BEING A RESOLUTION ACCEPTING DEVELOPMENT AT
950 CAMDEN AVENUE AND IMPROVEMENTS THEREON
WHEREAS, the City Council has been advised by the City En-
gineer that all improvements at 950 Camden Avenue have been
completed in accordance with that agreement entered into June 22,
1981, concerning said development; and
WHEREAS, the City Engineer recommends acceptance of the de-
velopment and improvements;
NOW, THEREFORE, BE IT RESOLVED by the City Council that the
improvements at 950 Camden Avenue be and the same are hereby ac-
cepted, and that the City Engineer is hereby ordered to record a
Notice of Completion of said improvements.
PASSED AND ADOPTED this 20th day of July
1982, by the following vote:

Maintenance Bond Amount: $8,500.00
Gentlemen:
We have made a Final Inspection of subject public works construction and find it
acceptable and in conformance with City standards. Accordingly, we have recom-
mended the acceptance of the work to the City Council. We will send a copy of their
resolution accepting the work upon their approval of same.
You are responsible for the maintenance, repair and/or replacement of all work done
should any failures occur within one (1) year of this date. To guarantee this,
you must either post a maintenance bond in the amount indicated above, or maintain
your existing Faithful Performance Bond. If you post a separate maintenance bond,
your current bond will be released by separate action.
We will inspect the work in one year and advise you whether or not maintenance is
needed.

are listed below. Failure to abide by these conditions and provisions may result in Job shut-down and/or

1. A CASH DEPOSIT is required. Charges will be made against this deposit if emergency call-out, overtime
inspection or City ordered barricading is required, (See General Conditlons13and 14.) Any such costs
in excess of the deposit will be billed to the Permittee.
2. A BOND to insure FAITHFUL PERFORMANCE and completion "f the work is required, This bond is refundable upon
completion of the work and written acceptance by the ~lty.

Copies are available at the permit counter for $2 each.
9. REPLACE IN KIND any damaged or removed existing improvements or planting.
10. SAWCUT for all P.C.C. or A.C. removals.
11. ALL CONSTRUCTION shall conform with current City of Campbell Construction Standards.
12, Any PAVEMENT STRIPING, MARKING OR LEGENDS that are obliterated by the work shall be replaced.
13, OVERTIME INSPECTION PREMIUM will be charged against th~ cash deposit for inspection required outside
the hours of 8 a.m, to 5 p.m. The rate is $10 per hour with a $10 minimum charge per occurrence.
14. Adequate lighted BARRICADING is required on the job site. Failure to provide such barricading as specified
by the City Engineer will result in the City renting such barricades and charging the cost against the
cash deposit.
15. Asphalt and/or compaction TESTING, if required by the City Engineer, shall be provided by Permittee.
16. The Contractor or Permittee will have a SUPERVISORY REPRESENTATIVE available for contact on the project
at all times during construction.
17. This permit shall be kept at the site of work and must be shown to any authorized representative of the
City of Campbell or any law enforcement officer upon demand.
18. No MATERIAL STORAGE will be allowed near the edge of pavement, the traveled way, or within the shoulder
line which would create a hazardous condition to the motoring public.
19. This permit shall not be construed as authorization for excavation and grading on private property adja-
cent to the work or any other work for which a separate permit may be required, nor does it relieve the
Permittee of any obligation to obtain any other permit required by law.
20. The Permittee shall RELOCATE, at his sole expense, the work authorized by this permit, in the event future
improvement of the road necessitates such relocation.
21. All necessary ROAD REPAIRS resulting from the permit work shall be made in accordance with City Standards
and Specifications at the sole expense of the Permittee.
22. This permit does NOT RELEASE the Permittee from any liabilities contained in other agreements of contracts
with the City or any other public agency.
23. This permit is NOT TRANSFERABLE. Work must be performed by the Permittee or his designated agent or con-
tractor as specified hereon.
24. TRENCH SAFETY has not been checked and is NOT IMPLIED with this permit. For "Permit to Excavate" call:

BEING A RESOLUTION AUTHORIZING EXECUTION
OF AGREEMENT WITH JOSEPH HERR AND HEDY
HERR
WHEREAS, Joseph Herr and Hedy Herr, husband and wife, have sub-
mitted to the City Council of the City of Campbell an Agreement,
identified as No. S 81-7, which covers certain conditions of approval
of the development of their real property;
NOW, THEREFORE, BE IT RESOLVED by the City Council that the Mayor
be and he is hereby authorized to execute said Agreement on behalf of
said City.

