BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CAMPBELL RECOMMENDING APPROVAL OF A TEXT AMENDMENT
TO THE CAMPBELL MUNICIPAL CODE AMENDING CHAPTERS 21.06,
21.08, 21.42, 21.55, 21.64, 21.78, 10.40, 11.24, 20.36. CITY INITIATED
APPLICATION, PLANNING FILE NO. TA 93-02.
After notification and public hearings as specified by law on the proposed
amendments to the text of the Campbell Municipal Code, and after
presentation by the Planning Department, proponents and opponents, the
hearing was closed.
After due consideration of all evidence presented, and based upon the
following findings, the Planning Commission did determine that there was a
significant need to amend Chapters 21.06, 21.08, 21.42, 21.55, 21.64, 21.78, 10.40,
11.24, 20.36 to the Campbell Municipal Code.
The Planning Commission of the City of Campbell finds as follows with
regard to Application TA 93-02:
The Land Use and Circulation Elements of the General Plan have been
revised to reference the San Tomas Neighborhood Plan.
o
The land use policies contained in the San Tomas Neighborhood Plan
implement existing the General Plan policies for the San Tomas Area
which promote maintaining the low density characteristics of the area.
o
The transportation policies contained in the San Tomas Neighborhood
Plan implement existing the General Plan policies for the San Tomas
Area which encourage alternative street improvements and a lesser
street width to reinforce the rural character of the area.
o
The proposed General Plan Amendment to the Circulation Element
modifies the functional classifications for streets in the San Tomas Area
to reflect the current traffic conditions on each street.
o
The proposed amendments to Title 21 of the Campbell Municipal Code
are consistent with the Campbell General Plan Land Use Element and
will implement the land use policies contained within San Tomas
Neighborhood Plan.
o
The proposed amendments to Titles 10, 11, and 20 of the Campbell
Municipal Code are consistent with the Campbell General Plan
Circulation Element and will implement the transportation policies
contained within the San Tomas Neighborhood Plan.

o
An Initial Study has been prepared on the amendments, as required by
the California Environmental Quality Act.
o
A Negative Declaration is appropriate as no significant environmental
impacts have been identified to be associated with this project.
Based upon the foregoing findings of fact, the Planning Commission
concludes that:
The proposed Text Amendments will aid in maintaining the rural
characteristics of the area.
o
The proposed Text Amendments are compatible with the General Plan
policies for the San Tomas Area and will aid the harmonious
development of the San Tomas Area.
o
The proposed Text Amendments will not be detrimental to the health,
safety, or welfare of the San Tomas Area or the city as whole.
Changes to the Titles 10, 11, and 20 of the Campbell Municipal Code do
not generate additional vehicular traffic nor alter significantly the
present patterns of circulation or movement of people or goods.
The Planning Commission does hereby recommend that the City Council
adopt an ordinance enacting the necessary legislation to make the proposed
text amendments effective.

The following Sections are proposed modifications to the Campbell
Municipal Code to implement the San Tomas Neighborhood Plan. Unless
otherwise specified, all Sections are to be added.
Chapter 21.06-PD (Planned Development District)
21.06.025 Relationship to the San Tomas Neighborhood Plan. San
Tomas Neighborhood Plan Policies I, J, and L are incorporated herein by
reference. The San Tomas Neighborhood Plan Policies shall only apply to
properties within the boundaries of the San Tomas Area. The boundaries of
the San Tomas Area are shown on Exhibit A. In the case of conflict between
the aforementioned San Tomas Neighborhood Plan Policies and
requirements contained in this Chapter, the Policies of the San Tomas
Neighborhood Plan shall prevail.
Chapter 21.08--R-1 (Single Family Residential District)
21.08.015 Relationship to the San Tomas Neighborhood Plan. San
Tomas Neighborhood Plan Land Use Policies C, D, E, F, H, I, and J are
incorporated herein by reference. The San Tomas Neighborhood Plan
Policies shall only apply to properties within the boundaries of the San
Tomas Area. The boundaries of the San Tomas Area are shown on Exhibit A.
In the case of conflict between the aforementioned San Tomas Neighborhood
Plan Policies and other requirements contained in this Chapter, the Policies of
the San Tomas Neighborhood Plan shall prevail.
Chapter 21.42--S (Site and Architectural Review Area)
21.42.015 Relationship to the San Tomas Neighborhood Plan. San
Tomas Neighborhood Plan Policy J is incorporated herein by reference. The
San Tomas Neighborhood Plan Policy shall only apply to properties within
the boundaries of the San Tomas Area. The boundaries of the San Tomas
Area are shown on Exhibit A. In the case of conflict between the
aforementioned San Tomas Neighborhood Plan Policy and requirements
contained in this Chapter, the Policy of the San Tomas Neighborhood Plan
shall prevail.

