CC Resolution 12127RESOLUTION NO. 12127 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING BUDGET ADJUSTMENTS FOR ST. ANTON'S SIGNAL EQUIPMENT IMPROVEMENTS PROJECT 17-XX AND DILLON AVENUE HOMES SIGNAL EQUIPMENT IMPROVEMENTS PROJECT 17-YY WHEREAS, on October 6, 2015, the City Council adopted Ordinance No. 2192 approving a planned development permit (PLN 2014-323 through -325, -329, 2015-053, and 2015-167) for 208 & 226-328 Railway Avenue and a portion of 290 Dillon Avenue (henceforth called the St. Anton's Project); and WHEREAS, at that time the conditions of approval required the applicant for the St. Anton's Project to post a deposit of $75,000 for the purchase and installation of miscellaneous traffic signal equipment improvements including new radar speed signs on Railway and Kennedy Avenues and emergency vehicle preemption equipment at the Union Avenue/Duncanville Court intersection; and WHEREAS, on May 18, 2016, the applicant for the St. Anton's Project paid a $75,000 deposit to the City under Encroachment Permit #2015-00258; and WHEREAS, a budget adjustment in the amount of $75,000 is required to acknowledge developer's fees available to install the signal equipment improvements associated with traffic generated by the St. Anton's Project; and WHEREAS, the radar signs will help to calm traffic along Railway and Kennedy Avenues and the emergency vehicle preemption equipment at Union Avenue/Duncanville Court will improve County Fire response times to the St. Anton's Project site and all emergencies in general; and WHEREAS, the St. Anton's Signal Equipment Improvements Project will be given the Capital Improvement Program (CIP) project number of 17-XX; and WHEREAS, on December 1, 2015, the City Council adopted Ordinance No. 2195 approving a modification (PLN 2015-170) to a previously approved and modified planned development permit (PLN 2013-337/PLN 2015-48) for 180/86, 190, 230, 240, 260, 272, 280, 282, and 290 (portion) Dillon Avenue; 466, 472, 482, and 488 Sam Cava Lane; and, 186 Gilman Avenue (henceforth called Dillon Avenue Homes Project); and WHEREAS, at that time the conditions of approval required the applicant to post a deposit of $30,000 for the purchase and installation of emergency vehicle preemption equipment at the Campbell Avenue/Gilman Avenue and Campbell Avenue/Union Avenue intersections; and WHEREAS, by April 4, 2016, the applicant for the Dillon Avenue Homes Project had paid a deposit totaling $30,000 to the City under Encroachment Permit #2015-00055; and WHEREAS, a budget adjustment in the amount of $30,000 is required to acknowledge developer's fees available to install the traffic signal equipment improvements associated with traffic generated by the Dillon Avenue Homes Project; and WHEREAS, the emergency vehicle preemption equipment at the Campbell Avenue/Gilman Avenue and Campbell Avenue/Union Avenue intersections will improve County Fire response times to the Dillon Avenue Homes Project site and all emergencies in general; and WHEREAS, Dillon Avenue Homes Signal Equipment Improvements Project will be given the CIP project number of 17-YY; and WHEREAS, the attached budget adjustments have been prepared for Council's consideration to provide $75,000 in developer's fees for the St. Anton's Signal Equipment Improvements Project 17-XX and $30,000 in developer's fees for the Dillon Avenue Homes Signal Equipment Improvements Project 17-W. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell approves the budget adjustment allocating $75,000 in developer's funds to the St. Anton's Signal Equipment Improvements Project 17-XX and related transfers. BE IT FURTHER RESOLVED that the City Council of the City of Campbell approves the budget adjustment allocating $30,000 in developer's funds to the Dillon Avenue Homes Signal Equipment Improvements Project 17-YY and related transfers.
