THE CITY OF CAMPBELL APROVING AN APPEAL OF THE COMMUNITY DEVELOPMENT DIRECTOR'S DENIAL OF A - TREE REMOVAL PERMIT (PLN2018-008) TO ALLOW .THE - REMOVAL OF TWO (2) .REDWOOD TREES ON .PROPERTY LOCATED AT 1.110 RIDGELEY DRIVE IN THE. R-1-6 (SINGLE- FAMILY RESIDENTIAL) ZONING DISTRICT. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents; the hearing was closed. After due consideration of all evidence. presented, the Planning Commission did find as follows vvith respect to the recommended approval of file number PLN2018-008: 1. The project site is located on the southern side of Ridgeley Drive, east of S. Bascom Avenue and west of Midway Street. ~2. The .project site is_ zoned R-1-6 (Single=family Residential) a's shown on the Campbell Zoning Map. 3. -The project site is designated Low Density Residential (less than 6 units per gross acre) as, shown on the Campbell General Plan Map.. - . 4. The project site is currently developed with asingle-family residence. 5. The Redwood trees located on the property are protected trees and require approval - of a Tree Removal Permit to remove. 6. The Appeal application requests the removal of two (2) Redwood trees on the project site. 7. The Tree Protection Ordinance requires a minimum of two (2) 36-inch box replacement trees for the removal of the two (2) Redwood trees. 8. No substantial evidence has been presented which shows that the project, as currently presented and subject to the required Conditions of Approval, will have a significant adverse impact on the environment. Based .upon the foregoing findings of fact, the Planning Commission further finds and concludes that: _ 1. The property can accommodate the minimum replacement requirement of two (2) new large-canopy trees to replace the two (2) Redwood trees. 2. The project qualifies as a Categorically Exempt project under. Section 15304, Class 4 of the California Environmental Quality Act (CEQA) pertaining to minor public,or private -Planning Commission Resolution No. 4438 Page 2 of 2 PLN2018-008 ~ 1110 Ridgeley Dr. -Appeal of Tree Removal Permit alterations in the condition of land, water, and/or_vegetation which. do. not. involve removal of healthy, mature, scenic trees except for forestry or agricultural purposes. THEREFORE, BE IT RESOLVED that the Planning Commission approves an Appeal of the Community Development Director's denial of a Tree .Removal Permit (PLN2018-008) _to allow the removal of two (2) Redwood Trees on .property located at 1110 Ridgeley Drive, subject to the attached Conditions of Approval (attached Exhibit A). Chair EXHIBIT A .CONDITIONS OF APPROVAL Approval of Appeal. -1110 Ridgeley Drive (PLN2018-008) Where approval by the Director of Community Development, City- Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with.. all applicable conditions of. approval, adopted policies and guidelines, ordinances, laws and regulations and accepted engineering practices for the.. item under .review. Additionally, the applicant is hereby notified. that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the. State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT Planning Division: _ 1: Replacement Trees: The appellanf shall plant two (2) 36-inch box trees on private property located.. at 1110 Ridgeley Drive within 30 days of the removal of the two (2) Redwood trees. Replacement species shall not include fruit trees or Eucalyptus trees. Replacement trees shall be of an equivalent aesthetic quality to the Redwood trees, including a large` mature canopy and evergreen foliage, subject to approval by the Community Development Director: . ~,
