This provision is intended to be the dispositive of all rights of indemnity and contribution between the parties, and property owner waives and releases any and all rights to indemnity or contribution from the City of Campbell, in law or equity, arising out of, or connected with any and all claims, actions, losses, liabilities and costs (including reasonably incurred attorney's fees) for which property owner is obligated under this paragraph to provide indemnity or defense to the City of Campbell, the City Redevelopment Agency, and its officers, officials, volunteers, employees or attorneys. ENC 2008-0008, is entered into this day of fz6-y-u a j^ J , 2008, by and between Brett Townsend, hereunder referred to as "O ers," and the CITY OF CAMPBELL, a municipal corporation of the County of Santa Clara, State of California,hereinafter referred to as "City." On October 10, 2006 the Planning Commission granted a site and architectural permit to allow the construction of a new repair building as a portion of an existing boat sales and repair facility for that certain real property commonly known as 130 E. Sunnyoaks Avenue, which property is hereinafter referred to as "said real property." TERMS AND CONDITIONS Now, therefore, in consideration of the above referenced approvals, and in satisfaction thereof, the parties to this Agreement shall comply with the following terms and conditions: (1) The Owners shall provide, construct and install at his/her own proper cost and expense, street improvements as described in Section 11.24.040 of the City Code within 12 months from the date first mentioned hereinabove; provided, however, that in the computation of said 12 month period, delays due to, or caused by acts of God, viz., unusually inclement weather, major strikes, and other delays. beyond the control of the Owners or his/her successors shall be excluded. (2) If the Owners fails to complete the work required by this Agreement within the said 12 month period, the City, after giving ten (10) days written notice to the Owners, or his/her successors, may construct and/or install said improvements and recover the full cost and expense from the Owners, or his/her successors. 1 t + t STREET IMPROVEMENT PLANS (3) The Owners, shall cause to be prepared at his/her cost and expense street improvement plans for the construction and installation of said improvements prior to such construction or installation. Said plans shall be prepared by a civil engineer registered by the State of California and submitted to the City Engineer for examination and approval. (4) All of said improvements embraced in this Agreement shall be constructed and installed in accordance with the plans approved by the City Engineer and shall be made under the inspection and to the satisfaction of the City Engineer. Said construction and/or installation shall be in accordance with the existing ordinances and resolutions of the City of Campbell and all applicable plans, specifications, standards, sizes, lines and grades approved by the City Engineer, and all State and County statutes. Upon completion and acceptance of the improvements by the City, the Owners, shall provide reproducible as- built plans to the City Engineer. PLAN CHECK AND INSPECTION FEE (5) Prior to approval of the plans- by the City Engineer pursuant to Section (3) of this Agreement, Owners, or his/her successors, shall pay the City for plan checking of improvement plans, field inspection of construction of improvements and all necessary expenses incurred by City in connection with said improvements, a sum calculated in accordance with Resolution No. 10494 as adopted by the City Council on May 3, 2005, or as may subsequently be adopted by the City Council. FAITHFUL PERFORMANCE SECURITY (6) The Owners, or his/her successors, shall file with City, prior to beginning construction, security acceptable to the City in amount equal to the City Engineer's estimated cost of the street improvements to ensure full and faithful performance of the construction of all the aforementioned_improvement work. Said security shall guarantee that Owners, and his/her successors, will correct any defects which may appear in said improvement work within one (1) year from the date of acceptance of the work by City and pay for any damage to other work resulting from the construction thereof, as well as pay the cost of all labor and materials involved. This security shall remain in effect until one (1) year after date of final acceptance of said improvements by City. Said security amount may be reduced by the City Engineer in his/her sole discretion after the date of final acceptance to not less than twenty-five(25)percent of its full value. (7) Upon final release of said security by City, the obligations of Owners, and his/her successors, contained in this Agreement shall be considered null and void, except as otherwise provided by applicable law, or Sections 12 or 13 of this Agreement. FORMATION OF A SPECIAL ASSESSMENT (8) The Owners, when called upon by City to do so, shall execute a petition for the formation of any special assessment district created pursuant to any special assessment act as 2 -- L i provided in the Streets and Highways Code of the State of California created for the purpose of constructing and/or installing any or all of said improvements. Owners, or his/her successors, -shall participate in and become a part of any special assessment district as described in Section(8) of this Agreement. (9) The Owner's, or his/her successors' obligations contained in this Agreement that are accomplished to the satisfaction of said City Engineer by said special assessment district shall be