CC Resolution 12511 RESOLUTION NO. 12511 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AUTHORIZING THE ISSUANCE OF A CARNIVAL PERMIT TO THE ST. THOMAS OF CANTERBURY FAMILY FUN FEST LOCATED AT 1522 MCCOY AVENUE, OCTOBER 27, 2019. WHEREAS, after due consideration of all the evidence presented the City Council did find as follows: 1. The dates and hours of operation for the carnival shall be as follows: Sunday, October 27, 2019 11:30 a.m. — 3:30 p.m. 2. The existing church, St Thomas of Canterbury, is located at 1522 McCoy Avenue; 3. The applicant is over 18 years of age; 4. As of the present date, there is no substantial evidence that the applicant has knowingly made any false, misleading or fraudulent statement of material fact in the application; 5. As of the present date, there is no substantial evidence that the proposed use as conditioned would constitute a violation of the Municipal Code, or other applicable law; 6. As of the present date, there is no substantial evidence that the proposed event as conditioned would result in a public nuisance as defined in the • Municipal Code, or Section 370 of the California Penal Code; and WHEREAS, the City Council approves the application of St. Thomas of Canterbury Church for a Carnival permit. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby grant a Carnival permit to St. Thomas of Canterbury Church, subject to the following conditions: 1. Games: Parish volunteers will operate the games. 2. Food: All food booths and the Chili Cook-Off will only operate after receiving approval by the Santa Clara County Environmental Health Department. 3. Promotions: (a) The weekly church bulletin will be used to advertise the event. (b) There will be a banner posted at the church. 4. Parking: Parking will be available at St. Thomas of Canterbury parking lot. Normal paths to and from the entrances and exits will be available and festival volunteers will monitor these paths to ensure that emergency and fire vehicles will have constant access to the premises. 5. Security: There is no outside security planned for this event. Volunteers will be responsible for the security of the event.
