed within 5 feet (1524mm) of combustible walls, openings or combustible roof eave lines unless the dumpsters are constructed of noncombustible materials or of combustible materials with a peak rate of heat release not exceeding 300 kW/m2 when tested in accordance with ASTM E 1354 at an incidental heat flux of 50 kW/m2 in the horizontal orientation. Exceptions: 1. Dumpsters in areas protected by an approved automatic sprinkler system installed throughout in accordance with Section 903.3.1.1. 45. Cooking Oil: Storage of cooking oil (grease) in commercial cooking operations shall comply with Chapter 57. Systems used to store cooking oils in larger than 60-gallon (227 L) above ground tanks shall also comply with Sections 610.2 through 610.5. For purposes of this section, cooking oil shall be classified as a Class IIIB liquid unless otherwise determined by testing. CFC Sec. 610. 46. Construction Site Fire Safety: All construction sites must comply with applicable provisions of CFC Chapter 33 and our Standard Detail and Specifications SI-7. Provide appropriate notations on subsequent plan submittals, as appropriate to the project. CFC Chp. 33. 47. Address Identification: New and existing buildings shall have approved address numbers, building numbers or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numbers or alphabetical letters. Numbers shall be a minimum of 4 inches (101.6mm) high with a minimum stroke width of 0.5 inch (12.7 mm). Where access is by means of a private road and the building cannot be viewed from the public way, a monument, pole or other sign or means shall be used to identify the structure CFC Sec. 505.1. 48. Plans Not Approved: To prevent plan review and inspection delays, the above noted Developmental Review Conditions shall be addressed as "notes" on all pending and future plan submittals and any referenced diagrams to be reproduced onto the future plan submittal.
