PC Res 2866RESOLUTION NO. 2866 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A MODIFICATION OF A PREVIOUSLY APPROVED USE PERMIT (UP 78-12) TO ALLOW THE EXPANSION OF AN EXISTING RESTAURANT BY APPROXIMATELY 1,132 SQUARE FEET. THE PROPOSED EXPANSION CONSISTS OF A SUNROOM ADDITION ON THE EAST AND WEST SIDE OF THE EXISTING BUILDING AND THE INSTALLATION OF A NEW ROOF AND AWNING TREATMENT, ON PROPERTY LOCATED AT 1651 W. CAMPBELL AVENUE IN A C-I-S (NEIGHBORHOOD COMMERCIAL) ZONING DISTRICT. FILE NO: M 93-08. After notification and Public Hearing as specified by law on the application of C. Chang, on behalf of Mr. Howard Sang, allowing a modification to a previously approved Use Permit allowing a 1,132 square foot addition to an existing restaurant building on property located at 1651 W. Campbell Avenue in a C-1-S (Neighborhood Commercial) Zoning District, as per the application filed in the Planning Department on June 11, 1993; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. M 93-08: The proposed addition and remodel will upgrade the existing development. Revised landscape plans will enhance the site and will better integrate the use with the surrounding area. 3. There is sufficient parking to support the proposed use. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. 2. The proposed use is compatible with the adjacent land uses. Resolution No. 2866 UP 78-12 --1651 W. Campbell Avenue Adopted on June 27, 1993 Page 2 Based upon the above findings, the Planning Commission does hereby recommend approval of this modification, subject to the Conditions of Approval attached hereto, as Exhibit A. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. DATE: JULY 27, 1993 Exhibit A The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with which the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. SITE AND BUILDING DESIGN Approved Project: This approval is for a modification approval allowing the expansion of an existing commercial building located at 1651 W. Campbell Avenue identified as Assessor's Parcel Number 307-16-005. Development shall be substantially as shown on the project plans listed below, except as may be modified by conditions contained herein: b0 Project drawings for Howard Sang prepared by Charles Chang, AIA, consisting of four sheets with revised elevations, dated June 19, 1993, and July 8, 1993. Color board on file in the Planning Department. LANDSCAPING 2. Landscaping: Detailed landscaping plan indicating quantity, type and size of plant material, and located irrigation system to be submitted to the Community Development Department and approved by the Community Development Director, upon recommendation of the Landscape Advisor, prior to issuance of a building permit. Landscape plan shall conform to the landscape plan/design indicated on the approved site plan. a_ Landscape plan to indicate the installation of new plant materials to provide a screening hedge along the LaPradera frontage. b. Revised plan to reflect the removal of existing wood fence at the rear of the property and upgrading of the landscape in this area. STREET/SITE IMPROVEMENTS 3. Parking and Driveways: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. (Community Development) 0 Signs: Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign to be installed until application is approved and permit issued by Planning and Building Departments (Section 21.53 of the Campbell Municipal Code). (Community Development) PROPERTY MANAGEMENT/UTILITIES 5. Property Maintenance,.: The property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property (Section 11.201 & 11.414, 1985 Ed. Uniform Fire Code). (Central Fire District) Garbage Collection,: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple family dwellings, and all commercial, business, industrial, manufacturing, and construction establishments. (Central Fire Distric0 Trash Containers: Trash container(s) of a size and quality necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. (Central Fire District) PUBLIC SAFETY/WELFARE 8. Handicapped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped. (Building) Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) 10. Utility Boxes and Back-Flow Preventers: Applicant to submit a plan to the Planriing Department, prior to installation of PG&E utility (transformer) boxes and San Jose Water back-flow preventers, indicating the location of the boxes and screening (if boxes are above ground) for approval of the Community Development Director. (Community Development) 11. Equipment Screening: All mechanical equipment on roofs and all utility meters to be screened for approval by the Community Development Director. Utili _ty Connections: Plans submitted to the Building Division for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. (Building) Performance Bond: Applicant to either (1) post a faithful performance bond in the amount of $5,000 to ensure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) file a written agreement to complete landscaping, fencing and striping of parking areas. Bond or agreement to be filed prior to application for a building permit. (Community Development) Public Improvements and Dedication: Applicant shall obtain an encroachment permit and offer dedication sufficient to construct all public improvements. Deferred Boulevard Treatment: Property owner to provide an agreement in a form satisfactory to the City Attorney commiting to installation of future boulevard treatment improvement adjacent to the easterly property line prior to issuance of building permits.
