BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL DECLARING CANVASS OF RETURNS AND RESULT OF
SPECIAL MUNICIPAL ELECTION HELD ON TUESDAY, APRIL 25, 2017
WHEREAS, the City Council of the City of Campbell duly called and ordered held in
said City a Special Municipal Election on the 25~h day of April, 2017 for the purpose of
submitting to the qualified electors thereof three Measures.
WHEREAS, said Special Municipal Election was held on Tuesday, April 25, 2017, and
in accordance with the law and the votes thereat received and canvassed, and the
returns thereof ascertained, determined and declared in all respects as required by law.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell as
follows:
1. That the City Clerk of the City of Campbell be and she is hereby instructed to
enter this resolution on the minutes of the City Council as a statement of the result of
said election.
2. That the whole number of ballots cast in said City at said Special Municipal
Election was 6,668, or 29.59%.
3. That at said election the following measures were submitted to the electors of
said City and that the number of votes given in said City for each of said candidates
were as follows:

4. That by said Resolution calling said Special Municipal Election for said City of
Campbell was divided into nineteen (19) voting precincts for the purpose of said
election, and that the number of votes cast in each of said precincts was as attached
hereto and made a part hereof and marked "Exhibit A."
5. That all vote by mail ballots have been duly received and canvassed in time for
and in the manner required by law, and the result is outlined in "Exhibit A."

I, Shannon Bushey, Registrar of Voters of the County of Santa Clara, State of
California, hereby declare: .
1. A Special Election was held in the County of Santa Clara, in the City of
Campbell, on April 25, 2017 for the purpose of submitting the following measure to the
voters:
/~ Shall the ordinance levying a business license tax on marijuana
businesses at the initial rate of 7% and a maximum rate of 15% of the
gross receipts of the marijuana business be adopted to continue until
repealed by the City Council or City voters, which is estimated to raise
$130,000 - $260,000 annually for general City services, such as police,
fire and code enforcement services?
2. The official canvass of the returns of the election was conducted by the Office of
the Registrar of Voters in accordance with the appropriate provisions of the Elections Code
of the State of California.
3. The Statement of Votes Cast, now on file at my office, shows the whole number
of votes cast for Measure A in each of the precincts and the total shown is true and
correct.

I, Shannon Bushey, Registrar, of Voters of the County of Santa Clara, State of
California, hereby declare:
1. A Special Election was held in the County of Santa Clara, in the City of
Campbell, on April 25, 2017 for the purpose of submitting the following measure to the
voters:
B Shall the ordinance allowing the City to license up to three medical
marijuana dispensaries in Campbell, which would also be allowed to
deliver medical marijuana to qualified patients throughout the City, and
that would allow every qualified patient and primary caregiver to cultivate
up to 100 square feet or 500 square feet of marijuana, respectively,
without a license be adopted?
2. The official canvass of the returns of the election was conducted by the Office of
the Registrar of Voters in accordance with the appropriate provisions of the Elections Code
of the State of California.
3. The Statement of Votes Cast, now on file at my office, shows the whole number
of votes cast for Measure B in each of the precincts and the total shown is true and
correct.

C Shall the ordinance imposing a moratorium on marijuana dispensaries
in Campbell until at least April 1, 2019 be adopted, allowing time for study
of traffic, neighborhood and safety issues, and providing the City Council
discretion to allow for dispensaries after that date, provided that the
dispensaries be at least 100 feet from residential properties and 600 feet
from child care facilities, schools, parks and community centers, and other
dispensaries?
2. The official canvass of the returns of the election was conducted by the Office of
the Registrar of Voters in accordance with the appropriate provisions of the Elections Code
of the State of California.
3. The Statement of Votes Cast, now on file at my office, shows the whole number
of votes cast for Measure C in each of the precincts and the total shown is true and
correct.
