BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A
MODIFICATION TO A PREVIOUSLY APPROVED SITE AND
ARCHITECTURAL APPROVAL TO ALLOW CONSTRUCTION OF
A 7,600 SQUARE FOOT BUILDING ADDITION TO A BUILDING
LOCATED AT 477 DIVISION STREET IN A CM (CONTROLLED
MANUFACTURING) ZONING DISTRICT, APPLICATION OF MR.
DENNIS KOBZA. FILE NO. M 93-11.
After notification and Hearing on the application of Dennis Kobza
recommending approval of a modication to a previously approved Site and
Architectural approval to allow the construction of a 7,600 square foot bulding
addition to a building located on property 477 Division Street in a CM
(Controlled Manufacturing) Zoning District, as per the application filed in the
Plan~i,ng Department on August 9, 1993; and, after presentation by the City
Staff, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. M 93-11:
The proposed addition is architecturally compatible with the existing
development.
2. Site provides substantial parking to support the proposed expansion.
3. Substantial landscaping is provided which will enhance the site.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
1. The proposed project is consistent with the General Plan.
The proposed project will enhance the development of the immediate
area.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed.
Further, the applicant is notified as part of this application that he is required
to comply with the following Conditions of Approval:
SITE AND BUILDING DESIGN
1. Approved Project: This approval is for a modification approval allowing

7,600 square foot building addition to an existing industrial building
located at 477 Division Street identified as Assessor's Parcel Number 424-
33-50. Development shall be substantially as shown on the project plans
listed below, except as may be modified by conditions contained herein:

five sheets dated September 10, 1993.
Color board on file in the Planning Department.
LANDSCAPING
2. Landscaping: Detailed landscaping plan indicating quantity, type and
size of plant material, and located irrigation system to be submitted to
the Community Development Department and approved by the
Community Development Director, upon recommendation of the
Landscape Advisor, prior to issuance of a building permit. Landscape
plan shall conform to the landscape plan/design indicated on the
approved plans.
PUBLIC WORKS
3. Install 5 foot concrete sidewalk behind the existing curb and gutter.
4. Install a handicap ramp at the corner of Dell and Division.
5. Submit plans, post surety, pay fees and obtain an encroachment permit
for all work in the public right-of-way.
6. Submit three copies of a grading and drainage plan for review by the City
Engineer.
FIRE DEPARTMENT
7. Provide fire sprinkler protection throughout all new and existing
construction to mitigate the fire flow requirement. Fire sprinkler design
shall be Ordinary Group 2, as defined in the 1989 edition of NFPA 13.
8. Provide an approved fire district key box for the project.
BUILDING DIVISION
9. Provide engineering calculations for second story addition. UBC 302(3)
10. Provide minimum 30" parapet on new roof, upper 18" non-combustible.
UBC 1709.
11. Provide two exits from the second floor per UBC 3303(a).
12. Provide one hour fire resistive construction for corridor. UBC 3305.

STREET/SITE IMPROVEMENTS
13. Parking Maintenance: All parking and driveway areas to be developed
in compliance with Chapter 21.50 of the Campbell Municipal code. All
parking spaces to be provided with appropriate concrete curbs or bumper
guards. (Community Development)
14.
Signs: Sign application to be submitted in accordance with provisions of
the Sign Ordinance for all signs. No sign to be installed until application
is approved and permit issued by Planning and Building Departments
(Section 21.53 of the Campbell Municipal Code). (Community

PROPERTY MANAGEMENT/UTILITIES
15. Property Maintenance: The property is to be maintained free of any
combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by
having windows boarded up and doors sealed shut, or be demolished or
removed from the property (Section 11.201 & 11.414, 1985 Ed. Uniform
Fire Code). (Central Fire District)
16.
Garbage Collection: Ordinance 782 of the Campbell Municipal Code
stipulates that any contract for the collection and disposal of refuse,
garbage, wet garbage and rubbish produced within the limits of the City
of Campbell shall be made with Green Valley Disposal Company. This
requirement applies to all single-family dwellings, multiple family
dwellings, and all commercial, business, industrial, manufacturing, and
construction establishments. (Central Fire District)
17.
Trash Containers: Trash container(s) of a size and quality necessary to
serve the development shall be located in area(s) approved by the Fire
Department. Unless otherwise noted, enclosure(s) shall consist of a
concrete floor surrounded by a solid wall or fence and have self-closing
doors of a size specified by the Fire Department. All enclosures to be
constructed at grade level and have a level area adjacent to the trash
enclosure area to service these containers. (Central Fire District)
PUBLIC SAFETY/WELFARE
18. Handicapped Requirements: Applicant shall comply with all
appropriate State and City requirements for the handicapped. (Building)

19. Underground Utilities: Underground utilities to be provided as required
by Section 20.36.150 of the Campbell Municipal Code. (Public Works)
20.
Utility Boxes and Back-Flow Preventers: Applicant to submit a plan to
the Planning Department, prior to installation of PG&E utility
(transformer) boxes and S.J. Water back-flow preventers, indicating the
location of the boxes and screening (if boxes are above ground) for
approval of the Planning Director. (Community Development)
21.
Equipment Screening: All mechanical equipment on roofs and all utility
meters to be screened for approval by the Planning Director.

22.
Utility Connections: Plans submitted to the Building Division for plan
check shall indicate clearly the location of all connections for
underground utilities including water, sewer, electric, telephone and
television cables, etc. (Building)
23.
Performance Bond: Applicant to either (1) post a faithful performance
bond in the amount of $5,000 to ensure landscaping, fencing and striping
of parking areas within 3 months of completion of construction; or (2)
file a written agreement to complete landscaping, fencing and striping of
parking areas. Bond or agreement to be filed prior to application for a
building permit. (Community Development)
Further, the applicant is notified as part of this application that he is required
to comply with all applicable Codes and Ordinances of the City of Campbell
and the State of California that pertain to this development and are not
herein specified.
