A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING AWARD OF EQUIPMENT CONTRACT FOR TRAFFIC SIGNAL
CONTROLLER CABINET REPLACEMENT PROJECT 14-FF TO THE SECOND-
LOWEST BIDDER
WHEREAS, on September 6, 2016, the City Council adopted Resolution No. 12038
authorizing the Public Works Director to award the equipment contract to purchase six
controller cabinets to Western Pacific Signal (WPS) in an amount not to exceed
$86,328.00 and to encumber a 10% contingency not to exceed $8,632.80 for a total
encumbrance of $94,960.80 for the Traffic Signal Controller Cabinet Replacement
Project 14-FF; and
WHEREAS, WPS has failed to furnish the controller cabinets in a timely manner; and
WHEREAS, on February 9, 2017, staff notified WPS that the City was terminating its
contract with WPS; and
WHEREAS, staff recommends authorizing the Public Works Director to award the
equipment contract to Western Systems, the second-low bidder, in the amount not to
exceed $99,606.42 and encumber a 10% contingency in an amount not to exceed
$9,960.64 for a total encumbrance not to exceed $109,567.06; and
WHEREAS, the Citywide ITS Enhancements Project 17-FF includes Vehicle
Registration Fee (VRF) grant funds for the Project 14-FF construction cost of
$105,500.OO;and
WHEREAS, Project 14-FF would have $79,653.84 remaining for construction of Project
14-FF: and
WHEREAS, per the terms of the procurement of the controller cabinets for Project 14-
FF, the City owes no payment to WPS.
NOW, THEREFORE, BE IT RESOLVED that the City Council authorizes the Public
Works Director to award the equipment contract to Western Systems in the amount not
to exceed $99,606.42 and encumber a 10% contingency in an amount not to exceed
$9,960.64 for a total encumbrance not to exceed $109,567.06 for the Traffic Signal
Controller Cabinet Replacement Project 14-FF.
