Hamilton Avenue per the City's Streetscape Standards. The conditions outline the requirements for the installation of the Streetscape Standards. PUBLIC WORKS DEPARTMENT CONDITIONS OF APPROVAL 1. Proof of Ownershib: Prior to issuance of any grading, drainage, or building permits for the site, the applicant shall provide a current Preliminary Title Report, grant deed, or other satisfactory proof of ownership. 2. Right-of-Way for Public Street Purposes: Prior to issuance of any grading or building permits for the site, the applicant shall fully complete the process to cause additional right- of-way to be granted in fee for public street purposes along the E. Hamilton Avenue frontage to accommodate 17 feet from the existing face of curb to the property line, unless otherwise approved by the City Engineer. The applicant shall submit the necessary documents for approval by the City Engineer, process the submittal with City staffs comments and fully complete the right-of-way process. The applicant shall cause all documents to be prepared by a registered civil engineer/land surveyor, as necessary, for the City's review and recordation. 3. Storm Drain Area Fee: Prior to issuance of any grading or building permits for the site, the applicant shall pay the required Storm Drain Area fee, currently set at $2,650 per net acre, which is $3,021. 4. Utilities: All on-site utilities shall be installed underground per Section 21.18.140 of the Campbell_Municipal Code for any new or remodeled buildings or additions. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility companies. Water Meter(s) and Sewer Cleanout(s): Existing and proposed water meter(s) and sewer cleanout(s) shall be relocated or installed on private property behind the public right-of- way line. 6. Utility Coordination Plan: Prior to issuance of building permits for the site, the applicant shall submit a utility coordination plan and schedule for approval by the City Engineer for installation and/or abandonment of all utilities. The plan shall clearly show the location and size of all existing utilities and the associated main lines; indicate which utilities and services are to remain; which utilities and services are to be abandoned, and where new utilities and services will be installed. Joint trenches for new utilities shall be used whenever possible. 7. Pavement Restoration: Based on the utility coordination plan,the applicant shall prepare a pavement restoration plan for approval by the City Engineer prior to any utility installation or abandonment. Streets that have been reconstructed or overlaid within the previous five years will require boring and jacking for all new utility installations. E. Hamilton Avenue has not been reconstructed or overlaid in the last 5 years. The pavement restoration plan shall indicate how the street pavement shall be restored following the installation or abandonment of all utilities necessary for the project. 8. Street Improvements: Prior to issuance of any grading or building permits for the site, the applicant shall execute a street improvement agreement, cause plans for public street improvements to be prepared by a registered civil engineer, pay various fees and deposits, post security and provide insurance necessary to obtain an encroachment permit for construction of the standard public street improvements, as required by the City Engineer. The plans shall include the following,unless otherwise approved by the City Engineer: a. Show location of all existing utilities within the new and existing public right of way. b. Relocation of all existing utilities including utility boxes, covers, poles, etc. outside of sidewalk area. No utility poles, boxes, covers, etc. will be allowed in the sidewalk area. c. Installation of street improvements along the project's E. Hamilton Avenue frontage consistent with the City's Streetscape Standards, including a 10 foot landscaped park strip and a 7 foot sidewalk. d. Removal of existing sidewalk and monument sign. e. Removal of existing street light. f. Installation of City approved street trees, landscaping and irrigation in park strip. g. Installation of City standard sidewalk. h. Installation of asphalt concrete overlay per street pavement restoration plan for utility installation and/or abandonment, as required by the City Engineer. i. Installation of City standard streetlight, conduits, conductors and related facilities in accordance with the City of Campbell's Street Lighting Policies. j. Installation of traffic control, stripes and signs. k. Submit final plans in a digital format acceptable to the City 9. Deferred Street Improvement Agreement: Prior to issuance of any grading or building permits for the site, the owner shall execute a deferred street improvement agreement for construction of the remainder of the street improvements consistent with the City's Streetscape Standards. Unless otherwise approved by the City Engineer these improvements shall include, but are not limited to: removal of existing driveway, related sidewalk, curb and gutter and installation of an ADA compliant shared driveway, sidewalk, curb and gutter, necessary drainage facilities and necessary conforms- to existing improvements. 10. Maintenance of Landscaping: Owner(s), current and future, are required to maintain the landscaped park strip and tree wells in the public right of way. This includes, but is not limited to: trees, lawn, plantings, irrigation, etc. Trees shall not be pruned in a manner that would not allow the tree to grow to a mature height. 11. Utility Encroachment Permit: Separate permits for the installation of utilities to serve the development will be required (including water, sewer, gas, electric, etc.). Applicant shall apply for and pay all necessary fees for utility permits for sanitary sewer, gas, water, electric and all other utility work. 12. Additional Street Improvements: Should it be discovered after the approval process that new utility main lines, extra utility work or other work is required to service the development, and should those facilities or other work affect any public improvements, the City may add conditions to the development/project/permit, at the discretion of the City Engineer, to restore pavement or other public improvements to the satisfaction of the City. 13. Stormwater Pollution Prevention Measures: Prior to issuance of any grading or building permits, the applicant shall comply with the National Pollution Discharge Elimination System (NPDES)permit requirements, Santa Clara Valley Water District requirements, and the Campbell Municipal Code regarding stormwater pollution prevention. The primary objectives are to improve the quality and reduce the quantity of stormwater runoff to the bay. Resources to achieve these objectives include Stormwater Best Management Practices Handbook for New Development and Redevelopment ("CA BMP Handbook") by the California Stormwater Quality Association (CASQA), 2003; Start at the Source: A Design Guidance Manual for Stormwater Quality Protection ("Start at the Source") by the Bay Area Stormwater Management Agencies Association (BASMAA), 1999; and Using Site Design Techniques to Meet Development Standards for Stormwater Quality: A Companion Document to Start at the Source ("Using Site Design Techniques") by BASMAA, 2003. 