As we advised you in October, 1984, there are deficiencies in the
work at 800 Camden Avenue. Unless and until these deficiencies
are corrected, we will be unable to send further payments on the
storm drain installation per Agreement S 80-17, and we may have
to call on your bonding company to have the work done.

an inspection of the correction work.

BEING A RESOLUTION ACCEPTING IM-
PROVEMENTS AT 800 CAMDEN AVENUE
WHEREAS, the City Council has been advised by the City Engineer
that all improvements at 800 Camden Avenue have been completed
in accordance with that agreement entered into October 4, 1983,
concerning said development; and
WHEREAS, the City Engineer recommends acceptance of the devel-
opment and improvements;
NOW, THEREFORE, BE IT RESOLVED by the City Council that the de-
velopment at 800 Camden Avenue, together with all improvements
thereon, be, and the same are hereby, accepted and that the
City Engineer is hereby ordered to record a Notice of Completion
of said improvements.

We have made a Final Inspection of subject public works construction and find it
acceptable and in conformance with City standards. Accordingly, we have recom-
mended the acceptance of the work to the City Council. We will send a copy of their
resolution accepting the work upon their approval of same.
You are responsible for the maintenance, repair and/or replacement of all work done
should any failures occur within one (1) year of this date. To guarantee this,
you must either post a maintenance bond in the amount indicated above, or maintain
your existing Faithful Performance Bond. If you post a separate maintenance bond,
your current bond will be released by separate action.
We will inspect the work in one year and advise you whether or not maintenance is
needed.

a $400 deposit and payment of storm sewer installation costs.
Please be advised that these payments are not due until the off-
site work on your property is completed and accepted. Our records
show that this has not been done. On June 5, 1983, your contractor,
Jim Smith, was advised to correct the deficiencies and request final
inspection and acceptance in writing. These actions have not yet
been completed.
Your prompt attention to these matters will allow us to make these
payments.

Dear Mr. Valkenaar,
This letter refers to the newly built industrial building on
804 Camden Ave., Campbell. The building was completed as of June 1, 1983.
As agreed upon, the deposit made for landscaping is to be refunded
upon completion of the building. The deposit was an amount of $400.
Also, a storm sewer was installed in the street during ~
construction of the proper,ty. The agreement concerning this matte:r:~ 0,) .' "',
was that the cost of that sewer is to be refunded over a period of-5 ~ 1M ~
5 years. The first payment is now due.
Further delays in refund payments are subject to an interest ~. ~ t .

Dear Mr. Kamber:
Upon review of your improvement plans for 800 Camden Avenue, we
have discovered an oversight on our part. A standard requirement
for developments on Camden Avenue has been for a seven-foot-wide
sidewalk. We notice now that your plans only call for the existing
five-foot-wide sidewalk. We must ask that you increase this side-
walk width to the standard of seven feet by adding a two-foot-wide
strip along the back side of the existing walk along your frontage.
You can see an example of this on the Woolworth frontage north of
your development.
We apologize for informing you of this requirement so late In your
development schedule. Thank you for your cooperation.

C. Attach three (3) copies of a drawin9 showing the location, extent and dimensions of the work. The drawing
shall show the relation of the proposed work to existing surface and underground i~rovenents. When ap-
proved by the City Engineer, said drawing becomes a part of this permit.
D. The General Conditions for all permits are listed on the reverse side. Special Provisions for this permit
are listed below. Failure to abide by these conditions and provisions ~y result in Job shut-down and/or

1. A CASH DEPOSIT is required. Charges will be made against this deposit if emergency call-out, overtime
inspection or City ordered barricading is required. (See General Conditionsl3and 14.) Any such costs
in excess of the deposit will be billed to the Permittee.
2. A BOND to insure FAITHFUL PERFORMANCE and completion of the work is required. This bond is refundable upon
completion of the work and written acceptance by the City.
3. A ONE-YEAR MAINTENANCE PERIOD AND BOND therefor is required.

