BEING A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF CAMPBELL, CALIFORNIA,
RECOMMENDING A REINSTATEMENT OF A
PREVIOUSLY APPROVED PLANNED DEVELOPMENT
PERMIT ALLOWING THE CONSTRUCTION OF PHASE II
(THREE TOWNHOME UNITS) OF LATIMER VILLA,
LOCATED AT 65-85 E. LATIMER AVENUE IN A PD
(PLANNED DEVELOPMENT) ZONING DISTRICT.
APPLICATION OF STEVE SARAY, FILE NO. R 93-04
After notification and Public Hearing as specified by law on the application of
Mr. Steve Saray for reinstatement of a previously approved Planned
Development Permit allowing the construction Phase II (three townhome
units) of Latimer Villa, located at 65-85 E. Latimer Avenue in a PD (Planned
Development) Zoning District, as per the application filed in the Planning
Department on September 30, 1993; and, after presentation by the Planning
Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. R 93-04 (PD 89-16):
1. The proposed project is consistent with the current General Plan policies.

The proposed project is consistent with the previously approved
Planned Development Permit.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
The proposed project, subject to the conditions imposed, will be
consistent with the General Plan of the City.

The proposed project will aid in the harmonious development of the
immediate area.
The Planning Commission recommends reinstatement of this project, per the
following conditions of approval and exhibits:
SITE AND BUILDING DESIGN
1. Building Occupancy: Building occupancy will not be allowed until
public improvements are installed. (Public Works)
Approved Project: The approval is for reinstatement of a portion of the
Planned Development Permit located on 65-85 E. Latimer Avenue, APN:

279-52--007, 8, 9. Approved plans include those demonstrated in the
exhibits prepared by Nadcon Development, Inc., sheets A-l, A-2, A-7, A-8
and A-9. (Planning)
LANDSCAPING
3. Landscaping: Landscaping for the proposed development will be subject
to the landscaping plan submitted in 4-12-90 and prepared by Greg G. Ing
and Associates. (Planning)
STREET/SITE IMPROVEMENTS
4. Parking and Driveways: All parking and driveway areas to be developed
in compliance with Chapter 21.50 of the Campbell Municipal Code. All
parking spaces to be provided with appropriate concrete curbs or bumper
guards. (Planning)

Fences: Fencing plan indicating location and design details of fencing to
be submitted to the Planning Department and approved by the
Community Development Director prior to issuance of a building
permit. (Planning)

Property Maintenance: The property is to be maintained free of any
combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by
having windows boarded up and doors sealed shut or removed from the
property. (Section 11.201 & 11.414, 1985 edition, Uniform Fire Code.)

Garbage Collection: Ordinance 782 of the Campbell Municipal Code
stipulates that any contract for the collection and disposal of refuse,
garbage, wet garbage and rubbish produced within the limits of the City
of Campbell shall be made with Green Valley Disposal Company. This
requirement applies to all single-family dwellings, multiple family
dwellings and all commercial, business, industrial, manufacturing and
construction establishments. (Fire)
Trash Containers: Trash container(s) of a size and quality necessary to
serve the development shall be located in area(s) approved by the Fire
Department. Unless otherwise noted, enclosure(s) shall consist of a
concrete floor surrounded by a solid wall or fence and have self-closing
doors of a size specified by the Fire Department. All enclosures to be

constructed at grade level and have a level area adjacent to the trash
enclosure area to service these containers. (Fire)
PUBLIC SAFETY/WELFARE
9. Handicapped Requirements: Applicant shall comply with all
appropriate State and City requirements for the handicapped. (Building)
10. Underground Utilities: Underground utilities to be provided as required
by Section 20.36.150 of the Campbell Municipal Code. (Public Works)
11.
Utility Boxes and Back-Flow Preventers: Applicant to submit a plan to
the Planning Department, prior to installation of PG&E utility
(transformer) boxes and San Jose Water back-flow preventers, indicating
the location of the boxes and screening (if boxes are above ground) for
approval of the Community Development Director. (Planning)
12. Equipment Screening: All mechanical equipment on roofs and all utility
meters to be screened for approval by the Planning Director. (Planning)
13.
Utility Connections: Plans submitted to the Building Division for plan
check shall indicate clearly the location of all connections for
underground utilities including water, electric, telephone and television
cables, etc. (Building)
14.
Noise Levels: Noise levels for the interior of residential units shall
comply with minimum State (Title 24) and local standards as indicated
in the Noise Element of the Campbell General Plan. (Building)
15. Grading and Drainage Plans: Provide grading and drainage plans for
review by the City Engineer. (Public Works)
16.
Park Impact Fee: Applicant to pay Park Impact Fee in effect at time of
issuance of building permits. Applicant to be credited for previous Park
Dedication Fees paid. (Public Works)
17.
Performance Bond: Applicant to either: 1) Post a faithful performance
bond in the amount of $5,000 to ensure landscaping, fendng and striping
of parking areas within 3 months of completion of construction; or 2)
File a written agreement to complete landscaping, fendng and striping of
parking areas. Bond or agreement to be filed prior to application for a

building permit. (Planning)
Complete Frontage Improvements: Prior to issuance of building permits
on the remaining three townhome units, request final inspection and
complete improvements on the frontage of the units which are currently
occupied. (Public Works)
Street Improvement Agreement: Prior to issuance of building permits
on the remaining three townhome units, execute an agreement to
construct street improvements in the public right-of-way. (Public
Works)
Encroachment Permit: Prior to issuance of building permits on the
remaining three townhome units, submit plans, pay fees, post surety and
obtain an encroachment permit to construct street improvements in the
public right-of-way in accordance with the previously approved street
improvement plan. (Public Works)
Fire Resistive Exterior Walls: Provide one hour fire resistive exterior
walls where less than three feet from the property line. (Building)
Exterior Wall Openings: Openings in exterior walls not permitted less
than three feet from the property line. (Building)
Further, the applicant is notified as part of this application that he is required
to comply with all applicable Codes and Ordinances of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.