considered to satisfy those obligations. RIGHT-OF-WAY ACQUISITION (10) Owners at his/her own cost and expense, shall acquire any easement and right-of-way within or without said real property necessary for the completion of the improvements shown upon aforesaid improvement plans. It is provided, however, that in the event eminent domain proceedings are required for the purpose of securing said easement and right-of-way, Owners, shall deposit or cause to be deposited with City a sum covering the reasonable market value of the land proposed to be taken and to be included in said sum shall be a reasonable allowance for severance damages, if any. It is further provided that in addition thereto such sums as may be required for legal fees and costs, engineering and other incidental costs shall be deposited with the City. (11) The Owners, shall carry out any and all negotiations with all interested parties and shall perform or cause to be performed at his/her own cost and expense and to the satisfaction of the.City Engineer any and all work required to abandon, remove, raise, lower, relocate and otherwise modify irrigation lines within or without the boundary of said real property. INDEMNITY AND INSURANCE (12)- -- The--Owners, and -his/her successors,- to -the-fullest extent permitted by law, shall indemnify, defend and hold-the City_of Campbell, the City of Campbell Redevelopment Agency, and -its agents, employees, attorneys,-officers, officials and assignees harmless from_any and all claims,--actions, causes of action, liabilities, damages, losses and - - expenses, including, but not limited to, attorneys' fees, arising out of, or resulting from, or alleged to arise out of or result from any negligent or intentional act or omission (including misconduct) of said Owners, or his/her successors, or any subcontractor, or anyone directly or indirectly employed by him, or anyone for whose acts any of them may be liable in the course of performance of the Agreement, except for any claims, actions, causes of action, liabilities, damages, losses and expenses proximately caused by the sole negligence or willful misconduct of the City. (13) The Owners, and his/her successors, shall also indemnify, defend and hold the City of Campbell, the City of Campbell Redevelopment Agency, and, its agents, attorneys, employees, officers, officials, and assignees harmless against and from any and all claims, actions, causes of action, liabilities, demands, losses, lawsuits,judgments, damages, costs and expenses (including, but not limited to, attorneys' fees and court costs, whether 3 incurred at trial, appellate or administrative levels) which the City of Campbell may incur or suffer, or to which the City of Campbell maybe subjected resulting from, or alleged to result from the failure of Owners, or his/her heirs, assignees, successors, grantees, agents, employees, subcontractors, or anyone performing services under him, to fulfill any of the obligations imposed under this Agreement, except for any claims, actions, causes of action, liabilities,judgments, damages, costs and expenses proximately caused by the sole negligence or willful misconduct of the City. (14) The Owners and his/her successors shall also indemnify, defend and hold harmless the City, the City of Campbell Redevelopment Agency, and its agents, officers and employees from any claim, action, or proceeding against the City or its agents, officers or employees to attach, set aside, void or annul an approval of the City, its City Council, Planning Commission, Community Development Director, Public Works Director, Building Official, City Engineer, or other such City official concerning a subdivision, which action is brought within the time period provided for in California Government Code Section 66499.37. (15) The City will promptly notify the Owners of any claim, action or proceeding to attack, set aside, void or annul any approval concerning a subdivision of said real property, and will cooperate fully in the defense. (16) Owners and his/her/its successors shall maintain insurance for injuries to persons or damage to property conforming to the following specifications: A. Minimum Scope of Insurance Coverage shall be at least as broad as: - 1. Insurance_Services-Office-(ISO) CGL form CG-00 01 11 85; and 2. ISO form G0009 -11 88 Owners and Contractors Protective Liability Coverage Form—Coverage for-Operations of Designated Contractor; and 3. Course of Construction.Insurance covering all risks of loss; and - 4. ISO CA 00 0106 92 including symbol 1 (Any Auto); an 5. Workers' Compensation insurance as required by the Labor Code of the State of California and Employer's Liability insurance. B. Minimum Limits of Insurance Owners shall maintain limits no-less than: 1. General Liability: $1,000,000 combined single limit per occurrence for bodily, personal injury and property -damage. If Commercial General -- - Liability-Insurance or other form-with-a general aggregate limit is used, either the general aggregate limit shall apply separately to this project/location or the general aggregate limit shall be twice the required 4 occurrence limit. 2. Automobile Liability: $1,000,000 combined single limit per accident for bodily injury and property damage. 