8. CONTROL OF TRAFFIC in the work area shall conform with the Work Area Traffic Control Handbook.
Copies are available at the permit counter for $2 each.
9. REPLACE IN KIND any damaged or removed existing improvements or planting.
10. SAWCUT for all P.C.C. or A.C. removals.
11. ALL CONSTRUCTION shall conform with current City of Campbell Construction Standards.
12. Any PAVEMENT STRIPING, MARKING OR LEGENDS that are obliterated by the work shall be replaced.
13. OVERTIME INSPECTION PREMIUM will be charged against the cash deposit for inspection required outside
the hours of 8 a.m. to 5 p.m. The rate is $10 per hour with a $10 minimum charge per occurrence.
14. Adequate lighted BARRICADING is required on the job site. Failure to provide such barricading as specified
by the City Engineer will result in the City renting such barricades and charging the cost against the
cash deposit.
15. Asphalt and/or compaction TESTING, if required by the City Engineer, shall be provided by Permittee.
16. The Contractor or Permittee will have a SUPERVISORY REPRESENTATIVE available for contact on the project
at all times during construction.
17. This permit shall be kept at the site of work and must be shown to any authorized representative of the
City of Campbell or any law enforcement officer upon demand.
18. No MATERIAL STORAGE will be allowed near the edge of pavement, the traveled way, or within the shoulder
line which would create a hazardous condition to the motoring public.
19. This permit shall not be construed as authorization for excavation and grading on private property adja-
cent to the work or any other work for which a separate permit may be required, nor does it relieve the
Permittee of any Obligation to obtain any other permit required by law.
20. The Permittee shall RELOCATE, at his sole expense, the work authorized by this permit, in the event future
improvement of the road necessitates such relocation.
21. All necessary ROAD REPAIRS resulting from the permit work shall be Made in accordance with City Standards
and Specifications at the sole expense of the Permittee.
22. This permit does NOT RELEASE the Permittee from any liabilities contained in other agreements of contracts
with the City or any other publiC agency.
23. This permit is NOT TRANSFERABLE. Work must be performed by the Permittee or his designated agent or con-
tractor as specified hereon.
24. TRENCH SAFETY has not been checked and is NOT IMPLIED with this permit. For "Permit to Excavate" call:

This letter is in regards to your conversation with J,V. Arruiza
concerning temporary aerial facilities to a new industrial building
at 800 Camden Avenue.
Per your request, this letter confirms PT&T's plans to place a 6-pair
service wire temporarily to this building in order to provide service
to customers at this site. Permanent facilities will be placed when
PG&6 completes their bore across Old Camden Avenue.
All PT&T work should be completed by July 1, 1983 and all temporary
facilities will be removed by PT&T by that time.

municipal corporation of the County of Santa Clara, State of
California, hereinafter referred to as "City."
WHEREAS, City granted conditional approval of Owners' applica-
tion to construct an industrial building
upon that certain real property
descri bed by tha5 ~er~ain Grant Deed
recorded October 26, 19 79 ,and filed in Book E 892 of
Offici~l Rp~nrd~ at page ~q in the office of the County
Recorder, County of Santa Clara, State of California, which property
is hereinafter referred to as "said real property";
NOW, THEREFORE, IT IS MUTUALLY AGREED TO by and between the
parties hereto as follows:
(1) Owners shall provide, construct and/or install at their
own proper cost and expense public street improvements across the
entire frontage of said real property;
(2) All of said improvements shall be constructed and/or in-
stalled within twelve (12) months from the date first above written;
provided, however, that in the computation of said twelve-month
pe~iod, delays due to or caused by acts of God, viz., unusually
inclement weather, major strikes, and other delays beyond the con-
trol of Owners shall be excluded.
It is expressly understood and agreed to that if Owners shall
fail to complete the work required by this agreement within the
said twelve-month period, the City, after giving ten (lO)::days
written notice thereu: to Owners, may construct and/or install
said improvements and recover the full cost and expense thereof
from Owners.

