Dear Mr. Lerner,
The Planning Division has reviewed your August 28, 2013 submittal of a Conditional Use
Permit application to allow a new liquor establishment (full bar) with late-night operational
hours within an existing retail building located at the above referenced property. This proposal
was reviewed pursuant to the standards set forth by the C-2 (General Commercial) Zoning
District and the Campbell General Plan. Based upon this review, this application has been
deemed incomplete. The following additional details and revisions are needed in order to
continue processing of this application:
PLAN REVISIONS
1. Site Plan (Sheet A-1): Revise the Site Plan as follows:
a. Re-label this sheet as "Existing Site Plan".
b. Label and depict the current tenants within the building (not showing Boswell's).
c. Indicate parking stall dimensions.
d. Indicate dimensions for the refuse enclosures.
2. Proposed Site Plan: Provide a Proposed Site Plan, which shall:
a. Label the remaining tenants within the building (showing Boswell's).
b. Depict the minimum aisle width and turn-around dimensions required by the Fire
Department (reference enclosed comments).
c. Depict the accessible path-of-travel from the public sidewalk to the main entrance
as required by the Building Division (reference enclosed comments).
d. Indicate the replacement of the existing driveway approach with an ADA
compliant approach as required-by the Public Works Department (reference
enclosed comments).

Proposed Site Plan.

ADDITIONAL MATERIALS
1. Acoustical Analysis: Please provide an Acoustical Analysis, prepared by a qualified
professional that analyzes the noise generation of the proposed live entertainment: The
analysis shall include an evaluation of the-hours of the live entertainment, the type of live
entertainment, the level of amplification, and building/window construction as it relates
to noise attenuation. The analysis shall include recommended measures to mitigate noise
impacts to adjacent residential properties.
2. Security and Queuing Management Plan: Provide a Security and Queuing Management
Plan, which shall indicate the location of a queuing line; entrance controls; number and
qualifications of security personnel; number, placement, and accessibility of security
cameras; and any other relevant security-related information.
3. .Photometric Plan: Due to the security issues associated with a full bar, additional on-site .
lighting will likely be required. To ensure that the additional lighting does not spill-over
to adjacent residential properties, please provide a Photometric Plan prepared by a
qualified professional in compliance with City's Lighting Design_.Standards (reference
enclosure).
4. Live Entertainment Schedule: Provide a proposed live entertainment schedule that
describes the anticipated scheduling of entertainment acts.
5. Parking Modification Permit: The parking demand for the proposed full bar
(approximately 39 spaces) exceeds the pro-rated share of property's parking for the
subject tenant space (13 spaces). As such, an application for a Parking Modification
Permit in conjunction with the Conditional Use Permit application is required pursuant to
CMC Sec. 21.28.050. To review this request, the following materials are necessary:
a. Occupancy Information: Based the bar's current location, provide information
on Boswell's occupancy pattern by days of the weeks and hours of the day. For
instance, Friday at 11:00 PM = 80 patrons, Friday at 1:00 AM = 110 patrons, etc.
The purpose is to determine the bar's peak hours to understand the impact.to the
site's parking supply.
b. Parking Management Plan: Provide a Parking Management Plan that creates a
cohesive framework for managing the bar's parking demand, including valet
service (location of valet booth, location of parked vehicles, etc.), taxi queuing (if
applicable), and ,provision for off-site auxiliary parking .if necessary to
accommodate high demand events (e.g., for special music performances).

6. Neighborhood Outreach: As previously discussed, voluntary outreach to adjacent
residents is strongly encouraged by the City's Planning Commission. Please provide a
letter explaining what.outreach you have done, or plan to do, with surrounding residents.

PUBLIC WORKS DEPARTMENT CONDITIONS OF APPROVAL
1. Preliminary Title Report: Prior to issuance of any grading or building permits for the site,
the applicant shall provide a current(within the past 6 months)Preliminary Title Report.
2. Storm Drain Area Fee: Prior to issuance of any grading or building permits for the site, the
applicant shall pay the required Storm Drain Area fee, currently set at $2,650 per net acre,
which is $2,050 (set for commercial land use).
3. Utility Coordination Plan: Prior to issuance of building permits for the site, the applicant
shall submit a utility coordination plan and schedule for approval by the City Engineer for
installation and/or abandonment of all utilities. The plan shall clearly show the location and
size of all existing utilities and the associated main lines; indicate which utilities and
services are. to remain; which utilities and services are to be abandoned, and where new
utilities and services will be installed. Joint trenches for new utilities shall be used
whenever possible.
4. Pavement Restoration: Based on the utility coordination plan, the applicant shall prepare a
pavement restoration plan for approval by the City Engineer prior to any utility installation
or abandonment. Streets that have been reconstructed or overlaid within the previous five
years will require boring and jacking for all new utility installations. Bascom Avenue was
overlaid in 2013. The pavement restoration plan shall indicate how the street pavement
shall be restored following the installation or abandonment of all utilities necessary for the
project.
5. Street Improvements: Prior to issuance of any grading or building-permits for the site, the
applicant shall execute a street improvement agreement, cause plans for public street
improvements to be prepared by a registered civil engineer, pay various fees and deposits,-
post security and provide insurance necessary to obtain an encroachment permit for

