A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
ADOPTING THE ATTACHED FINDINGS AND AUTHORIZING THE PUBLIC WORKS
DIRECTOR TO AWARD AND EXECUTE A CONTRACT WITH GHILOTTI
CONSTRUCTION COMPANY FOR PROJECT 15-QQ, MISCELLANEOUS
FRONTAGE IMPROVEMENTS EAST CAMPBELL AVENUE
WHEREAS, Project 15-QQ Miscellaneous Frontage Improvements East Campbell
Avenue has been created for construction of various frontage improvements and
conforms along East Campbell Avenue; and
WHEREAS the Engineer's Estimate for such work has been determined to be $60,000•
and
WHEREAS the work involved in Project 15-QQ would most appropriately be completed
as an integral part of the work involved in the larger East Campbell Avenue Portals
Project 11-EE in order to avoid compromising the work structurally and aesthetically
and
WHEREAS, Ghilotti Construction Company has prepared a fair and reasonable
proposal for the completion of the work involved in Project 15-QQ and has estimated a
cost of $47 457 to complete the work involved• and
WHEREAS, a public competitive bid process for Project 15-QQ would not result in the
most beneficial means to complete project work as coordinating two contractors in the
same area on essentially the same item of work would create coordination problems
and increase the potential for construction claims and increased project costs; and
WHEREAS, a budget adjustment has been prepared to transfer $55,000 from the
Hacienda Avenue Enhancement Project 14-EE to the Miscellaneous Frontage
Improvements -East Campbell Avenue Project 15-QQ;
NOW, THEREFORE, BE IT RESOLVED that based on the foregoing, the City Council
further finds and concludes that:
1 The nature of the subject of the contract is such that competitive
proposals would be unavailing or would not produce an advantage, and
the advertisement for competitive bid would thus be undesirable,
impractical, or impossible.
2. Competitive proposals would work an incongruity and would
be unavailing as affecting the final result.
3. It is practically impossible to obtain what is required and to observe the
competitive bidding process.
AND, BE IT FURTHER RESOLVED that the City Council hereby authorizes the Public
Works Director to award and execute a contract with Ghilotti Construction Company for
Project 15-00, Miscellaneous Frontage Improvements -East Campbell Avenue in an
amount not to exceed $50 000 and encumber an additional 10% construction
contingency for an amount not to exceed $55,000 and authorizes the Public Works
Director to negotiate and execute contract change orders up to the construction
contingency amount, and approves a budget adjustment.
