CC Resolution 12052RESOLUTION NO. 12052 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING THE CITY'S BELOW MARKET RATE (BMR) PROGRAM ELIGIBILITY INTERIM GUIDELINES. WHEREAS, on October 3, 2006, the City Council adopted Ordinance No. 2074, implementing the City's Inclusionary Housing Ordinance (Chapter 21.24); and WHEREAS, Campbell Municipal Code (CMC) Section 21.24.040(F) establishes a preference in the rental or purchase of affordable units; and WHEREAS, CMC Section 21.24.060(C) provides that no household shall be permitted to begin occupancy of an affordable unit unless the City or its designee has approved the household's eligibility; and WHEREAS, on June 7, 2016, the City Council authorized the City Manager to enter into a Professional Services Agreement with Nyanda & Associates, LLC, a California Limited Liability Company, d/b!a HouseKeys to administer the City's Affordable Housing Programs including determining eligibility for the City's BMR Program; and WHEREAS, CMC Section 21.24.100(A) provides that the City Council may adopt guidelines, by resolution, to assist in the implementation of all aspects of the City's Inclusionary Ordinance; and WHEREAS, the BMR Eligibility Interim Guidelines will assist staff and HouseKeys in implementing the City's Inclusionary Ordinance and determining eligibility for the BMR Program including the preference for individuals who live and/or work in Campbell; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell hereby approves the Eligibility Guidelines as an interim measure prior to reviewing and adopting a more comprehensive BMR Guidelines at a future date uncertain.
