PC Res 4448RESOLUTION NO. 4448 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING THAT THE CITY COUNCIL RESCIND THE HISTORIC DESIGNATION OF 14 STRUCTURES CURRENTLY LISTED ON THE HISTORIC RESOURCE INVENTORY. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. The Planning Commission finds as follows with regard to file number PLN2018-212: 1. The Historic Preservation Ordinance is consistent with the goals, policies, and actions of the General Plan and includes procedures for designating and rescinding a resource from the Historic Resource Inventory; 2. The Historic Resource Inventory is the official City Council approved register of structures of merit, landmarks and historic district properties, significant in Campbell's history, architecture, engineering, and culture; 3. The decision to rescind the historic designation of a resource requires approval by the City Council upon recommendation of the Historic Preservation Board and the Planning Commission; 4. The Historic Preservation Board held a public hearing on May 23, 2018 and determined that the 14'structures proposed for rescission no longer meet the criteria for historic designation (Campbell Municipal Code Section 21.33.060.8.1) because the structures have either been demolished or significantly altered to the point that the structures no longer embody historic architecture or construction; no longer benefit the historic character of the city, and can no longer be associated with historical events or persons; 5. The Planning Commission shall either recommend approval or denial of the rescission, based on substantial evidence and findings of fact in the record that the resource no longer has historic value with respect to the designation criteria for structures of merit identified in Campbell Municipal Code Section 21.33.060.6.1. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: The resource no longer has historic value with respect to the designation criteria identified in Campbell Municipal Code Section 21.33.060.6.1. 2. An Initial Study has been prepared for the project which provides documentation for the factual basis for concluding that a Negative Declaration may be adopted since Planning Commission Resolution No. 4448 (PLN2018-212) Page 2 of 2 Recommendina Aparoval of the Rescission of 14 structures from the HRI no substantial evidence exists, in light of the whole record, that the rescission may have a significant effect on the environment.
