PC Res 4359RESOLUTION NO. 4359 BEING A RESOLUTION OF THE PLANNING COMMISSION OAF THE CITY OF CAMPBELL APPROVING A SITE AND ARCHITECTURAL REVIEW PERMIT (PLN2016-333) TO ALLOW FACADE CHANGES TO AN EXISTING DOWNTOWN BUILDING ON PROPERTY LOCATED AT 296 E. CAMPBELL AVENUE. FILE NO.: PLN2016-333 After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. The Planning Commission finds as follows with regard to file number PLN2016-333: 1. The project site is zoned C-3 (Central Business District) and designated Cenfral Commercial by the General Plan Land Use Map. 2. The project site is located on the south side of East Campbell Avenue, between First Street and Central Avenue. 3. The building elevation was changed to include reclaimed wood siding as a primary building material, which is inconsistent with the City's Downtown Development Plan policies and strategies. 4. Reclaimed wood siding as a primary building material is inconsistent with the City's C-3 (Central Commercial) Zoning Ordinance provisions. 5. Reclaimed wood siding as an accent material is consistent with the Downtown Development Plan and C-3 (Central Commercial) Zoning Ordinance. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The project will be consistent with the General Plan; 2. The project will aid in the harmonious development of the immediate area; and 3. The project is consistent with applicable adopted design guidelines. 4. This project is Categorically Exempt under Section 15301 Class 1 of the California Environmental Quality Act (CEQA) pertaining to minor alterations to an existing private structure, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. THEREFORE, BE IT RESOLVED that the Planning Commission approves a Site and Architectural Review Permit (PLN2016-333) to allow for facade changes on property located at 296 E. Campbell Avenue, subject to the attached Conditions of Approval (attached Exhibit "A"). Planning Commission Resolution No. 296 E. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT Planning Division Approved Project: Approval is granted for a Site and Architectural Review Permit (PLN2016-333) to allow facade changes to an existing building located at 296 E. Campbell Avenue. The project shall substantially conform to Option 4 of the staff report, with a modification allowing the original painted wood siding to remain and be painted to match the building parapet wall in lieu of new stucco and the west building wall visible from E. Campbell Avenue shall be painted to match the parapet wall. 2. Building Permit Required: The applicant shall secure a building permit in compliance with the Title 18 (Building Codes and Regulations) of the Campbell Municipal Code no later than March 16, 2017. Upon issuance of a building permit, the applicant shall cause all necessary improvements to be completed and secure a permit "final" for the facade improvements no later than April 17, 2017. 3. Expiration of Approval and Abatement of Violation: If the applicant fails to satisfy the any of the deadline requirements of Condition No. 2, this Site and Architectural Review Permit shall be deemed void. The applicant or property owner shall therein, upon order of the Community Development Director, restore the facade to its original condition. Should the applicant or property owner fail to remove the reclaimed wood siding and restore the facade, the City shall take all necessary and appropriate action to abate the violation. Any and all cost associated with abatement shall be liened against the property as allowed by law. 4. Acceptance of Permit and Requirements: Should the applicants fail to file a valid and timely appeal of this permit approval (Site and Architectural Review Permit) within the applicable appeal period, pursuant to Campbell Municipal Code Sec. 21.62.030, such inaction shall be deemed to constitute acceptance of permit approval and all associated requirements by the applicants and property owner. 5. Planning Final Required: Planning Division clearance is required prior to final Building Permit clearance. Construction not in substantial compliance with the approved project plans shall not be approved without prior authorization of the necessary approving body. 6. Construction Activities: The applicant shall abide by the following requirements during construction: Exhibit A -Conditions of Approval ~ 296 E. Campbell Avenue File No. PLN2016-333 Page 2 a. The project site shall be posted with the name and contact number of the lead contractor in a location visible from the public street prior to the issuance of building permits. b. Construction activities shall be limited to weekdays between 8:00 a.m. and 5:00 p.m. and Saturdays between 9:00 a.m. and 4:00 p.m. No construction shall take place on Sundays or holidays unless an exception is granted by the Building Official. c. All construction equipment with internal combustion engines used on the project site shall be properly muffled and maintained in good working condition. d. Unnecessary idling of internal combustion engines shall be strictly prohibited. e. All stationary noise-generating construction equipment, such as air compressors and portable power generators, shall be located as far as possible from noise-sensitive receptors such as existing residences and businesses. Use standard dust and erosion control measures that comply with the adopted Best Management Practices for the City of Campbell. Building Division 7. PERMITS REQUIRED: A building permit application shall be required for the new installed siding on the (e) commercial structure. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. 8. CONSTRUCTION PLANS: The conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 9. SIZE OF PLANS: The minimum size of construction plans submitted for building permits shall be 24 in. X 36 in. 10.APPROVALS REQUIRED: The project requires the following agency approval prior to issuance of the building permit: a. Santa Clara County Fire Department
