A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE CITY TO SUPPORT ASSEMBLY BILL (AB) 765 -LOCAL
INITIATIVE MEASURE
WHEREAS, AB 765 prohibits local initiative proponents from timing their initiatives to
force standalone special elections that suffer from low and unrepresentative turnout;
WHEREAS, local initiative measures, proponents have the ability to force local
governments to hold a special election by including a request for a special election in
the initiative petition;
WHEREAS, local initiative proponents have the ability to collect a larger number of
signatures and can force the local government body to either adopt the initiative
measure outright, or schedule a special election to vote on the measure;
WHEREAS, these special elections can be costly for local governments, and frequently
result in lower and less representative voter participation;
WHEREAS, earlier this year, the City of Campbell City was forced to schedule a
citywide special election at an estimated cost of $570,000;
WHEREAS, AB 765 eliminates the ability of the proponents of a local initiative measure
to force the local government to call a special election to vote on the measure; and
WHEREAS, local jurisdiction would have the ability to call a special election to vote on the
initiative, for time sensitive matter, prior to the next regularly scheduled election.
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
herby supports AB 765 which would require that the election for a county, municipal, or
district initiative measure that qualifies for the ballot be the next statewide or regular
election, as applicable, unless the governing body of the county, city, or district calls a
special election.
