PC Res 4367RESOLUTION NO. 4367 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MASTER SIGN PLAN WITH PROVISIONS TO ALLOW AN ADDITIONAL NUMBER OF SIGNS AND AN INCREASE IN ALLOWABLE SIGN AREA FOR THE KIRKWOOD PLAZA SHOPPING CENTER LOCATED AT 1570-1820 W. CAMPBELL AVENUE AND 75 S. SAN TOMAS AQUINO ROAD. FILE NO.: PLN2016-166 After notification and public hearing; as -specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. The Planning Commission finds as follows with regard to file number PLN2016-166: 1. The project site is the Kirkwood Plaza Shopping Center, a 12-acre commercial shopping center located south of W. Campbell Avenue, west of San Tomas Aquino Road, and east of Fulton Street . 2.. The project site has three frontages, taking access from Fulton Street, West Campbell Avenue and S. San Tomas Aquino Road. 3. Preparation of a Master Sign Plan is required for a nonresidential project with four or more tenants, which seeks approval of two or more signs: 4. The- applicant is. requesting approval of a new Master Sign Plan to. establish. . guidelines for the appearance and placement of monument, landmark identification,. . and tenant signs throughout a 12-acre commercial shopping center. 5. The applicant's proposal includes a request to allow an additional number of monument signs .(see discussion on Additional Number of Signs), and an increase in allowable sign area to allow signs greater than 50 square feet in area (see discussion on Increase in Allowable Sign Area). 6. Allowance for additional monument signs is necessary to ensure sufficient visibility commensurate with, the size of the shopping .center and distance between monument signs. 7. Allowance for an increase in allowable sign area is necessary to allow the signs to be visible from a reasonable distance, and in recognition of the. size(s) of the tenant spaces. Based upon the foregoing findings of fact, the Planning Commission further finds 'and concludes that: 8. The size of signs otherwise allowed by the Sign Ordinance would not be visible to the public due to issues of distance or obstructions that are beyond the control of the owner of the site on which the signs are or would be located; 9. The. sign area and height proposed are not more than is necessary to allow the signs to be visible and intelligible to a person of normal sight; 10. The signs do not exceed forty-five feet in height and/or three hundred fifty square feet in area; l 11. The .size of signs otherwise allowed by the Sign Ordinance would not be visible to Planning Commission Resolution No. 1570-1820 W. Campbell Avenue & 75 S. Paae 2 of 2 the public due to issues, of distance or obstructions that are beyond the control of the owner of the site on which the signs are or would be located; 12.The number of signs otherwise allowed by the Sign Ordinance could not be made visible and intelligible to a person of normal sight by allowing an increase in the area or height; - ~ - 13.The additional signs comply with all the requirements of this chapter, except for the limitations on the number of signs; and 14.The number of signs do not exceed the minimum number of signs necessary to make the signs visible to the public due to issues of distance or obstructions that are beyond the control of the owner of the site on which the signs are or would be located, which could not be accomplished, by the number of-signs otherwise allowed by this chapter. 15. The project is Categorically Exempt under Sections 15311, Class 11 of the California Environmental Quality Act (CEQA) pertaining to the construction or placement of on premise signs. THEREFORE, ~BE IT RESOLVED that the Planning Commission approves a Master Sign Plan (PLN2016-166) with provisions to allow an additional number of signs and an increase in allowable sign area for the Kirkwood Plaza Shopping Center located at 1570- 1820 11V. Campbell Avenue and 75 S. San Tomas Aquino Road, subject to the attached Conditions of Approval (attached Exhibit "A").. Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditionsof approval, adopted policies and .guidelines, ordinances, laws and regulations and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the. State of California that pertain to this development and. are not herein specified.. 1. improved Project: Approval ,is granted for a Master Sign Plan (PLN2016-166) with provisions to allow an additional number of signs and an increase in allowable sign area for the .Kirkwood Plaza Shopping Center located at 1.570-1820 W. Campbell Avenue and 75 S. San Tomas Aquino, stamped as received by the Planning Division on February 2, 2017, except as modified by the conditions of approval herein. 2. Sign- Permit Required: All signs permitted under the Master Sign Plan shall require a Sign Permit prior to installation. ,. 3. Future Changes: Any sign inconsistent with -the approved Master Sign Plan shall require approval of a Modification to the Master Sign Plan. 4. Sign Maintenance: The signs shall be maintained in good condition at all times and shall be repaired or replaced as necessary. Monument Identification Sign MID-2 shall not be replaced if removed. 5. Building Permits Required: The applicant shall obtain all necessary building and/or electrical permits from the Building Division .prior to the installation of any new signs.