3. Workers' Compensation and Employer's Liability: Workers' Compensation limits as required by the Labor Code of the State of California and Employer's Liability limits of$1,000,000 per accident. C. Deductible and Self-Insured Retention Any deductibles or self-insured retention must be declared to and approved by the City. At the option of the City, either: the insurer shall reduce or eliminate such deductibles or self-insured retention as respects the City, the City of Campbell Redevelopment Agency, its agents, officers, attorneys, employees, officials and volunteers; or the Owners shall procure a bond guaranteeing payment of losses related to investigations, claim administration, and defense expenses. D. Other Insurance Provisions The policies are to contain, or be endorsed to contain, the following provisions: 1. General Liability and Automobile Liability Coverage: a. The City, City of Campbell Redevelopment Agency, its agents, officers, attorneys, employees, officials and volunteers are to be covered as insureds as respect to: liability arising out of activities related to this Agreement performed by or on behalf of the Owners, products and completed operations of the Owners, premises owned, occupied or used by the Owners, or automobiles owned, leased,--hired or borrowed by the Owners. _. - b. The Owner's insurance coverage shall be primary insurance as - -- - respects--the-City, City of Campbell Redevelopment Agency, -its _____agents, -officers,--attorneys, employees, officials and volunteers. Any insurance- or self-insurance maintained by the City, City of --Campbell,Redevelopment Agency, its agents, officers, attorneys, employees, officials and volunteers shall be excess of the Owner's insurance and shall not contribute with it. C. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the City, City of Campbell Redevelopment Agency, its agents, officers, attorneys, employees, officials, and volunteers. d. The Owner'-s insurance shall apply separately to each insured against whom claim is made or suit is brought except with respect to the limits of the insurer's liability. 5 e. Coverage shall not extend to any indemnity coverage for the active negligence of the City in any case where an .agreement to indemnify the City would be invalid under Subdivision (b) of Section 2782 of the California Civil Code. 2. Workers' Compensation and Employer's Liability Coverage: The insurer shall agree to waive all rights of subrogation against the City, City of Campbell Redevelopment Agency, its agents, officers, attorneys, employees, officials, and volunteers for losses arising from work performed by the Owners for the City. 3. Course of Construction Coverage: Course of Construction policies shall contain the following provisions: (a) the City shall be named as loss payee; and (b) the insurer shall waive all rights of subrogation against the City. 4. All Coverages: Each insurance policy required by this clause shall be endorsed to state that coverage shall not be suspended, voided, canceled by either party, reduced in coverage or in limits except after thirty (30) days prior written notice by certified mail, return receipt requested, has been given to the City. E. Acceptability of Insurers Without limiting Owner's indemnification provided hereunder, Owners shall take out and maintain at all times during the life of this contract, up to the date of acceptance of the work by the City, the policies of insurance listed in Paragraphs _12_through.l6 of this-Agreement. _Insurance is to be issued by an issuer with a current A.M. Best Rating of A:VH and be authorized to transact business in the State of California, unless otherwise approved by the City. F. Verification of Coverage Owners shall furnish the City with certificates of insurance evidencing coverage required by this clause. The certificates for each insurance policy are to be signed by a person authorized by that insurer to bind coverage on its behalf. The certificates are to be on forms provided by the City. Where by statue, the City Workers' Compensation related forms cannot be used, equivalent forms approved by the Insurance Commissioner are to be substituted.. All certificates are to be received and approved by the City before work commences. G. Subcontractors Owners shall include all subcontractors as insured under its policies or shall furnish separate certificates by each subcontractor. All coverage shall be subject 6 to all of the requirements stated herein. MUTUAL BENEFIT COVENANTS BINDING ON HEIRS, ASSIGNEES, SUCCESSORS, AND GRANTEES OF OWNERS (17) It is acknowledged that the provisions of this Agreement constitute covenants for the improvement of the subject real property for the mutual benefit of Owner's property, commonly known as 1691 and 1711 Bucknall Road, and the City's property, commonly described as Bucknall Road where it adjoins Owner's property. These covenants shall be considered to affect rights in the above-described real properties, and shall be binding on the heirs, assignees, successors, grantees and agents of the Owners to said real property. UNVESTED INTERESTS (18) Nothing contained herein shall be construed to transfer any unvested interests in real or personal property for purposes of the rule against perpetuities. BREACH OF CONTRACT (19) The City, upon breach any of the terms, conditions, or covenants of this Agreement by the Owners, shall be entitled to recover from the Owners, in addition to any other relief available in law or equity, all costs and compensation incurred in attempting to obtain enforcement of the Agreement, including reasonable attorneys' fees and court costs. ENTIRE AGREEMENT BINDING (20) This is the entire Agreement between the parties, and there are no representations, -- - agreements, arrangements or-- understandings that are not fully expressed herein. This Agreement can-be-executed-in counterparts by-the parties hereto, and as so executed shall consist of one agreement, binding on all parties. FINAL PLANS (21) Owners shall provide and construct public street improvements per final plans titled "STREET IMPROVEMENT