Joint trenches for new utilities-shali be used whenever-possible. 31.Pavement Restoration: Based on the utility coordination plan, the applicant shall prepare a pavement restoration plan for approval by the City Engineer prior to any utility installation or abandonment..Streets that have been reconstructed or overlaid within the previous five years will require boring and jacking for. all new utility installations. Sunnyside Avenue has not been reconstructed or overlaid in the last 5 - years. The pavement restoration plan shall indicate how the street pavement shall be restored following the installation or abandonment of all utilities necessary for the. project. 32.Storm Drain Area Fee: Prior to issuance of any grading or building permits fol the site, the applicant shall-pay the required Storm Drain Area fee for R-1 land use. zz 33.Stormwater Pollution Prevention Measures: Prior to issuance of any grading or building permits, the-applicant shall- comply with the National Pollution Discharge Elimination System (NPDES) permit requirements, Santa Clara Valley Water District requirements, and the Campbell Municipal Code regarding stormwater pollution prevention. The primary objectives are to improve the quality and reduce the quantity of stormwater runoff to the bay. Resources to achieve these objectives include Stormwater Best Management Practices Handbook for New Development and Redevelopment ("CA BMP Handbook") by the California Stormwater Quality Association (CASQA), 2003; Start at the Source: A Design Guidance Manual for Stormwater Quality Protection ("Start at the Source") by the Bay Area Stormwater Management Agencies Association (BASMAA), 1999; and Using Site Design Techniques to Meet Development Standards for Stormwater Quality: A Companion Document to Start at the Source ("Using Site Design Techniques") by BASMAA, 2003. BACKGROUND The Planning Commission, at. 'its meeting of June 27, 2006, forwarded a recommendation to the City Council by a .5-1 vote (Commissioner Rocha abstained) to approve the ;proposed project.. One person from the public spoke at the public hearing and` 'had general questions regarding the. proposed project and the required development standards. DISCUSSION . Applicant's Proposal: The applicant''is requesting approval of a Planned Development Permit to allow the construction of a new single-story, second residential dwelling unit on a property with an existing home on property located 188 Sunnyside Avenue. The, existing home on the property 'is located near.the front ,part of the property and the proposed second home would be detached'and located behind the existing home. The project site is located on the south side of Sunnyside Avenue between South First Street and Industrial Way. General Plan 'Designation: The General Plan land use designation for the project site is Low-Medium Density Residential, which permits residential development with a density range between 6 and 13 units per gross acre. The density of the proposed project is 8.7 units: per gross acre,which is within the permitted density range for the site. Zoning Designation: The zoning designation for the project site is 'P-D (Planned Development). Under the P-D Zoning Ordinance, the construction of a new unit on an existing- lot that is already developed with an existing unit shall require approval of a Planned Development Permit by the City Council. Developments within the P-D zoning district must be consistent with the underlying land use designation of the General Plan. Planner Stephanie Willsey: • Said that under the zoning, a unit is considered detached if it does not share any common interior walls. • Advised that while there are no specific requirements for open space in the P-D Zoning, there is a 750 square foot minimum per unit for duplexes. This amount is exceeded with this application. • Assured that this second unit can never be sold off separately. This will remain two units on a single property. The current zoning designation of P-D (Planned Development) requires that the construction of a new unit on an existing lot that is already developed with an existing unit shall receive approval of a Planned Development Permit. by the City Council.