A G R E E MEN T
THIS AGREEMENT (identified as No. S 81-7 ), made and entered
into this day of , 19 , by and between
JOSEPH HERR and HEDY HERR, husband and wife
herei nafter referred to as "Owners," and the CITY OF CAMPBELL, a
municipal corporation of the County of Santa Clara, State of
California, hereinafter referred to as "City."
WHEREAS, City granted conditional approval of Owners' applica-
tion to construct an industrial building
upon that certain real property
described b that certain Grant Deed
recorded November 20 ,980, and i ed in ook F 741 of
Official Records at page 298 in the office of the County
Recorder, County of Santa Clara, State of California, which property
is hereinafter referred to as "said real property";
NOW, THEREFORE, IT IS MUTUALLY AGREED TO by and between the
parties hereto as follows:
(1) Owners shall provide, construct and/or install at their
own proper cost and expense public street improvements across the
entire frontage of said real property;
(2) All of said improvements shall be constructed and/or in-
stalled within twelve (12) months from the date first above written;
provided, however, that in the computation of said twelve-month
period, delays due to or caused by acts of God, viz., unusually
inclement weather, major strikes, and other delays beyond the con-
trol of Owners shall be excluded.
It is expressly understood and agreed to that if Owners shall
fail to complete the work required by this agreement within the
said twelve-month period, the City, after giving ten (lO):days
written notice thereof to Owners, may construct and/or install
said improvements and recover the full cost and expense thereof
from Owners.

(3) Owners shall prepare or cause to be prepared at their
cost and expense improvement plans for the construction and/or in-
stallation of said improvements. Said plans shall be prepared by
a civil engineer registered by the State of California and submitted
to the City Engineer of City for examination and approval.
All of said improvements shall be constructed and/or installed
in accordance with those plans approved by the City Engineer and
shall be made under the supervision and inspection and to the satis-
faction of the City Engineer. Said construction and/or installation
shall be in accordance with the existing ordinances and resolutions
of the City of Campbell and to all plans, specifications, standards,
sizes, lines and grades approved by the City Engineer, and all State
and County statutes applicable thereto. Upon completion and accep-
tance of the improvements by City, Owners shall provide reproducible
as-built plans to said City Engineer.
(4) The construction work of the improvements embraced by
this agreement shall be done in accordance with the specifications
of the City of Campbell and Sanitation District No.4 of Santa
Clara County, where indicated.
(5) Owners shall pay to City, upon execution of this agreement,
for office examination of improvement plans, field inspection of con-
struction of improvements and all necessary expenses incurred by City
in connection with said improvements, the sum of ONE THOUSAND ONE
HUNDRED EIGHTY-SEVEN DOLLARS ($1,187.00~
(6) Owners shall file with City, upon execution of this agree-
ment, surety acceptable to City in the amount of THIRTY-FOUR
THOUSAND DOLLARS ($34,000.00) to insure full and
faithful performance of the construction of all the aforementioned
improvement work, excluding sanitary sewers and water distribution
system. Said surety shall guarantee that Owners will correct any
defects which may appear in said improvement work within one (1) year
from the date of acceptance of the work by City and pay for any dam-
age to other work resulting from the construction thereof, as well
as pay the cost of all labor and materials involved. This surety
shall remain in effect until one (l) year after date of final ac-
ceptance of said improvements by City. Said surety amount may be
reduced by the City Engineer after the date of final acceptance to
not less than twenty-five (25) percent of its full value.
(7) Upon final release of said surety by City, the obligations
of Owners contained in this agreement shall be considered null and
void.