PLANS — OFFSITE — 130 E. Street Improvements: Prior to issuance of any gradingibuilding permits, the applicant shall execute a street improvement agreement, cause plans for public street improvements to be prepared by a registered civil engineer, pay various fees and deposits, post security and provide insurance necessary to obtain an encroachment permit for construction of the standard public street improvements, as required by the City Engineer. The plans shall include the following: a. Show location of all existing utilities within the new and existing public right of way. b. Relocation of all existing utilities including utility boxes, covers, poles, fire hydrants, etc. outside of. sidewalk area. No utility boxes, covers, poles, fire hydrants, etc. will be allowed in the sidewalk area. c. Removal of existing driveway approach, cobblestone sidewalk, curb and gutter. d. Installation of City approved street trees and irrigation at 30 feet on center. e. Installation of City standard curb, gutter, sidewalk and ADA compliant driveway approach. f. Installation of traffic control, stripes and signs as necessary. g. Construction of conforms' to existing public and private improvements, as necessary. 3. Sunnyoaks Avenue 4. Utility Encroachment Permits: Separate permits for the installation of utilities to serve the development will be required (including water, sewer, gas, electric, etc.). Applicant shall apply for and pay all necessary fees for utility permits for sanitary sewer, gas, water and all other utility work. 5. Soils Report: Prior to issuance of any grading or building permits for the site, applicant shall provide a soils report prepared by a registered geotechnical or civil engineer. 6. Occupancy Prior to allowing occupancy for any and/or all buildings, the applicant shall have the required street improvements installed and accepted by the City, and the design engineer shall submit as-built drawings to the City. 7. Maintenance of Landscaping_ Owner(s), current and future, are required to maintain the landscaped park strip and tree wells in the public right of way. This includes, but is not limited to: trees, lawn, plantings, irrigation, etc. Trees shall not be pruned in a manner that would not allow the tree to grow to a mature height. 8. Water Meter(, and Sewer Cleanout(s): Existing and proposed water meter(s) and sewer cleanout(s) shall be relocated or installed on private property behind the public right-of- way line. 9. Utilities: All on-site utilities shall be installed underground per Section 21.18.140 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility companies. - -10. Utility Coordination Plan: Prior to issuance of building permits for the site, the applicant shall submit a utility coordination plan and schedule for approval by the City Engineer for installation and/or abandonment of all utilities. The plan shall clearly show the location and size of all existing utilities and the associated main lines; indicate which utilities and services are to remain; which utilities and services are to be abandoned, and where new utilities and services will be installed. Joint trenches for new utilities shall be used whenever possible. 11. Pavement Restoration: Based on the utility coordination plan, the applicant shall prepare a - pavement restoration plan for approval by the City Engineer prior to any utility installation or abandonment. Streets that have been reconstructed or overlaid within the previous five years will require boring and jacking for all new utility installations. E. Sunnyoaks Avenue has not been.reconstructed or overlaid in the last 5 years. The pavement restoration plan shall indicate how the street pavement shall be restored following the installation or- abandonment of all utilities necessary for the project. 12. Storm Drain Area Fee: Prior to recordation of the parcel map, the applicant shall pay the required Storm Drain Area fee, currently set at$2,650.00 per net acre, which is $3,763.00. Grading, and Drainage Plan: Prior to issuance of any grading or building permits for the site, the applicant shall conduct hydrology studies based on a ten-year storm frequency, prepare an engineered grading and drainage plan, and pay fees required to obtain necessary grading permits. The plans shall comply with the 1998 edition of the California Building Code including Chapters 10, 11, 18, 33, and Appendix Chapter 33. 14. Grading & Drainage Plan Review Fee: Prior to issuance of any grading or building permits for the site, the applicant shall pay the required Grading & Drainage Plan Review fee of$1,200.00 14. Stormwater Pollution Prevention Measures: Prior to issuance of any grading or building permits, the applicant shall comply with the National Pollution Discharge Elimination System (NPDES) permit requirements, Santa Clara Valley Water District requirements, and the Campbell Municipal Code regarding stormwater pollution prevention. Specifically the project must include source control, site design and treatment measures to achieve compliance with Provision C.3. of the NPDES Permit. Measures may include, but are not limited to, minimization of impervious surface area, vegetated swales, infiltration areas, and treatment devices. The primary objectives are to improve the quality and reduce the quantity of stormwater runoff to the bay. Resources to achieve these objectives include Stormwater Best Management Practices Handbook for New Development and Redevelopment ("CA BMP Handbook") by the California Stormwater Quality Association (CASQA), 2003; Start at the Source: A Design Guidance Manual for Stormwater Quality Protection ("Start at the Source") by the Bay Area