BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A
MODIFICATION OF A PREVIOUSLY APPROVED USE PERMIT (UP
78-12) TO ALLOW THE CONVERSION OF A TWO-CAR GARAGE
TO A LIVING AREA IN AN EXISTING SINGLE-FAMILY HOME
LOCATED AT 783 LOYALTON DRIVE IN A R-l-6 (SINGLE FAMILY
RESIDENTIAL) ZONING DISTRICT. APPLICATION OF BRETT
MARTIN, FILE NO.: UP 93-07.
After notification and Public Hearing as specified by law on the application of
Brett Martin, allowing a Conditional Use Permit to allow the conversion of a
two-car garage to a lving area in an existing single family home located at 783
Loyalton Drive in a R-l-6 (Single Family Residential) Zoning District, as per
the application filed in the Planning Department on June 18, 1993; and, after
presentation by the Planning Director, proponents and opponents, the
hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. UP 93-07:
The proposed development allows the use of the subject property as a
single family swelling consistent with the R-l-6 Zoning District.
The site plan indicates the provision of two parking spaces in the
driveway satisfying the development standards of the single family
zoning district.

The proposed conversion does not architecturally modify the appearance
of the existing residence and retains the existing garage door.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:

The conversion of a garage and/or carport to additional residential
living space will not establish additional living units on the premises.
Development plans indicate the location of two on-site parking areas
which meet the minimum parking standards for single-family
developments, as specified in Section 21.50.030 of the Municipal Code.
Conversion of a garage to additional residential living space complies
with all applicable building and fire codes.

The establishment, maintenance or operation of the use applied for will
not be detrimental to the health, safety, peace, morals, comfort or general
welfare of persons residing or working in the neighborhood of such
proposed use, or be detrimental to property and improvements in the
neighborhood or to the general welfare of the City.
The proposed site is adequate in size and shape to accommodate the
yards, walls, fences, parking and loading facilities, landscaping and other
development features required in order to integrate said use with uses in
the surrounding area.
The proposed site is adequately served by streets of sufficient capacity to
carry the kind and quantity such use would generate.
The proposed use is compatible with the uses in the area.
The proposed project, subject to the conditions imposed, will be
consistent with the general plan.
12. The proposed project, subject to the required conditions, will aid in the
harmonious development of the immediate area.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed.
Further, the applicant is notified as part of this application that he is required
to comply, as part of this application, that he/she is required to meet the
following conditions in accordance with the Ordinances of the City of
Campbell and the State of California. The lead department with which the
applicant will work is identified on each condition. Additionally, the
applicant is hereby notified that he/she is required to comply with all
applicable Codes or Ordinances of the City of Campbell and the State of
California that pertain to this development and are not herein specified.
SITE AND BUILDING DESIGN
Approved Project:. Project approval shall be in substantial conformance
to the plans dated July 18, 1993, prepared by the applicant. (Planning)
Applicant shall obtain any necessary building, electrical or mechanical
permits from Campbell Building Division. (Building)

3. Planning Commission approval is effective ten (10) days following its
action and is valid for a period of one (1) year. (Planning)
