BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL APPROVING A GENERAL PLAN
:AMENDMENT (PLN2017-365) TO CHANGE THE LAND
USE DESIGNATION FROM PROFESSIOINAL OFFICE TO
NEIGHBORHOOD COMMERCIAL ON PROPERTY
LOCi4TED AT 71 N. SAN TOMAS AQUINO ROAD
(ASSESSOR PARCEL NUMBER 307-16-012).
After notification and public hearing, as specified by law and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
The City Council finds as follows with regard to the approval of a General Plan
Amendment (PLN2017-365):
Environmental Finding
1. An Initial Study has been prepared for the project which provides documentation for
the factual basis for concluding that a Negative Declaration may be adopted since
no ~ substantial evidence exists, in light of the whole record, that the project may
have a significant effect on the environment. .
Evidentiary Findings
1. The proposed project ("project") includes an amendment to change the General
Plan land use designation from Professional Office to Neighborhood Commercial
and an amendment to change the Zoning Map designation from P-O (Professional
Office) to C-1 (Neighborhood Commercial).
2. The project site consists of a single parcel located at the southwest corner of North
San Tomas Aquino Road and La Pradera Drive, north of West Campbell Avenue.
3. Abutting land uses include office uses to the west, residential uses to the
northwest, and commercial uses to the east and south.
4. The approximately 24,000 square foot lot is developed with asingle-story 5,692
square foot building that is physically suited for, and currently occupied by, uses
that would conform to the proposed land use designation.
5. The site is located adjacent to an arterial corridor and is easily accessible by
automobile, bicycle, transit, and by foot, consistent with the purpose of the
neighborhood commercial zoning designation.
6. The existing parking is sufficient to support the type of uses that would be allowed
under the proposed land use designation.

7. The project would be consistent with the following General Plan policies and
strategies:
Policy LUT-5.3: Variety of Commercial and Office Uses: Maintain a variety of attractive and
convenient commercial and office uses that provide needed goods, services
and entertainment.
Strategy LUT-9.1 b: Land Use Review: Review the types of land uses allowed in the City's zoning
districts and revise, where appropriate, to assure greater compatibility.
Strategy LUT-9.1c: -Land Use Objectives and Redevelopment Plans: Permit only those uses that
are compatible with land use objectives and redevelopment plans.
Policy LUT-11.2: Services within Walking Distance: Encourage neighborhood services within
walking distance of residential uses.
Policy LUT-13.1: Variety of Uses: Attract and maintain a variety of uses that create an
economic balance within the City while maintaining a balance with other
community land use needs, such as housing and open space, and while
providing high quality services to the community.
Strategy LUT-13.1c: Fiscal Effects of Land Use: Evaluate the fiscal effects of different land uses
on City revenues and services.
8. On the basis of the Initial Study, and as supported by substantial evidence, the
project as currently presented and subject to the uniformly applicable development
policies, will not have a significant adverse impact on the environment
9. The City of Campbell provided a Notice of Intent to adopt a Negative Declaration to
the public via the Campbell Express, the County Clerk, and on the City website.
10.. The City of Campbell provided a 20-day public review period of the Negative
Declaration pursuant to the California Environmental Quality Act Guidelines. The
20-day public review period began January 16,2018.
Based upon the foregoing findings of fact, the City Council further finds and concludes
that:
1. The proposed amendments are consistent with the goals, policies, and actions of
the General Plan.
2. The proposed amendments would not be detrimental to the public interest, health,
safety, convenience, or general welfare of the city.
3. The. parcel is physically suitable (including absence of physical constraints, access,
provision of utilities, and compatibility with adjoining land uses) for the requested
land use designation(s) and anticipated land uses/project.

4. No substantial evidence has been presented from which a reasonable argument
could be made that shows that the project, as currently presented and subject to
the uniformly applicable development policies, will have a significant adverse
impact on the environment.
5. The Negative Declaration reflects the independent judgment and analysis of the
City Council upon recommendation of the Planning Commission.
6. The Custodian of the Record for the Negative Declaration and Initial Study is the
Community Development Department of the City of Campbell, located at 70 North
First Street, Campbell, California.
THEREFORE, BE IT RESOLVED that the City Council approves a General Plan
Amendment (PLN2017-365) on property located at 71 N. San Tomas Aquino Road
(assessor parcel number 307-16-012).
