A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
RESCINDING THE HISTORIC RESOURCE INVENTORY DESIGNATION OF
PROPERTY LOCATED AT 119 S. SECOND STREET IN THE CITY OF CAMPBELL
WHEREAS, the City's process to designate a property to the Historic Resources
Inventory is voluntary and the property owner does not consent to having their home
designated on the Historic Resources Inventory.
WHEREAS, the property at 119 South Second Street will be retained on the City's
"potential" Historic Resource Inventory survey list allowing the opportunity for future
designation because the property is locally important and possesses significant
aesthetic, architectural, and engineering interest of an historical nature, and should be
identified for the community's knowledge and benefit.
WHEREAS, retaining the property on the City's "potential" Historic Resource Inventory
survey list is consistent with the purposes of the City of Campbell Historic Preservation
Ordinance and the General Plan, which has a goal to identify valuable and potentially
valuable historic resources.
WHEREAS, the designation of the property on the City's HRI was Categorically Exempt
under Section 15331, Class 31 of the California Environment Quality Act (CEQA),
pertaining to projects involving the maintenance, rehabilitation, restoration, preservation,
or reconstruction of historical resources. The City Council's program to allow property
owners to voluntarily place their properties on the HRI could be found to establish a
CEQA threshold of significance implying that such designation would be considered
environmentally significant if the property owner was initially in agreement with said
designation. Because this property owner was not in agreement, the property should not
have been designated as an HRI property in the first place. In this regard, no
environmental impact would occur with the property's removal.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby rescinds the designation of property located at 119 South Second Street from
the City of Campbell's Historic Resource Inventory list while retaining the property on
the City's "potential" Historic Resource Inventory survey list allowing the opportunity for
future designation.