14. It is our understanding that both the planning department and public works department staff are required to not support our reduced proposed improvements due to the established implementation requirements for the General Plan. We are seeking your review and approval of our most reasonable and sensible proposal not to implement at this time a temporary solution for the current pedestrian path of travel along our property line which would cause undue hardship and unsafe path of travel to the pedestrians traversing in front of this property for many years to come. We hope that it is in your power to enable approval of our Project as presented with our proposed suggested improvements which intend to partially, meet the General Plan vision for the Hamilton Avenue corridor.We would like to commence with our Project to make the much needed improvements to the Central Animal Hospital 1952 Building which has been in dire need of renovation for quite a long time.We appreciate your understanding. We have provided you with the survey of the property which depicts the existing conditions, as well as our proposed site improvement plan.We hope our proposed plan will suffice at this time in providing sufficient improvements towards meeting the General Plans' goals. We have found undue hardships in meeting all requirements due to existing conditions as will be mentioned below. We are proposing for the existing sidewalk to remain for the time being in that it ties to the existing bridge sidewalk to the east and currently provides a safe pedestrian continuous path of travel. To the west the sidewalk crosses a driveway approach shared with the adjacent property whose sidewalk is also along the curb and whose building structure is built at property line. If we were to place the sidewalk 10 feet back from curb it would send the pedestrian path of travel into the parking entrance of the adjacent property. This will cause the pedestrian to have to traverse back to the curb. Our temporary solution, until neighboring properties are brought up to City requirements -the bridge to the east and the open parking approach to the west as well as creating offset sidewalk, work with the ADA Design Guidelines to provide as save a path of travel as possible for the disabled. We feel in this case the General Plan requirements work against the ADA guidelines and will cause more unsafe situations than the mere aesthetic improvements it intends. We believe this will provide a temporary resolution until both adjacent properties to the west comply with the City's Master plan by reducing their footprint an appropriate amount to allow for the streetscape requirements. We do not expect the bridge to be made wider to accommodate the sidewalk configuration the general plan suggests in the near future,if ever. In addition,the existing sidewalk at curb side which supposes to be a landscape strip has two large electrical subsurface vaults, a light standard, a PG&E light pole and PG&E easements with overhead and underground power supply lines. Two trees planted on this strip of land would not comply with PG&E's canopy clearance requirements and would need to be evaluated and approved by PG&E prior to disturbing any subsurface area. The costs that may be incurred to meet the.General Plan site improvements may be greater than costs proposed for our cosmetic remodel - simply to solve the problems caused by the existing flat roof, exterior mechanical systems and to upgrade the building's current 1950's front elevation of the. The following section 11.24.190 appears to relate mainly to situations where the applicant is claiming that the Planning Commission required the improvements in error, rather than a situation where the applicant is simply trying to avoid the standard requirements. Any condition imposed by the Planning Commission is appealable to the City Council pursuant to Municipal Code Chapter 21.62. However, I do not think that the issue of exempting someone from streetscape standards required under Chapter 11.24 would be properly before the Council in the absence of a request for an exception. The issue concerning the General Plan is fairly complicated. If you are referring to the standards set forth in Appendix A2, most of them seem fairly definite and objective; and the project as a whole must be consistent with the General Plan. I do note that the Community Development Director has authority under the Appendix to approve minor alterations to accommodate unusual site or project related conditions. However, if the applicant is seeking a substantial deviation from the standards, then the City Council would need to find that some other over-riding policy of the General Plan justifies the exception to the street standards. Our temporary solution, until neighboring properties are brought up to City requirements -the bridge to the east and the open parking approach to the west as well as creating offset sidewalk, work with the ADA Design Guidelines to provide as save a path of travel as possible for the disabled. We feel in this , case the General Plan requirements work against the ADA guidelines and will cause more unsafe situations than the mere aesthetic improvements it intends. We believe this will provide a temporary resolution until both adjacent properties to the west comply with the City's Master plan by reducing their footprint an appropriate amount to allow for the streetscape requirements. We do not expect the bridge to be made wider to accommodate the sidewalk configuration the general plan suggests in the near future,if ever. In addition,the existing sidewalk at curb side which supposes to be a landscape strip has.two large electrical subsurface vaults, a light standard, a PG&E light pole and PG&E easements with overhead and underground power supply lines.Two trees planted on this strip of land would not comply with PG&E's canopy clearance requirements and would need to be evaluated and approved by PG&E prior to disturbing any subsurface area. The costs that may be incurred to meet the General Plan site improvements may be greater than costs proposed for our cosmetic remodel - simply to solve the problems caused by the existing flat roof, exterior mechanical systems and to upgrade the building's current 1950's front elevation of the .