(8) Owners shall make such deposits or file such bonds and
enter into such agreement as required by Sanitation District No.
4 of Santa Clara County to insure the installation of a sanitary
sewerage system to serve said real property, and Owners shall
file with City, upon execution of this agreement, a letter from
said Sanitation District No.4 stating that Owners have made
such deposits or filed such bonds and entered into such agree-
ments.
(9) Owners shall pay to Pacific Gas and Electric Company any
and all fees required for installation of underground wiring cir-
cuit to all electroliers within said real property when Owners are
notified by either the City Engineer or the Pacific Gas and Electric
Company that said fees are due and payable.
(10) Owners shall make such deposits or file such bonds and
enter into such agreement as required by San Jose Water Works when
called upon to do so to insure the installation of a water distri-
bution system to serve said real property, including fire hydrant.
(11) Any easement and right of way within or without said
real property necessary for the completion of the improvements
shown upon aforesaid improvement plans shall be acquired by Owners
at their own cost and expense. It is provided, however, that in
the event eminent domain proceedinqs are required for the purpose
of securinq said easement and riqht of way, Owners shall deposit
or cause to be deposited with City a sum coverinq the reasonable
market value of the land proposed to be taken and to be included in
said sum shall be a reasonable allowance for severance damages, if
any. It is further provided that in addition thereto such sums as
may be required for legal fees and costs, engineering and other
incidental costs shall be deposited with City.
(12) Owners shall carry out any and all negotiations with
all interested parties and shall perform or cause to be performed
at their own cost and expense and to the satisfaction of the City
Engineer any and all work required to abandon, remove, raise, lower,
relocate and otherwise modify irrigation line or lines within the
boundary of said real property.
(13) Owners shall indemnify and save harmless the City of
Campbell, the City Council, the City Engineer and any and all other
officers or employees of City from any suits, claims or actions
brought by any person for or on account of any injuries or damages
to persons or property sustained during or arising out of the con-
struction or installation of said improvements due to any acts,
omissions or negligence of Owners, their officers, agents, em-
ployees or contractors.

(14) This instrument is and shall be considered to be an
instrument affecting the right, title or interest in the real
property hereinabove described and shall bind the successors in
interest of Owners.
IN WITNESS WHEREOF, said City has caused its name to be affixed

Section 21.42~090 of the Campbell Municipal Code reads as follows:
Any approval granted under this section shall expire one year after
the date upon which such approval was granted, unless an extension
for such approval is obtained by making written application for same
to the Planning Commission at least fifteen (15) days days prior to
the expiration date of such approval.
No building permit shall be issed after the expiration date of any
approval until a new approval has been obtained in the manner pro-
vided for in this Chapter.
Approval effective ten (10) days after decision of approval of the
Planning Commission.

Dear Mr. Woodworth:
We have reviewed the site plan for an industrial building for lands of Herr,
File 581-07, sent to us with your transmittal of January 22, 1981.
The site would not be subject to flooding from a District facility in the
event of the one percent flood.
The portion of the site over which this District currently has an easement
~ should be transferred in fee to the District. Please contact Mr. Donald
Lawrie of our Real Estate Division to make arrangements for the transfer.
Provisions to protect District fencing from vehicular damage should be made.
A curb or wheel bumper placed at least 5 feet from the District's right of
way or a traffic guardrail placed adjacent to District's right of way would
be satisfactory.
No landscaping, grading or structures can be allowed within District right of
way. Because it can affect the operation and maintenance of the channel, we
request that any grading adjacent to the right of way be done in accordance
with District Detail Sheets 20-208. The details of the grading should include
the cross sectional view at the right of way and should be shown on the lmprove-
ment plans.
Enclosed for your information are copies of Sheets 5 and 80 of District As-Builts.
It would be desirable to incorporate the site's drainage into an existing
storm drainage system. If a storm drain outfall into the creek is necessary,
please have it designed to serve the general area to minimize the number of
future outfalls needed. Please furnish outfall structure details for our
review and issuance of a permit prior to advertising for construction. Design
guides for outfalls will be furnished upon request. No overbank drainage onto
District right of way can be allowed.