(3) Owners shall prepare or cause to be prepared at their
cost and expense improvement plans for the construction and/or in-
stallation of said improvements. Said plans shall be prepared by
a civil engineer registered by the State of California and submitted
to the City Engineer of City for examination and approval.
All of said improvements shall be constructed and/or installed
in accordance with those plans approved by the City Engineer and
shall be made under the supervision and inspection and to the satis-
faction of the City Engineer. Said construction and/or installation
shall be in accordance with the existing ordinances and resolutions
of the City of Campbell and to all plans, specifications, standards,
sizes, lines and grades approved by the City Engineer, and all State
and County statutes applicable thereto. Upon completion and accep-
tance of the improvements by City, Owners shall provide reproducib12
as-built plans to said City Engineer.
(4) The construction work of the improvements embraced by
this agreement shall be done in accordance with the specifications
of the City of Campbell and Sanitation District No.4 of Santa
Clara County, where indicated.
(5) Owners shall pay to City, upon execution of this agreement,
for office examination of improvement plans, field inspection of con-
struction of improvements and all necessary expenses incurred by City
in connection with said improvements, the sum of ONE THOUSAND
SEVEN HUNDRED TWENTY.EIGHT DOLLARS ($1,728.00),
(6) Owners shall file with City, upon execution of this agree-
ment, surety acceptable to City in the amount of FORTY-laNE
THOUSAND DOLLARS ($49,000.00) to insure full and
faithful performance of the construction of all the aforementioned
improvement work, excluding sanitary sewers and water distribution
system. Said surety shall guarantee that Owners will correct any
defects which may appear in said improvement work within one (1) year
from the date of acceptance of the work by City and pay for any dam-
age to other work resulting from the construction thereof, as well
as pay the cost of all labor and materials invoived. This surety
shall remain in effect until one (1) year after date of final ac-
ceptance of said improvements by City. Said surety amount may be
reduced by the City Engineer after the date of final acceptance to
not less than twenty-five (25) percent of its full value.
(7) Upon final release of r~id surety by City, the obligations
of Owners contained in this agreement shall be considered null and
void.

(8) Owners shall make such deposits or file such bonds and
enter into such agreement as required by Sanitation District No.
4 of Santa Clara County to insure the installation of a sanitary
sewerage system to serve said real property, and Owners shall
file with City, upon execution of this agreement, a letter from
said Sanitation District No.4 stating that Owners have made
such deposits or filed such bonds and entered into such agree-
ments.
(9) Owners shall pay to Pacific Gas and Electric Company any
and all fees required for installation of underground wiring cir-
cuit to all electroliers within said real property when Owners are
notified by either the City Engineer or the Pacific Gas and Electric
Company that said fees are due and payable.
(lO) Owners shall make such deposits or file such bonds and
enter into such agreement as required by San Jose Water Works when
called upon to do so to insure the installation of a water distri-
bution system to serve said real property, including fire hydrant.
(11) Any easement and right of way within or without said .
real property necessary for the completion of the improvements
shown upon aforesaid improvement plans shall be acquired by Owners
at their own cost and expense. It is provided, however, that in
the event eminent domain proceedinqs are required for the purpose
of securinQ said easement and riqht of way. Owners shall deposit
or cause to be deposited with City a sum coverinQ the reasonable
market value of the land proposed to be taken and to be included in
said sum shall be a reasonable allowance for severance damages, if
any. It is further provided that in addition thereto such sums as
may be required for legal fees and costs, engineering and other
incidental costs shall be deposited with City.
(12) Owners shall carry out any and all negotiations with
all interested parties and shall perform or cause to be performed
at their own cost and expense and to the satisfaction of the City
Engineer any and all work required to abandon, remove, raise, lower,
relocate and otherwise modify irrigation line or lines within the
boundary of said real property.
(13) In conformance with the requirements of Section 20.16.060
of the Campbell Municipal Code, the storm drainage area fee for said
real property is in the amount of FOUR HUNDRED SEVENTY DOLLARS ($470.00).
In accordance with the City of Campbell Storm Fee Schedule, the
reimbursement for storm drainage facilities constructed across the
frontage of said real property as shown on said plans will be in the
amount of ONE THOUSAND THREE HUNDRED TVIENTY-THREE DOLLARS ($1,323.00).
The reimbursement for storm drainage facilities extended from the
south end of said real property to three hundred twenty-four (324)
feet south of said real property will be in the amount of SEVENTEEN
THOUSAND EIGHT HUNDRED FIFTEEN DOLLARS ($17,815.00). The total
reimbursement amount will be NINETEEN THOUSAND ONE HUNDRED THIRTY-
EIGHT DOLLARS ($19,138.00).