construction of the-standard public street improvements, as required by the City Engineer.
The plans shall include the following, unless otherwise approved by the City Engineer:
a. Show location of all existing utilities within the existing public right of way.
b. Relocation of all existing utilities including utility boxes, covers, etc. outside of
new driveway approach area (if applicable). New boxes will not be allowed
within the City's right of way.
c. Removal of existing driveway approach and necessary sidewalk, curb and
gutter.
d. Installation of City approved street trees, tree wells and irrigation at 30 feet on
center.
e. Installation of City standard ADA compliant driveway approach and associated
curb, gutter and sidewalk.
f. Installation of asphalt concrete overlay per street pavement restoration plan for
utility installation and/or abandonment, as required by the City Engineer.
g. Construction of conforms to existing public and private improvements, as
necessary.
h. Submit final plans in a digital format acceptable to the City
6. Utility Encroachment Permit: Separate permits for the installation of utilities to serve the
development will be required (including water, sewer, gas, electric, etc.). Applicant shall_
apply for and pay all necessary fees for utility permits for sanitary sewer, gas, water,
electric and all other utility work.
7. Additional Street Improvements: Should it be discovered after the approval process that
new utility main lines, extra utility work or other work is required to service the
development, and should those facilities or other work affect any public improvements, the
City may add conditions to the development/project/permit, at the discretion of the City
Engineer, to restore pavement or other public improvements to the satisfaction of the City.
8. Stormwater Pollution Prevention Measures: Prior to issuance of any grading or building
permits, the applicant shall comply with the National Pollution Discharge Elimination
System (NPDES)permit requirements, Santa Clara Valley Water District requirements, and
the Campbell Municipal Code regarding stormwater pollution prevention. The primary
objectives are to improve the quality and reduce the quantity of Stormwater runoff to the
bay.
Resources to achieve these objectives include Stormwater Best Management Practices
Handbook for New Development and Redevelopment ("CA BMP Handbook") by the
California Stormwater Quality Association (CASQA), 2003; Start at the Source: A
Design Guidance Manual for Stormwater Quality Protection ("Start at the Source") by the
Bay Area Stormwater Management Agencies.Association (BASMAA), 1999; and Using
Site Design Techniques to Meet Development Standards for Stormwater Quality: A
Companion Document to Start at the Source ("Using Site Design Techniques") by
BASMAA, 2003.

9. Occupancy and Building Permit Final: Prior to allowing occupancy and/or final building
permit signoff for any and/or all buildings, the applicant shall have the required street
improvements installed and accepted by the City, and the design engineer shall submit as-
built drawings to the City.
10. Plan Lines: Prior to issuance of any grading or building permits for the site, the applicant
shall provide a plan layout showing the correct distance from the street centerline to the
property line, dimensions of sidewalk and other relevant information in the public right of
way.

Note: No building code issue has been reviewed at Development Review Committee; it will be reviewed in the
Building Permit process. Please be aware that building codes are changing constantly;plans submitted for
building permit shall comply with the code in effect at that time. Submit permit application together with
required documents to the Building Inspection Division to obtain a building permit. No construction can be
commenced without an appropriate building permit.
It is recommended that this item be forwarded to the Planning Commission for review,with the following
conditions.
TO THE SATISFACTION OF THE BUILDING DIVISION MANAGER/BUILDING OFFICIAL:
1. PERMITS REQUIRED: A building permit application shall be required for the proposed tenant
improvement to the existing building to create an A-2 Occupancy. The building permit shall
include Electrical/Plumbing/Mechanical fees when such work is Dart of the permit. The building
shall be made to comply with all the requirements necessary taa`-Occupancy.
2. CONSTRUCTION PLANS: The conditions of Approval shall be stated in full on the cover
sheet of construction plans submitted for building permit.
3. SIZE OF PLANS: The minimum size of construction plans submitted for building permits shall
be 24 in. X 36 in.
4. PLAN PREPARATION: This project requires plans prepared under the direction and oversight
of a California licensed Engineer or Architect. Plans submitted for building permits shall be
"wet stamped"and signed by the qualifying professional person.
5. SITE PLAN: Application for building permit shall include a competent site plan that identifies
property and proposed structures with dimensions and elevations as appropriate. Site plan shall
also include site drainage details. Site address and parcel numbers shall also be clearly called
out. Site parking and path of travel to public sidewalks shall be detailed.
6. TITLE 24 ENERGY COMPLIANCE: California Title 24 Energy Standards Compliance forms
shall be blue-lined on the construction plans. Compliance with the Standards shall be
demonstrated for conditioning of the building envelope and lighting of the building.

