BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL APPROVING A TREE REMOVAL
PERMIT (PLN2015-322) TO ALLOW THE CONDITIONAL
REMOVAL OF AN TWENTY-ONE TREES AT THE VASONA
TECHNOLOGY PARK ON PROPERTY LOCATED AT 1315
DELL_ AVENUE, 1353 DELL AVENUE, 210 E. HACIENDA
AVENUE, AND 200 E. HACIENDA AVENUE.
After notification and public hearing, as specified by law and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
The Planning Commission finds as follows with regard to File No. PLN2015-322:
1. The project site consists of 4 parcels, totaling 18'/Z acres.
2. The project site is located at the southeast corner of Winchester Boulevard and East
Hacienda Avenue.
3. The project site is zoned C-M/80 (Controlled Manufacturing / 80,000 sf. min. parcel
size) as shown on the Campbell Zoning Map.
4. The project site is designated Research and Development as shown on the Campbell
General Plan Map.
5. The project site is bordered by commercial and industrial uses to the north, south, and
east, and Winchester Boulevard to the west.
6. The project site is developed with aseven-building business park, commonly known as
the Vasona Tf~chnology Park.
7. The business park was originally created in 1980 when the Planning Commission
approved the remodel of the former IBM processing building and construction of six
new office/manufacturing/warehousing buildings.
8. The Planning Commission approved a remodel of the business park buildings in 2000
to accommodate research and development uses and for approval of a parcel map to
subdivide the property into four parcels.
9. The project site encompasses a variety of research and development, medical (Kaiser
Permanente), and professional office uses.
10. The proposed project would allow exterior alterations to the existing commercial
buildings, including installation of new entry features, enlargement of window openings,
restriping of the entire parking lot, and creation of new courtyards.
11. The proposec project will also include the removal of 21 protected trees due to their
location, which would preclude the construction of the proposed site improvements.

12. Alternate placement of the site improvements to preserve the trees would result in
undesirable site configuration.
13. As a condition of approval, the proposed project will include new trees consistent with
the requirements of the Campbell Tree Preservation Ordinance.
Based upon the foregoing findings of fact, the Planning Commission further finds and
concludes that:
14. The retention of the trees restricts the economic enjoyment of the property and creates
an unusual hardship for the property owner by severely limiting the use of the property
in a manner not typically experienced by owners of similarly zoned and situated
properties, and the applicant has demonstrated to the satisfaction of the Planning
Commission ghat there are no reasonable alternatives to preserve the trees due to the
number of site constraints of the infill site.
15. The project Categorically Exempt under Section 15301 (Class 1) of the California
Environmental Quality Act (CEQA) Guidelines, pertaining to alterations to existing
private structures involving negligible or no expansion of use beyond that existing at the
time of the lead agency's determination.
THEREFORE, E3E IT RESOLVED that the Planning Commission approves a Tree
Removal Permit (PLN2015-322), subject to the attached recommended Conditions of
Approval (attached Exhibit A).

CONDITIONS OF APPROVAL
Tree Removal Permit (PLN2015-322)
Where approval by the Director of Community Development, City Engineer, Public Works
Director, City Attorney or Fire Department is required, that review shall be for compliance
with all applicablf: conditions of approval, adopted policies and guidelines, ordinances,
laws and regulations and accepted engineering practices for the item under review.
Additionally, the applicant is hereby notified that he/she is required to comply with all
applicable Codes or Ordinances of the City of Campbell and the State of California that
pertain to this development and are not herein specified.
COMMUNITY DEVELOPMENT DEPARTMENT
1. Approved Permit: Approval is granted for a Tree Removal Permit (PLN2015-322) to
allow the removal of trees as specified in the Vasona Business Park Arborist Report
and Tree InvE~ntory, prepared by KLA, Inc., dated October 20, 2015, on properties
located at 1315 Dell Avenue, 1353 Dell Avenue, 210 E. Hacienda Avenue, and 200
E. Hacienda Avenue, except for (Redwood) Trees No. 128, 129, and 131, which shall
be preserved. This permit shall be valid only in conjunction with the associated Site and
Architectural R'.eview Permit (PLN2015-270).
2. Time of Removal: The protected trees shall only be removed only upon
commencement of construction of the approved building and site improvements.
3. Replacement Required: The landscaping plans included in the construction drawings
for a building permit shall indicate planting of one (1) 15-gallon for each tree to be
removed that i;s less than 12-inches (DBH) and one (1) 24-inch box tree for each tree to
be removed thiat is greater than 12-inches in diameter. The Community Development
Director shall cletermine the species of the replacement trees.
