CITY OF CAMPBELL CITY COUNCIL RESOLUTION NO. 6155 After notification and publ ic hearing as specified by law on the appl ication of Mr. Warren G. Jacobsen for a use permit and approval of plans and elevations to convert an existing service station building into a retail sales bui 1ding while retaining the service bays for the sale of gasol ine on property known as 1387 Camden Avenue, the Planning Commission by a 5-1-1 vote denied the use permit appl ication. The City Council, after hearing the appeal of the Planning Commission decision filed by Mr. Warren G. Jacobsen, did by a unanimous vote to approve the use permit as requested subject to the following conditions: 1. A six-month review of the operation by the Planning Commission and City Council. 2. Revised elevations and/or site plan to be approved by the Planning Director upon recommendation of the Architectural Advisor, within 30 days of the Planning Commission approval. 3. Property to be fenced and landscaped as indicated and/or added in red on plans. Landscaping and fencing shall be maintained in accordance with the approved plans. 4. Landscaping plan indicating type and size of plant material, and location of hose bibs or sprinkler system to be submitted for approval of the Planning Director prior to application for a building permit. 5. Applicant to either (1) post a faithful performance bond in the amount of $1,000 to insure landscaping, fencing and striping of parking areas within three months of completion of construction; or (2) file written agreement to complete landscaping, fencing and striping parking areas prior to appl ication for a building permit. 6. All mechanical equipment located on roofs to be screened as approved by the Planning Director. 7. Sui lding occupancy will not be al lowed until public improvements are installed. 8. West planter area to be landscaped as indicated in red on plans. 9. Existing free-standing sign to be removed or modified to meet Code requirements. ~~V~ ~ , The applicant i~ notified as part of this approval that he IS required to meet the following conditions in accordance with Ordinances of the City of Campbell and Laws of the State of Cal ifornia. A. All parking and driveway areas to be developed in compl iance with Section 21.50 of the Campbell Minicipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. B. Underground util ities to be provided as required by Section 20.16.070 of the Campbel 1 Municipal Code. C. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground util ities including water, sewer, electric, telephone and television cables, etc. D. Sign application to be submitted in accordance with provIsions of the sign ordinance for all signs. No sign to be installed until appl ication is approved and permit issued by the Building Department. (Section 21.68.030 of the Campbell Municipal Code). E. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwell ings, multiple apartment units, to all commercial, business, industrial, manufacturing and construction establishments. F. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a sol id wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. G. Appl icant shall comply with all appropriate State and City require- ments for the handicapped. BUILDING DEPARTMENT H. Change of Occupancy shall require building to comply with latest City Codes. Section 502 Uniform Building Code. I. South and west walls plus mansard shall be one hour construction as wall is less than 40 feet to a property line. J. Roof covering shal I be fire retardant. -2- ~ . FI RE DEPAI ~NT , K. Section 79.703(b) Uniform Fire Code states that a qualified attendant shall be in charge of all dispensing. His primary function is to observe, control and supervise those who need attention in dispensing fuel. L. An additional attendant will be needed at the pump islands and shall not be utilized in the retail sales area. Section 79.703(f) (5). M. Trash enclosure shall be accessible for dumpster movement to truck. PUBLIC WORKS DEPARTMENT M. Pay the storm drainage area fee. N. Obtain an excavation permit, post surety and pay fees if any work is necessary in the publ ic right of way. STANDARD FIRE HAZARD ABATEMENT COMMENT: The appl icant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be kept secure by having windows boarded up and doors sealed shut, or be demolished or removed from property. Section 11.201 & 11.414, 1979 Edition of Uniform Fire Code. The applicant is notified that he shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified.