7. SPECIAL INSPECTIONS: When a special inspection is required by C.B.C. Chapter 17,the
architect or engineer of record shall prepare an inspection program that shall be submitted to the
Building Official for approval prior to issuance of the building permits, in accordance with C.B.0
Appendix Chapter 1, Section 106. Please obtain City of Campbell, Special Inspection forms
from the Building Inspection Division Counter.
8. The City of Campbell, standard Santa Clara Valley Non-point Source Pollution Control Program
specification sheet shall be part of plan submittal. The specification sheet (size 24"X 36") is
available at the Building Division service counter.
9. TITLE 24 ACCESSIBILITY—COMMERCIAL: On site general path of travel shall comply
with the latest California Title 24 Accessibility Standards. Work shall include but not be limited
to accessibility to building entrances from parking facilities and sidewalks.
10. TITLE 24 ACCESSIBILITY—COMMERCIAL: Projects seeking to_use the Title 24 Hardship
exemption clause shall blue-line completed, City of Campbell"20%"exemption form on
submitted construction plans. Form is available at Building Division service counter.
11. APPROVALS REQUIRED: The project requires the following agency approval prior to
issuance of the building perrnit:
a. West Valley Sanitation District
b. Santa Clara County Fire Department
C. Santa Clara County Department of Environmental Health
12. P.G.&E.: Applicant is advised to contact Pacific Gas and Electric Company as early as
possible in the approval process. Service installations, changes and/or relocations may require
substantial scheduling time and can cause significant delays in the approval process. Applicant
should also consult with P.G. and E. concerning utility easements,distribution pole locations and
required conductor,clearances.
13. STORM WATER REQUIREMENTS: Storm water run-off from impervious surface created by
this permitted project shall be directed to vegetated areas on the project parcel. Storm water shall
not drain onto neighboring parcels.

21.18.090 Lighting design standards.
A. Exterior lighting. Exterior lighting shall be:
1 Architecturally integrated with the character of the structure(s);
2. Energy-efficient, and fully shielded or recessed; and
3• Completely t rued off or significantly dimmed at the close of business hours when the
exterior lighting is not essential for security and safety, when located on parcels within
nonresidential zoning districts.
B. Permanent lighting. Permanently installed lighting shall not blink, flash, or be of unusually high
intensity or brightness. Lighting fixtures shall be appropriate in height, intensity, and scale to
the use they are se ing.
C. Shielding requirements. Outdoor lighting fixtures shall be designed and installed so that light
rays are not emitted across property lines, to the extent possible. Fixtures like the "shoe box"
design are capable of providing accurate light patterns and can be used for lighting parking
lots without spilling onto the neighboring property.

D. Design criteria.
1 External light fixtures, poles, and their foundation should be simple in design and
compatible with and complimentary to the style of surrounding development. Historical-
themed fixtures are not appropriate for a contemporary building design and modern
fixtures are not appropriate for a structure with a significant historical design theme.
Simple and f u nctional designs are considered to be appropriate in most environments.
Lighting standards should be of a scale that is compatible with their surroundings.
Pedestrian-style lighting (three to five feet high) should be installed in areas where foot
traffic is prevalent. Lighting fixtures for parking lots and private roadways.,should not be
installed at a height greater than twenty feet.
2. Color-correct ed lamps of appropriate intensity should be used in exterior lighting. High-
efficiency la i ps that alter the colors of objects at night are discouraged. Incandescent,
fluorescent, color-corrected sodium vapor and mercury lamps should be used because
they provide �Iight with an appropriate color spectrum.
3. Lighting intensity should be the minimum required to serve the tasks for which the
fixtures are i Itended.
4. Exterior lighting should be considerate of both the neighbors and the community as a
whole. Each new lighting scheme should actively strive to reduce negative light impacts.

