PC Res 2870RESOLUTION NO. 2870 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL, CALIFORNIA, APPROVING A REINSTATEMENT OF A PREVIOUSLY APPROVED SITE AND ARCHITECTURAL APPLICATION ALLOWING THE CONSTRUCTION OF A 7,500 SQUARE FOOT AUTOMOTIVE REPAIR FACILrrY AT 980 CAMDEN AVENUE IN A P-D (PLANNED DEVELOPMENT) ZONING DISTRICT. APPLICATION OF ALAN MEGENITY, FILE NO. R 93-02 After notification and Public Hearing as specified by law on the application of Mr. Alan Megenity for reinstatement to a previously approved Site and Architectural application allowing the construction of a 7,500 square foot automotive repair facility at 980 Camden Avenue in a P-D (Planned Development) Zoning District, as per the application filed in the Planning Department on July 16, 1993; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. R 93-02 (S 90-10): 1. The Planning Commission has authority under Section 21.42.100 of the C.M.C. to grant extensions of previous architectural approvals. 2. The current General Plan land use designation for the site allows industrial uses. 3. The current Zoning designation for the site is P-D (Planned Development). 4. A Negative Declaration was previously granted for this project. 5. The project will provide an easement for public access to the Los Gatos Creek Trail. 6. The project will provide a parking easement over a portion of the parking lot for public parking when the business is not in operation. Based upon the foregoing findings of fact, the Planning Commission concludes that: The proposed project, subject to the conditions imposed, will be consistent with the General Plan. The proposed project, subject to the conditions imposed, will aid in the harmonious development of the immediate areas. The proposed project is consistent with Parking, Landscaping and Open Space Ordinances of the City. Resolution No. 2870 R 93-02 (S 90-10) -- 980 Camden Avenue Adopted on August 10, 1993 2 A Negative Declaration was granted for the project as no substantial evidence has been presented which demonstrates that the project would have a significant adverse impact on the environment. The Planning Commission recommends reinstatement of this project, per the attached conditions of approval (Attachment A). Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified. Additionally, the applicant is hereby notified that he is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified. Compliance with all conditions of approval shall be demonstrated prior to issuance of building permits for the project unless otherwise noted. 1. ApprovedPro_iect This approval is for a 7,500 square foot automotive repair building located on a 22,795 square foot site identified as Assessor's Parcel Number 412-01-002. Development shall be substantial as shown on the project materials listed below, except as may be modified by conditions contained herein: ao Project drawings for A&E Performance prepared by Morelan Associates, Inc., consisting of seven sheets, dated 10/31/90. Color board on file in the Planning Department. Perspective Drawing Landscape plan prepared by Morelan Associates, Inc., consisting of one sheet dated 12/18/91. 2. Parking Easq:mCnt The applicant shall record a covenant running with the land over the northerly 12 parking spaces and driveway to allow public parking for users of the Los Gatos Creek Trail on weekends and on weekdays from 6:30 p.m. until the park closing time as p. osted at other available Trail parking sites. The covenant shall be submitted for review and approval of the City Attorney and the Planning Department. No cars associated with the business shall be parked in the northerly 12 spaces during the hours cited above. 3. Parking Sign The applicant shall install a sign at the entry to the parking lot listing the hours during which users of the Los Gatos Creek Trail may use the parking lot. 4. Landscaping on Santa Clara Valley Water District Lands Resolution No. 2870 R 93-02 (S 90-10) -- 980 Camden Avenue Adopted on August 10, 1993 4 The applicant shall provide shrubs on Santa Clara Valley Water District (SCVWD) lands adjacent to the chain link fence on the easterly property line. The intent of the condition is to provide vegetative screening of the fence when viewed from the Los Gatos Creek Trail. The landscaping shall be shown on the final landscape plan and is subject to approval of the Planning Department. Staff may waive this condition if the applicant cannot obtain permission of the SCVWD for such landscaping. pl~blic Works Access Easement Dedicate a 20 foot wide access easement over the driveway area to the Santa Clara Valley Water District. (Satisfied) Path Easement Dedicate a 10 foot wide public path easement to the City of Campbell along the northerly boundary of the site (Satisfied) o Excgvation Permit Obtain an excavation permit, pay fees, and post surety to install cul-de-sac and public path. Provide documentation of a complete land exchange between the City of Campbell and the Santa Clara Valley Water District (SCVWD) and documentation of vacation of Camden Avenue and the former portion of Casey Road. (Satisfied) Pay storm drain fee of $1,110.00. (Paid) Legal Description Provide a legal description for a certificate of compliance. SCVWD Access Provide uninterrupted access to the SCVWD facility during construction. Flood Control Easement Provide an 8 foot wide flood control easement for SCVWD at the top of the concrete bank if required by SCVWD. Gate Radius Provide a 20 foot radius from the gate along the site's easterly property line to the bicycle path and revise the valley gutter. (Satisfied) Buildine Denartment 1. Pacific Gas & Electric Submit the Boundary and Topographical Map to Pacific Gas & Electric (PG&E) Land Use Department. Provide a letter from PG&E authorizing construction within the distances shown on the plan. Fire Denartment 1. Fire Sprinklers Provide supervised f'ue sprinkler protection throughout the building. 2. Fire Hydrant Provide one on-site or municipal fire hydrant located as directed by the Fire Department. 3 Access Driveway vertical clearance shall be maintained at not less than 13 feet, 6 inches above grade.
