CC Resolution 12505RESOLUTION NO. 12505 A RESOLUTION OF THE CITY COUNCIL, DIRECTING STAFF TO RETURN WITH THE NECESSARY ORDINANCE AND FEE SCHEDULE UPDATES TO ADJUST THE PARK DEDICATION IN -LIEU AND IMPACT FEES REQUIRED BY SECTIONS 20.24 AND 13.08 OF THE CITY OF CAMPBELL MUNICIPAL CODE. WHEREAS, the City desires to promote and maintain a vibrant and healthy system of City parks, by ensuring that new development contributes either new parkland or in -lieu fees proportional to the demand created by said new development; and WHEREAS, the City desires the parkland dedication and in -lieu fee payment requirements be based on land valuations between $2 million and $4 million; and WHEREAS, the City desires to revise the Parkland Dedication requirement in Section 13.08 from four (4) acres per 1,000 residents to the same three (3) acres per 1,000 residents required by Section 20.24 within the"Campbell Municipal Code; and - WHEREAS, the City desires to implement the updated in -lieu and impact fees effective December 24, 2019 for all new projects, allowing projects previously approved or on -file with the Planning Division prior to December 24, 2019 to pay the rates in effect prior to this adjustment; and WHEREAS, the City desires to defer changing the number of residents per unit type until the 2020 Census is complete and the new data is available; and WHEREAS, the City desires to defer discussion of an additional Park Development Impact Fee to a future date. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell hereby -directs staff to return with the necessary ordinance and fee schedule updates to: 1) Implement new Parkland Dedication In -Lieu (Section 20.24) and. Park Impact Fees (Section 13.08) consistent with a land valuation between $2 million and $4 million per acre; 2) Revise the Parkland Dedication requirement in Section 13.08 from four (4) acres per 1,000 residents to the same three (3) acres per 1,000 residents required by Section 20.24; 3) Implement these new fees effective December 24, 2019, allowing projects already approved or on -file with the Planning Division prior to December 24, 2019 to pay the rates in effect prior to this adjustment; 4) Defer changing the number of residents per unit until the 2020 Census data is available; and 5) Defer discussion of an additional Park Development Impact Fee to a future date.