Stormwater Management Agencies Association (BASMAA), 1999; and Using Site Design Techniques to Meet Development Standards for Stormwater Quality: A Companion Document to Start at the Source ("Using Site Design Techniques") by BASMAA, 2003. a. Upon submission of the preliminary site/grading plans, the applicant shall calculate and submit to the City the an ount of impervious surface created by the development including the types of stormwater controls to be used. b.. Prior to issuance of grading or building permits the applicant's designer or engineer shall submit the required certification indicating that sizing, selection, and design of treatment BMP's for the project site has been completed to meet the requirements of the City of Campbell's NPDES permit, No. 01-119, Provision C.3. C. The applicant shall also comply with any other or new conditions as required by the City of Campbell's most current NPDES permit. Any changes are in conformance with local, state, or federal regulations. Prior to occupancy, the applicant shall provide security for the operation and maintenance of stormwater pollution prevention measures installed or provided as a part of this project. Prior to issuance of any grading or building permits, the applicant shall sign the "Covenants for the Operation and Maintenance -of Stormwater Facilities" and submit a Stormwater Management Plan. 15. State General Construction Activity Permit: Prior to issuance of any grading or building permits, the applicant shall comply with the State General Construction Activity Permit requirements including paying fees, filing a Notice of Intent and providing a Storm Water Pollution Prevention Plan (SWPPP). The proposed repair building would be located towards the rear of the site in a similar location to the area occupied by the prior repair building. Property `Description: The subject property is located on the south side of East Sunnyoaks Avenue between-Dell Avenue and San Tomas Expressway. The property is currently developed with.a single-story industrial office/repair building towards the front of the site. ANALYSIS General Plan Designation: The General Plan land use designation for the project site is Light Industrial. The proposed boat sales and repair use is compatible with the General Plan land use designation of the site. The proposed project complies with the following General Plan Land Use Element Policies and Strategies: Strategy LUT-7.2n: Consistency with Plans: Ensure that new development and substantial remodeling projects are consistent with Specific Plans, Area Plans, City Standard Details and adopted Streetscape Standards to create cohesive design. StrategyLUT-9.3e: Building Materials: Encourage the use of long-lasting, high quality building materials on all buildings to ensure the long-term quality of the built environment. Policy LUT-13.1: Variety of Uses: Attract and maintain a variety of uses that create an economic balance within the City while maintaining a balance with other community land use needs and while providing high quality services to the community. Zoning Designation: The zoning designation for the project site is M-1-S (Light Industrial). A Conditional Use Permit is required for the establishment of a new boat sales and repair use, however, the existing use was established prior to this requirement. A Site and Architectural Approval is required to replace the repair building in that it was destroyed over one year ago. The proposed project will be consistent with the Zoning Ordinance with approval of a Site and Architectural Approval Permit. Use: The proposed use is a repair building towards the rear of the site. Parking: Chapter 21.28 (Parking and Loading) of the Zoning Code requires one parking space for each 350 square feet of gross floor area and two spaces for each service bay or 47 parking spaces. A total of 47 parking spaces are shown on the site plan. The building elevations depict a simple rectangular shaped building with stucco walls and a split face wainscoting accents. The building accommodates a small storefront system at the office and six service bay doors. Landscaping: The project site currently does not have any landscaping; however, the applicant is proposing to install 2.3 percent in new landscaping around the perimeter of the front parking lot. Staff is supportive of the proposed site layout and design as it will significantly improve the existing conditions of the project site. Street Improvements: The recommended Conditions of Approval from the Public Works Department call fora new sidewalk along the street frontage. The street improvements require the installation of City standard curb, guttet,'sidewalk, ADA compliant driveway approach, and City approved street trees, tree wells, and irrigation at 30-feet on center. The applicant will be required to modify the Site Plan prior to Building Permit submittal to identify the required street improvements. Failure to meet these deadlines will result in the Site and Architectural Review Permit being void. 3. Operational Hours: The hours of operation shall be limited to 6:00am to 11:00pm daily. 4. Property Maintenance: The owner/operator of the subject property shall maintain all exterior areas of the business free from graffiti, trash, rubbish, posters and stickers placed on the property. 