Chapter 21.55--Residential Setbacks and Open Space
21.55.015 Relationship to the San Tomas Neighborhood Plan. San
Tomas Neighborhood Plan Policies B and G are incorporated herein by
reference. The San Tomas Neighborhood Plan Policies shall only apply to
properties within the boundaries of the San Tomas Area. The boundaries of
the San Tomas Area are shown on Exhibit A. In the case of conflict between
the aforementioned San Tomas Neighborhood Plan Policies and
requirements contained in this Chapter, the Policies of the San Tomas
Neighborhood Plan shall prevail.
Chapter 21.64--Nonconforming Buildings
Note: Proposed additional text for this Chapter is underlined.
21.64.060 Exceptions.
A. Provided that where a building or structure nonconforming solely
because it fails to meet the setback requirements for the district in which it is
located, it may be added to or enlarged, upon issuance of a conditional use
permit as prescribed in Chapter 21.72, Conditional Uses. Such addition must
meet all other standards of the district in which it is located.
B. Additions to legally existing structures in the San Tomas Area may
be a~--ded to or enlarged as allowed under Policy G of the San Tomas
Neighborhood Plan. Policy G is incorporated herein by reference. The
boundaries of the San Tomas Area are shown on Exhibit A. In the case of
conflict between the San Tomas Neighborhood Plan Policy G and
requirements contained in this Chapter, Policy G of the San Tomas
Neighborhood Plan shall prevail.
Chapter 21.78-Public Hearing Notice Procedures
21.78.030 Notices in San Tomas Area. Notices of public hearings for a
general plan amendment or zone change within the San Tomas Area shall be
given as specified in Section 21.78.020. In addition, a notice containing the
time, place, and general purpose of the hearing shall be posted on the parcel(s)
at least ten days prior to the hearing for hearings involving a specific parcel(s).
The boundaries of the San Tomas Area are shown on Exhibit A.

Chapter 10.40--Restricted-Unrestricted Streets

10.40.020 Unrestricted streets or truck routes. The city council finds that
the designation of the following streets as unrestricted streets or through
passage truck routes will adequately protect the public health, safety, and
welfare and will reasonably provide through truck passage for vehicles in
excess of six thousand pounds through the city. The city council does
therefore designate the following streets as unrestricted or truck routes within
the city, as follows:
(1) Bascom Avenue;

(3) Campbell Avenue from westerly city limit to Bascom Avenue;

The city council may, by resolution, add other unrestricted streets or delete
certain streets when it finds that public safety and the convenience of the
public will be better enhanced.
Chapter ll.24--Street Improvements

11.24.160 Standard Specifications.
A. Except as otherwise provided by this chapter, improvements herein
required shall be made in accordance with the standard specifications of the
city, current at the time the improvements are made. When a required
improvement is not provided for by standard specifications of the city, the
nature and type of any such improvement shall be as approved by the city
engineer.
B_ Improvements for the San Tomas Area shall be consistent with the
Transportation Issues Section of the San Tomas Neighborhood Plan
Transportation. The boundaries of the San Tomas Area are shown on Exhibit
A. In the case of conflict between the San Tomas Neighborhood Plan and
requirements contained in this Chapter, the San Tomas Neighborhood Plan
shall prevail.
Chapter 20.36--Subdivision and Land Development

20.36.090 Width of Streets and Highways. Streets and highways not
shown on any general plan or incorporated in approved plan lines or affected
by proceedings initiated by the city council or approved by the city council
upon initiation by other legally constituted governmental bodies shall not be
of less width than those set forth under this chapter, except where it can be
shown by the subdivider, to the satisfaction of the planning commission, that
the topography or the small number of lots served and the probable future
traffic development are such as to unquestionably justify a narrower width.
Increased widths may be required where streets are to serve commercial
property, or where probable traffic conditions warrant such increased widths.

1. Local streets--minimum right-of-way: sixty feet;
2. Cul-de-sac streets--if not over three hundred fifty feet in length, may
provide fifty-six feet right-of-way.