PUBLIC WORKS DEP TMENT CONDITIONS OF APPROVAL
1. Prelimin Title Rloft: Prior to issuance of any grading or building permits for the site,
the applicant shall provide a current(within the past 6 months)Preliminary Title Report.
2. Storm Drain Area F e: Prior to issuance of any grading or building permits for the site, the
applicant shall pay the required Storm Drain Area fee, currently set at $2,650 per net acre,
which is $2,050 (set for commercial land use).
3. Utilily Coordination Plan: Prior to issuance of building permits for the site, the applicant
shall submit a utility coordination plan and schedule for approval by the City Engineer for
installation and/or abandonment of all utilities. The plan shall clearly show the location and
size of all existing utilities and the associated main lines; indicate which utilities and
services are to remain; which utilities and services are to be abandoned, and where new
utilities and services will be installed. Joint trenches for new utilities shall be used
whenever possible.
4. Pavement Restoratio : Based on the utility coordination plan, the applicant shall prepare a
pavement restoratio plan for approval by the City Engineer prior to any utility installation
or abandonment. Streets that have been reconstructed or overlaid within the previous five
years will require bo 'ng and jacking for all new utility installations. Bascom Avenue was
overlaid in 2013. T e pavement restoration plan shall indicate how the street pavement
shall be restored following the installation or abandonment of all utilities necessary for the
project.
5. Street Im r�ove_mentsr Prior to issuance of any grading or building permits for the site, the
applicant shall execute a street improvement agreement, cause plans for public street
improvements to be repared by a registered civil engineer, pay various fees and deposits,
post security and provide insurance necessary to obtain an encroachment permit for

construction of the standard public street improvements, as required by the City Engineer.
The plans shall include the following, unless otherwise approved by the City Engineer:
a. Show location of all existing utilities within the existing public right of way.
b. Relocation of all existing utilities including utility boxes, covers, etc. outside of
new driveway approach area (if applicable). New boxes will not be allowed
within the City's right of way.
c. Removal of existing driveway approach and necessary sidewalk, curb and
gutter.
d. Installation of City approved street trees, tree wells and irrigation at 30 feet on
center.
e. Installation of City standard ADA compliant driveway approach and associated
curb, gutter and sidewalk.
f. Installation of asphalt concrete overlay per street pavement restoration plan for
utility installation and/or abandonment, as required by the City Engineer.
g. Construction of conforms to existing public and private improvements, as
necessary.
h. Submit final plans in a digital format acceptable to the City
6. Utility Encroachment Permit: Separate permits for the installation of utilities to serve the
development will be required (including water, sewer, gas, electric, etc.). Applicant shall
apply for and pay all necessary fees for utility permits for sanitary sewer, gas, water,
electric and all other utility work.
7. Additional Street Improvements: Should it be discovered after the approval process that
new utility main lines, extra utility work or other work is required to service the
development, and should those facilities or other work affect any public improvements, the
City may add conditions to the development/project/permit, at the discretion of the City
Engineer, to restore pavement or other public improvements to the satisfaction of the City.
8. Stormwater Pollution Prevention Measures: Prior to issuance of any grading or building
permits, .the applicant shall comply with the National Pollution Discharge Elimination
System (NPDES)permit requirements, Santa Clara Valley Water District requirements, and
the Campbell Municipal Code regarding stormwater pollution prevention. The primary
objectives are to improve the quality and reduce the quantity of stormwater runoff to the
bay.
Resources to achieve these objectives include Stormwater Best Management Practices
Handbook for New Development and Redevelopment ("CA BMP Handbook") by the
California Stormwater Quality Association (CASQA), 2003; Start at the Source: A
Design Guidance Manual for Stormwater Quality Protection ("Start at the Source")by the
Bay Area Stormwater Management Agencies Association (BASMAA), 1999; and Using
Site Design Techniques to Meet Development Standards for Stormwater Quality: A
Companion Document to Start at the Source ("Using Site Design Techniques") by
BASMAA, 2003.

9. Occupancy and Building Permit Final: Prior to allowing occupancy and/or final building
permit signoff for any and/or all buildings, the applicant shall have the required street
improvements installed and accepted by the City, and the design engineer shall submit as-
built drawings to the City.
10. Plan Lines: Prior to issuance of any grading or building permits for the site, the applicant
shall provide a plan layout showing the correct distance from the street centerline to the
property line, dimensions of sidewalk and other relevant information in the public right of
way.

contiguous with the ublic right-of-way along the
frontage, unless oth-,rwise approved by the City Engineer. The applicant shall cause all
documents to be pre�ared by a registered civil engineer/land surveyor, as necessary, for the
City's review and re ordation.
3. Storm Drain Area ee: Prior to (issuance of any grading or building permits for the
site)(recordation of�he parcel map/final map), the applicant shall pay the required Storm
Drain Area fee, curr ntly set at $0,000.00 per net acre, which is $000.00 (set for R-1/multi
family/commercial band use).
4. Utility Coordination Plan: Prior to issuance of building permits for the site, the applicant
shall submit a utili coordination plan and schedule for approval by the City Engineer for
installation and/or abandonment of all utilities. The plan shall clearly show the location and
size. of all existing utilities and the associated main lines; indicate which utilities and
services are to rem in; which utilities and services are to be abandoned, and where new

accordance with the City of Campbell's Street Lighting Policies.
