with John Albright on March 25, 1964.
Dear Sir:
Please be advised that we have considered your verbal
refusal to install street tmprovement~,at this time, in
accordance with our referred letter. \'1e have taken this
matter to the City Council, and we have been authorized to
instruct you to tmmediately contact Pert Developers and
organize your construction program for street tmprovements.
Your present operation exists under a conditional variance,
which conditions have NOT BEEN MET and unless you proceed
with street improvements in accordance with your agreement
dated December 14, 1959, the City shall forthwith proceed
to hait your present operation in view of the fact that
your conditional variance has not been complied with.
After arranging construction ,with Pert Developers, please
inform us of your inten.tion to construct and possible scheduling.
Should you have any questions ~(8rning the above
matter, please contact the undersigned.

to enforce the agreement between the City and Mr. Wi I I iam N. Gray,
for the street improvements. in accordance wi th an agreement dated

DISCUSSION
The subject agreement between the City and Mr. Gray was prepared in
order to ensure the construction of sidewalk. curbs and gutters as
a condition of Variance dated October 8, 1959. The adjacent property
will be required to construct street improvements including curbs,
gutters, and sidewalks to be installed at that time.

SUBJECT: Consideration of Enforcement of Gray Agreement for
Street ~rovements.
Ibrl'RODUCTION:
The property involved is on the east side of Camden Avenue,
two properties north of the Signal Station.
The City entered into an agreement with awners William N. Gray
and Delphine A. Gray as a condition of granting Variance No. 47
dated October 8, 1959. This agreement was dated December 14, 1959.
and was recorded December 17, 1959, in Book 4639 at Page 384.
'the agreement, in part, stated "(2) owners agree to install sidewalk,
curb and gutter and pave between gutter and sound existing
pavement all according to City standards and at such t~e as
adjacent properties are so ~roved, said ~provements are to
extend along the entire one hundred and twenty (120') foot frontage.-
Mr. Gray was granted conditional variance 1936-6 dated
August 22, 1963. Condition 2. stated "Applicant to sign agreement
to enter future assessment district for this area.1t This
condition was not complied with and Mr. Gray is operating anyhow.
The adjacent property to the south has received "Sit Approval
1963-59 and will be constructing street ~rovements in April, 1964.
Mr. Gray has verba,lly refused to construct said ~provements
in answer to my letter.
RECOMMENDATION:
Ask Council to authorize City Engineer, by motion, to appraise
Mr. Gray that he is operating under a conditional var iance, which
conditions have not been met, and that unle8. he proceeds with
street improvements in accordance with his agreement dated
December 14, 1959, the City shall forthwith proceed to halt his
present operation in view that his a:> nditional variance has not
been complied with.
DISCUSSION:
Mr. Gray contested condition 2. to Variance 1963-6 in a
letter to me dated Sept:ember 13, 1963, stating "Item -#2 I believe
is imposing additional expense and har~lp on me, as I have
already agreed to this in our signed agreement of December 14, 1959
wherein I agree to install sidewalk, curb and gutter and pave
bet:ween gutter and sound existing pavement all according to City

said tmprovements are to extend along the entire one hundred and
twenty (120') foot frontage.1t

He did not comply with the condition, but did commence the new
use.
Mr. Gray bases his verbal refusal t.o construct under the
original agreement, interpreting the language to mean "properties
on both sides (north and south) of me must develop first." I
contend that "adjacent properties" means, instead, "properties
lying near or close". It is my interpretation that the Signal
station is an "adjacent" property and the S 1963-59 (Pert-CPM Co.)
is also an "adjacent" property, therefore, we have a right to ask
for improvement under the agreement.
Installation of street tmprovements in front of the Pert-CPM Co.
property would not have been recommended at the time if it was
thought that Gray was not to develop also, as storm drainage of
the street would have created a problem. There is, however, an
existing storm drain line that goes to the creek just north of
the Gray property, which will serve very well for draining the
street after Gray puts his section in. .

Dear Sir:
This letter will serve as our notice to you, that
street tmprovements (curb, gutter and paving) are to be
installed in the near future on the property to the south
of your property on Camden Avenue. This irs tallation is
being made by Pert Developers. This office DS prepared
a street imp.c'Jvement plan for this installation.
It is the intention of this office to ask you to join
in this 1mprovement in accordance with the provisions of
your agreement with the City of Campbell dated December 14, 1959.
A joint venture of improvement at this time, by you
and Pert Developers, should allow you both to realize a
lower unit cost by increasing the size of the job to be done.
In addition, this office could include your ~rovement
on the existing Pert Developers Improvement Plan, thus saving
you the cost of a separate plan. Also, the inspection fee
normally charged in cases of this type would not be necessary.
This cost will be borne by the City as it was not definitely
spelled out in the aforemention agreement.
This office has contacted Mr. Campbell, the construction
superintendent for Pert Developers Inc., at 960 Camden Avenue
(phone number 379-2280). He has indicated that he will start
construction within thirty days.
We would, therefore, appreciate an ~ediate answer to this
letter verifying your joining Pert Developers, or your intention
to proceed on your own. This is necessary so that tlUs office
may proceed accordingly.
Should you have any questions concerning the above matter,
please contact the undersigned.
