A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
REJECTING BID PROPOSAL FROM GUERRA CONSTRUCITON GROUP, AWARDING A CONTRACT
TO WATTIS CONSTRUCTION, INC., AUTHORIZING THE PIUBLIC WORKS DIRECTOR TO
EXECUTE CONTRACT, AND APPROVING A BUDGET ADJUSTMENT FOR THE CONSTRUCTION
OF THE HARRIET AVENUE TRAFFIC CALMING PROJECT 18-NN
WHEREAS, the Campbell City Council adopted Resolution 12370 approving the plans and
specifications, and other associated actions for Harriet Avenue Traffic Calming Project 18-NN on
October 16, 2018; and
WHEREAS, three bid proposals were received and publically read out loud by the City Clerk on May 14,
2019; and
WHEREAS, after careful review of the bid proposal submitted by Guerra Construction Group, a number
of deficiencies were identified; and
WHEREAS, a 3% construction contingency is not recommended as a 10% construction contingency is
industry standard; and
WHEREAS, a budget adjustment has been prepared for transferring $41,708 from the FY19/20 Capital
Improvement -Program Reserve (CIPR) into this project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell hereby rejects the
bid proposal from Guerra Construction Group; and awards a contract to Wattis Construction, Inc.; and
BE IT RESOLVED that the City Council of the City of Campbell hereby authorizes the Public Works
Director to execute a construction contract in the amount of $601,915.90 and encumber a construction
contingency in an amount not to exceed $60,192; authorizes the City Engineer to negotiate and execute
contract change orders up to and within the allocated construction contingency; and
BE IT RESOLVED that the City Council of the City of Campbell hereby authorizes the Finance Director
to execute a budget adjustment for the Harriet Avenue Traffic Calming Project 18-NN; and