5. Landscape Plan: The applicant shall submit four sets of a landscape and irrigation plan to the Planning Division, prior to the issuance of building permits, for review and approval by the Community Development Director. The landscape and irrigation plan shall substantially conform with the approved conceptual landscape plan and the City's Water Efficient Landscaping Standards (WELS) and shall include the following: Attachment#2 Page 2 of 8 a. All shrubs shall be a minimum five gallon size plant material and all trees shall be a minimum 15-inch boxed container. b. Required landscaping shall consist of turf, ground cover, shrubs, trees, and boulders in combination to provide attractive screening of parking lots and other paved area. Required landscaping shall consist of a variety of species and sizes. 6. Outdoor Storage: No outdoor storage is permitted on the subject property in the front parking area. No equipment, materials or business vehicles or boats shall be parked and/or stored outside the building within the front parking lot beyond normal business hours. 7. Parking and Driveways: . All.parking:and driveway areas shall be maintained in compliance with the standards in Chapter 21.28 (Parking and Loading) of the Campbell Municipal Code. 8. On-Site Lighting: Any proposed on-site lighting shall be shielded away from adjacent properties and directed on site. The design, type, lighting intensity, and location of any exterior lighting fixtures shall be reviewed and approved by the Community Development Director prior to issuance of a building permit for such lighting. Lighting fixtures shall be of a decorative design to be compatible with the development and shall incorporate energy saving features. 9. Location of Mechanical .Equipment: No roof-mounted mechanical equipment (i.e. air conditioning units, ventilation ducts or vents), shall be added to the existing building without providing screening of the mechanical equipment from public view and surrounding properties. The screening material and method shall be architecturally compatible with the building and requires review and approval by the Community Development Director and Building Division prior to installation of such screening. 10. SM: No signage is permitted as part of the development application approved herein. New signage shall not be installed prior to approval of a sign permit as required by Chapter 21.30 (Signs) of the Campbell Municipal Code. 11. Skylights: The applicant shall submit building permit plans with details for the provision of approximately 6 skylights in the proposed building for the review and approval of the Community Development Director. Building Division: 12. Permits Required: A building permit application shall be required for the proposed change in use from the existing industrial building to a new medical therapy use. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. 13. Construction Plans: The conditions of approval shall be stated in full on the cover sheet of construction plans submitted for building permit. Attachment#2 Page 3 of 8 14. Size of Plans: The maximum size of construction plans submitted for building permits shall be 24 inches by 36 inches. 15. Plan Preparation: This conversion of use project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be"wet stamped" and signed by the qualifying professional person. , 16. Site Plan: Application for building permit shall include a competent site plan that identifies property and proposed structures with dimensions and elevations as appropriate. Site plan shall also include site drainage details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. 17. Title 24 Energy Compliance: California Title 24 Energy Standards Compliance forms shall be- blue-lined on the construction plans. Compliance with the Standards shall be demonstrated for conditioning of the building envelope and lighting of the building. 18. Special Inspections: When a special inspection is required by U.B.C. Section 1701, the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Official for approval prior to issuance of the building permits; in accordance with U.B.0 Section 106.3.5. Please obtain City of Campbell, Special Inspection forms from the Building Inspection Division Counter. 19. Non-Point Source Provisions: The City of Campbell, standard Santa Clara Valley Non-point Source Pollution Control Program specification sheet shall be part of plan submittal. The specification sheet(size 24"X 36")is available at the Building Division service counter. 20. Title 24 Accessibility— Commercial: On site general path of travel shall comply with the latest California Title 24 Accessibility Standards. Work shall include but not be limited to accessibility to building entrances from parking facilities and sidewalks. 21. Title 24 Accessibility Hardship Exemption: Projects seeking to use the Title 24 Hardship exemption clause shall blue-line completed, City of Campbell "20%0" exemption form on submitted construction plans. Form is available at Building Division service counter. 22. Approvals Required: The project requires the following agency approval prior to issuance of the building permit: a. West Valley Sanitation District b. Santa Clara County Fire Department 23. P.G:&E.: Applicant is advised to contact Pacific Gas and Electric Company as early as possible in the approval process. Service installations, changes and/or relocations may require substantial scheduling time and can cause significant delays in the approval process. Applicant should also consult with P.G. and E. concerning utility easements, distribution pole locations and required conductor clearances. Attachment#2 Page 4 of 8 COUNTY FIRE DEPARTMENT 24. Required Fire Flow: The fire flow for this project is 1750 gpm at 20 psi residual pressure. As an automatic fire sprinkler system will be installed, the fire flow has been reduced by 50 percent establishing a required adjusted fire flow of 1500 gpm (plus sprinkler system demand) at 20 psi residual pressure. Applicant