BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL ADOPTING A NEGATIVE DECLARATION (PLN2015-
329) FOR THE PLANNED DEVELOPMENT PERMIT (PLN2015-35);
TENTATIVE PARCEL MAP (PLN2015-36); ZONING MAP
AMENDMENT (PLN2015-37); AND A TREE REMOVAL PERMIT
(PLN2015-38) ON PROPERTY LOCATED AT 1685 BUCKNALL
ROAD.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
The City Council finds as follows with regard to the Negative Declaration (PLN2015-329):
Environmental Finding
1. An Initial Study in accordance with CEQA (California Environmental Quality Act) has
been prepared for the project, which provides documentation for the factual basis for
concluding that a Negative Declaration may be adopted since no substantial evidence
exists, in light of the whole record, that the project may have a significant effect on the
environment. The project consists of a Planned Development Permit (PLN2015-35);
Tentative Parcel Map (PLN2015-36); Zoning Map Amendment (PLN2015-37); and a
Tree Removal Permit (PLN2015-38) on property located at 1685 Bucknall Road.
Evidentiary Findings
1. The proposed project includes an application fora Planned Development Permit
(PLN2015-35) to allow the construction of three, two-story, detached single-family
townhomes; Tentative Parcel Map (PLN2015-36) to subdivide a parcel into four parcels
including one common lot, Zoning Map Amendment (PLN2015-37) to allow a PD
zoning designation, and a Tree Removal Permit (PLN2015-38) on property located at
1685 Bucknall Road.
2. An Initial Study has been prepared for the Project located at 1685 Bucknall Road,
which provides documentation for the factual basis for concluding that a Negative
Declaration may be adopted since no substantial evidence exists, in light of the whole
record, that the project may have a significant effect on the environment.
3. The Negative Declaration describes the reasons that the Project will not have a
significant effect on the environmeht and therefore does not require the preparation of
an Environmental Impact Report, pursuant to the California Environmental Quality Act
Guidelines.
4. There are no responsible agencies or trustee agencies responsible for resources
affected by the Project.

5. The City of Campbell provided a Notice of Intent to adopt a Mitigated Negative
Declaration to the public via the Campbell Express, the County Clerk, and on the City
website.
6. The City of Campbell provided a 20-day public review period of the draft Mitigated
Negative Declaration pursuant to the California Environmental Quality Act Guidelines.
The 20-day public review period was October 7, 2015 to October 27, 2015.
Based upon-the foregoing findings of fact, the City Council further finds and concludes
that:
7. The Negative Declaration reflects the independent judgment and analysis of the
Planning Commission.
8. No substantial evidence has been presented from which a reasonable argument could
be made that shows that the project, as currently presented and subject to the required
Conditions of Approval, will have a significant adverse impact on the environment.
9. The Custodian of the Record for the Negative Declaration and Initial Study is the
Community Development Department of the City of Campbell, located at 70 North First
Street, Campbell, California.
THEREFORE, BE IT RESOLVED that the City Council adopts a Negative Declaration
(PLN2015-329) (attached Exhibit A) for Planned Development Permit (PLN2015-35);
Tentative Parcel Map (PLN2015-36); Zoning Map Amendment (PLN2015-37); and a Tree
Removal Permit (PLN2015-38) on property located at 1685 Bucknall Road.

NEGATIVE DECLARATION
The Community Development Director has reviewed the proposed project described
below to determine whether it could have a significant effect on the environment as a
result of the project completion. "Significant effect on the environment" means a
substantial, or potentially substantial, adverse change in any of the physical conditions
within the area affected by the project including land, air, water, minerals, flora, fauna,
ambient noise, and objects of historic or aesthetic significance.

Project Location and Surrounding Land Use: The project site consists of a single
parcel located on Bucknall Road between Della Court and Rachel Court. The 12,074
square foot (net area) lot is currently developed with one single-family residence that
will be demolished as part of the proposed subdivision. Abutting land uses include
single-family residences to the north, east, south, and west. The City of Campbell
Zoning Map classifies the project site as R-2 (Multiple-Family Residential). The
corresponding General Plan Land Use Designation is Medium Density Residential (14-
20 units/gr. acre).

Project Description: The project is an application for a Tentative Parcel Map to allow
subdivision of the project site into three single-family residential parcels, ranging from
2,625 to 3,210 square feet in area. The project also includes a common lot consisting of
a private street and driveway for the subdivision. Access to the private street/driveway
would be taken from the north side of Bucknall Road. The private street will be 20 feet
wide with an additional 2 foot wide landscape buffer on the west side of the drive aisle.
The development will include construction of three two-story single-family residences at
a maximum height of 25 feet from existing grade and an average floor area ratio of 59%
for the entire development.
Finding: The Community Development Director finds that the proposed project will not
have a significant effect on the environment and does not require the preparation of an
environmental impact report and therefore a NEGATIVE DECLARATION will be
prepared.
Any person may file a written prgtest of the draft Negative Declaration before 5:00 p.m.
on October 27, 2015. Such protest must be filed at the Community Development
Department, City Hall, 70 North First Street, Campbell, California. The written protest
should make a "fair argument" that the project will have one or more significant effects
on the environment based on substantial evidence.
