PC Res 4498RESOLUTION NO. 4498 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING THAT THE CITY COUNCIL ADOPT AN ORDINANCE TO AMEND THE CAMPBELL MUNICIPAL r CODE BY AMENDING SECTIONS 21.28.120 "RECREATIONAL VEHICLE PARKING" AND 21.72.020 "DEFINITIONS". FILE NO. PLN2018-361 After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. The Planning Commission finds as follows.with regard to file number PLN2018-361: 1. The project consists of a text amendment to adopt provisions to regulate camping and the storage of personal property which includes amendments to the Zoning Code. 2. The proposed text amendment would be consistent with the following General Plan goals, policies, and strategies: Goal LUT-5: Preservation and enhancement of the quality character and land use patterns that support the neighborhood concept. Policy LUT-5.2: Residential Neighborhoods: Maintain safe, attractive, pedestrian friendly residential neighborhoods with identifiable centers and consistent development patterns and a range of public and private services. Goal LUT-7: Attractive, well -maintained and safe streets, public improvements and utilities. 3. The legislature of the State of California has, in Government Code Sections 65302, 65560 and 65800, conferred upon local government units authority to adopt regulations designed to, promote the public health, safety and general welfare of its citizenry. 4. Review and adoption of this Zoning Code Amendment is done in compliance with California government Code Sections 65853 through 65857, which require a duly noticed public hearing of the Planning Commission whereby the Planning Commission shall provide its written recommendation to the City Council for its consideration. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed amendment is consistent with the goals, policies, and actions of the General Plan; 2. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or general welfare of the City; 3. The proposed amendment is internally consistent with other applicable" provisions of the Zoning Code; and 4. The proposed Text Amendment project is exempt from the California Environmental Quality Act under Section 15061.b.3 because it has no potential for resulting in a physical change to the environment. AN ORDINANCE OF THE CITY OF CAMPBELL AMENDING THE CAMPBELL MUNICIPAL CODE (PLN2018-361) BY AMENDING SECTIONS 21.28.120 "RECREATIONAL VEHICLE PARKING" AND 21.72.020 "DEFINITIONS". THE CITY COUNCIL OF THE CITY OF CAMPBELL DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 21.28.120 of the Campbell Municipal Code "Recreational Vehicle Parking" is hereby" amended rto read as follows with strike throughs (stFil a throughs) indicating deleted text, and underlying (underlining) indicating added text: 21.28.120 - Recreational vehicle parking. A. Requirements. Recreational vehicles may be parked in residential zoning districts only in compliance with the following requirements: 4 A. Recreational vehicles shall be parked on private property and shall not be parked on or over a public sidewalk or within the publiG Fight of way; B. Recreational vehicles shall not be parked within the public right-of-way when signage has been posted prohibiting such parking; 2 C. Recreational vehicles shall be parked on a paved surface; 3 D. Recreational vehicles shall not. impede safe entry to or exit from any residential structure and shall not inhibit emergency access to and from any structure; -4 E. Recreational vehicles shall not be used for camping purposes, except in compliance with the provisions of Chapter 6.40 of the Campbell Municipal Code unless othor.e,ic o appFGved by the building OffiGial. SECTION 2. Subsection R of Campbell Municipal Code Section 21.72.020 is hereby amended by adding the following definition between the definition for "radio station" and "recreation land:" "Recreational vehicle means the same as set forth in California Health and Safety Code section 18010, as that section exists and may be amended and decodified in the future. SECTION 3- If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, sentence, clause and phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. 1 City Council Ordinance No. Page 2 of 2 Adoption of a Zoning Code Amendment (PLN2018-361) SECTION 4. This ordinance shall become effective thirty (30) days following its passage, and shall be published one time within fifteen (15) days upon passage and adoption in the Campbell Express, a newspaper of general circulation in the City of Campbell, County of Santa Clara.