plans to install a voluntary sprinkler system per comments on sheet A0.01. A State of California licensed (C-16) Fire Protection Contractor shall submit plans, calculations, a completed permit applicant and appropriate fees to the department for review and approval prior to beginning their work. 25. Fire Apparatus (Engine) Access Roads Required: Provide access roadways with a paved all weather surface, a minimum unobstructed width of 20 feet, vertical clearance of 13 feet 6 inches. Installations shall conform to Fire Department Standard Details and Specifications sheet A-L 26. Fire Department (Engine) Roadway Turn-around Required: Provide an approved fire department engine roadway turnaround with a minimum radius of 36 feet outside and 23 feet inside. Revise drawings to show turn around which complies with standard specification A-l. 27. On-Site Private Fire Service Mains and/or Hydrants: Installation of private fire service mains and/or fire hydrants shall conform to National Fire Protection Association (NFPA) Standard #24, and Fire Department Standard Details and Specification W-2. If the supply piping is "combined" (sprinkler system and hydrants), a U.L. approved 4-way FDC shall be provided. A separate installation permit from the fire department is required. 28. Public Fire Hydrant(s) Required: Provide one public fire hydrant at location to be determined by the Fire Department. Hydrant shall have a minimum single flow of 1500 gpm at 20 psi residual pressure, with spacing not to exceed 250 feet. Prior to applying for building permit, provide civil drawings reflecting all fire hydrants serving the site. Install new public hydrant at east property line. 29. New Commercial Buildings: All new commercial buildings shall comply with standard specification SI-7 for construction site safety. 30. Timingof of Required Water Supply Installations: Installations of required fire service(s) and fire hydrant(s) shall be tested and accepted by the Fire Department, prior to the start of framing or delivery of bulk combustible materials. Building permit issuance may be withheld until required installations are completed, tested and accepted. 31. Fire Hydrant Location Identifier: Prior to project final inspection, the general contractor shall ensure than an approved ("Blue Dot") fire hydrant location identifier has been placed in the roadway, as directed by the fire department. 32. Emergency Gate/Access Gate Requirements: Gate installations shall conform to Fire Department Standard Details and Specification G-1 and, when open shall not obstruct any Attachment#2 Page 5 of 8 portion of the required width for emergency access roadways or driveways. Locks, if provided, shall be fire department approved prior to installation. 33. Fire Department Key Box Required: The building shall be equipped with a permanently installed emergency access key lock box (Knox), conforming to Fire Department Standard Detail and Specification sheet K-1. At time of final inspection, access keys shall be provided to the fire department. 34. Premises Identification: Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Numbers shall contrast with their background. PUBLIC WORKS DEPARTMENT 35. Preliminary Title Report: The applicant shall provide a current (within the past 6 months) Preliminary Title Report. 36. Street Improvements: Prior to issuance of any gradingibuilding permits, the applicant shall execute a street improvement agreement, cause plans for public street improvements to be prepared by a registered civil engineer, pay various fees and deposits, post security and provide insurance necessary to obtain an encroachment permit for construction of the standard public street improvements, as required by the City Engineer. ,The plans shall include the following: a. Show location of all existing utilities within the new and existing public right of way. b. Relocation of all existing utilities including utility boxes, covers, poles, fire hydrants, etc. outside of sidewalk area. No utility boxes, covers, poles, fire hydrants, etc. will be allowed in the sidewalk area. c. Removal of existing driveway approach, cobblestone sidewalk, curb and gutter: d. Installation of City approved street trees and irrigation at 30 feet on center. e. Installation of City standard curb, gutter, sidewalk and ADA compliant driveway approach. f. Installation of traffic control, stripes and signs as necessary. g. Construction of conforms to existing public and private improvements, as necessary. 37. Additional Street Improvements: Should any new utility main lines or other work required to service the development affects any public improvements, the City may add conditions to the development/project, at the discretion of the City Engineer, to restore pavement or other affected public improvements to the satisfaction of the City. 38. Utility Encroachment Permits: Separate permits for the installation of utilities to serve the development will be required (including water, sewer, gas, electric, etc.). Applicant shall apply for and pay all necessary fees for utility permits for sanitary sewer, gas, water and all other utility work. 39. Soils Report: Prior to issuance of any grading or building permits for the site, applicant shall provide a soils report prepared by a registered geotechnical or civil engineer. i - Attachment#2 Page 6 of 8 40. Occupancy: Prior to allowing occupancy for any and/or all buildings, the applicant shall have the required street improvements,installed and accepted by the City, and the design engineer shall submit as-built drawings to the City. 41. Maintenance of Landscaping: Owner(s), current and future, are required to maintain the landscaped park strip and tree wells in the public right of way. This includes, but is not limited to: trees, lawn, plantings, irrigation, etc. Trees shall not be.pruned in a manner that would not allow the tree to grow to a mature height. 