PC Res 2874RESOLUTION NO. 2874 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT ALLOWING A 1,241 SQUARE FOOT SECOND STORY ADDITION TO AN EXISTING NON- CONFORMING DWELLING (INSUFFICIENT GARAGE SETBACK) ON PROPERTY LOCATED AT 234 NORTH SECOND STREET, IN AN R-l-6 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF MR. MICHAEL ROWE ON BEHALF OF ROB AND ANNE NARAGON. FILE NO. UP 93-12. After notification and Public Hearing as specified by law on the application of Michael Rowe, on behalf of Rob and Anne Naragon, to allow a 1,241 square foot second story addition to an existing non-conforming dwelling, as per the application filed in the Planning Department on August 12, 1993; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 93-12: The proposed building addition meets the current zoning standards in which the property is located. The proposed addition is architecturally compatible with the existing structure. o The proposed project is supported by the Site and Architectural Review Committee. Based upon the foregoing findings of fact, the Planning Commission concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. Second Street Adopted on September 28, 1993 Page 2 o The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 4. The proposed use is compatible with the uses in the area. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. Further, the applicant is notified as part of this application that he is required to comply, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with which the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. SITE AND BUILDING DESIGN Approved Project: This approval is for a Conditional Use Permit allowing a 1,241 square foot residential addition on an existing non- conforming property located at 234 N. Second Street identified as Assessor's Parcel Number 279-39-50. Development shall be substantially as shown on the project plans listed below, except as may be modified by conditions contained herein: Project drawings by Britt-Rowe, consisting of five sheets dated August 3, 1993. EXPIRATION OF CONDITIONAL USE PERMIT 2. Conditional Use Permit (93-12) is valid for a period of one year from the date of approval and shall expire on September 28, 1994. BUILDING DEPARTMENT 3. Provide 5/8" X gypsum on all walls and ceiling of existing garage. UBC 503(d). (Building Department) o Provide reinforced perimeter footing on all new bearing walls. UBC T29- A.