(14) The reimbursement will be made in five equal payments.
The first payment will be made when the work is accepted by the City.
The remaining payments will be made on the anniversary date of accep-
tance for four successive years.
(15) City reserves the right to revise storm drain design shown
on approved improvement plans provided Owners are given reasonable
written notice of City's intention to make revisions. Reimbursement
amount will be adjusted by difference between revised storm design
and presently approved storm design.
(16) Owners shall indemnify and save harmless tne City of
Campbell, the City Council, the City Engineer and any and all other
officers or employees of City from any suits, claims or actions
brought by any person for or on account of any injuries or damages
to persons or property sustained during or arising out of the con-
struction or installation of said improvements due to any acts,
omissions or negligence of Owners, their officers, agents, em-
ployees or contractors.
(17) This instrument is and shall be considered to be an
instrument affecting the right, title or interest in the real
property hereinabove described and shall bind the successors in
interest of Owners.
IN WITNESS WHEREOF, said City has caused its name to be affixed
by its Mayor and City Clerk, who are duly authorized by resolution of
the City Council, and said Owners have caused their names to be af-
fixed the day and year first above written.

Gentlemen:
We are pleased to transmit herein alternate pavement sections for the subject
project located on Camden Avenue in Campbell, California.
The following pavement sections are based on our laboratory resistance "R"
value test of near-surface soil sample and traffic indices (T.I.) of 8 for
Camden Avenue improvements. The results of the "R" value test is presented
in Figure 2.
Pavement section designs which satisfy the State of California Standard Design
Criteria and the assumed traffic indices are presented in Table I.

During the past storms we have incurred considerable damage from storm drain
runoff coming from neighboring properties. When Timber Cove was constructed
in 1974, we placed several drainage pipes along our west bank in order to
collect storm runoff from existing runoff areas. Apparently there have been
modifications over the past three years made by owners and users of the ad-
jacent properties since several new storm runoff concentrations have material-
ized. We have now spent several thousand dollars installing new and additional
storm water collection systems on top of our west bank. These new systems
will handle all existing runoff areas as they have occurred during the past
heavy storms.

The purpose of this letter is to inform you that we will not make any further
modifications in our storm system. It is adequate to accept runoff as it
currently exists. If there is any modification made in the current storm
drainage patterns on your property, it will be your responsibility to collect
this storm runoff and direct it to the collection point where we are currently
accepting your runoff. Do not attempt to create new drainage areas over our
bank since any damage resulting to our property or the property of our tenants
will be your responsibility. Finally, you will be responsible for providing
any new facilities required due to improvements made to your property which
cauc;e increased runoff intI) our system.

collection points.

The applIcant Is notified as part of this application that he/she is required
to meet the following conditions in accordance with Ordinances of the City of
Campbell and Laws of the State of California.
A All parking and driveway areas to be developed in compliance
with Section 21.50 of the Campbell Municipal Code. All
parking spaces to be provided with appropriate concrete curbs
or bumper guards.
B Underground utilities to be provided as required by Section
20.16.070 of the Campbell Municipal Code.
C Plans submitted to the Building Department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and
television cables, etc.
C Sign application to be submitted in accordance with provisions
of the sign ordinance for all signs. No sign to be Installed
until application is approved and permit issued by the Building
Department. (Section 21.68.030 of the Campbell Municipal Code.)

Ordinance No. 782 of the Campbell Municipal Code stipulates that
any contract for the collection and disposal of refuse, garbage,
wet garbage and rubbish produced within the limits of the city
of Campbell shall be made with Green Valley Disposal Company.
This requirement applies to all single-family dwellings, multiple
apartment units, to all commercial, business, Industrial,
manufacturing, and construction establishments.