42. Water Meter(s) and Sewer Cleanout(s): Existing and proposed water meter(s) and sewer cleanout(s) shall be relocated or installed on private property behind the public right-of-way line. 43. Utilities: All on-site utilities shall be installed underground per Section 21.18.140 of the Campbell.Municipal Code for any new or remodeled buildings or additions. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility companies:' 44. Utility Coordination Plan: Prior to issuance of building permits for the site, the applicant shall submit a utility coordination plan and schedule for approval by the City Engineer for installation and/or abandonment of all utilities. The plan shall clearly show the location and size of all existing utilities and the associated main lines; indicate which utilities and services are to remain; which utilities and services are to be abandoned, and where new utilities and services will be installed. Joint trenches for new utilities shall be used whenever possible. 45. Pavement Restoration: Based on the utility coordination plan, the applicant shall prepare a pavement restoration plan for approval by the City Engineer prior to any utility installation or abandonment. Streets that have been reconstructed or overlaid within the previous five years will require boring and jacking for all new utility installations. E. Sunnyoaks Avenue has not been reconstructed or overlaid in the last 5 years. The pavement restoration plan shall indicate how the street pavement shall be restored following the installation or abandonment of all utilities necessary for the project. 46. Storm Drain Area Fee: Prior to recordation of the parcel map, the applicant shall pay the required Storm Drain Area fee, currently set at$2,650.00 per net acre, which is $3,763.00. 47. Grading and Drainage Plan: Prior to issuance of any grading or building permits for the site, the applicant shall conduct hydrology studies based on a ten-year storm frequency, prepare an engineered grading and drainage plan, and pay fees required to obtain necessary grading permits. The plans shall comply with the 1998 edition of the California Building Code including Chapters 10, 11, 18, 33, and Appendix Chapter 33. 48. Grading & Drainage Plan Review Fee: Prior to issuance of any grading or building permits for the site, the applicant shall pay the required Grading & Drainage Plan Review fee of $1,200.00. 49. Stormwater Pollution Prevention Measures: Prior to issuance of any grading or building permits, the applicant shall comply with the National Pollution Discharge Elimination Attachment#2 Page 7of8 System (NPDES).permit requirements, Santa Clara Valley Water District requirements, and. the Campbell Municipal Code regarding stormwater pollution prevention. Specifically the project must include source control, site design and treatment measures to achieve compliance with Provision C.3. of the NPDES Permit. Measures may include, but are not limited to, minimization of impervious surface area, vegetated swales, infiltration areas, and treatment devices. The primary objectives are to improve the quality and reduce the quantity of stormwater runoff to the bay. Resources to achieve these objectives include Stormwater Best Management Practices Handbook for New Development and Redevelopment ("CA BMP Handbook") by the California Stormwater Quality Association (CASQA), 2003; Start at the Source: A Design Guidance Manual for Stormwater Quality Protection ("Start at the Source") by the Bay Area Stormwater Management Agencies Association (BASMAA), 1999; and Using Site Design Techniques to Meet Development Standards for Stormwater Quality: A Companion Document to Start at the-Source ("Using Site Design Techniques")by BASMAA, 2003. a. Upon sulimission of the preliminary'site%grading plans, the applicant shall calculate and submit to the City the amount of impervious surface created by the development including the types of stormwater controls to be used. b. Prior to issuance of grading or building permits the applicant's designer or engineer shall submit the required certification indicating that sizing, selection, and design of treatment BMP's for the project site has been completed to meet the requirements of the City of Campbell's NPDES permit,No. 01-119, Provision C.3. c. The applicant shall also comply with any other or new conditions as required by the City of Campbell's most current NPDES permit. Prior to occupancy, a qualified BMP certifier is required to inspect the stormwater management facilities, submit a complete set of as-built drawings to Public Works Engineering, and certify on these drawings that: a. The stormwater management facilities were constructed in compliance with the approved plans, b. The as-built drawings show all pertinent constructed dimensions, elevations, shapes, and materials; c. All variations in construction from the approved design plan have been identified, including omissions to and additions from the approved plan; and d. Any changes are in conformance with local, state, or federal regulations. Prior to occupancy, the applicant shall provide security for the operation and maintenance of stormwater pollution prevention measures installed or provided as a part of this project. Prior to issuance of any grading or building permits, the applicant shall sign the "Covenants for the Operation and Maintenance of Stormwater Facilities" and submit a-Stormwater Management Plan.
