A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
ADOPTING THE INITIAL STUDY AND MITIGATED NEGATIVE DECLARATION AND
APPROVING THE PRELIMINARY DESIGN FOR SAN TOMAS AQUINO CREEK TRAIL
PROJECT NO. 15-NN
WHEREAS, on August 21, 2018, the City Council approved the project to move forward
with only Reaches 1 and 2 (Project) and to complete preliminary design and environmental
clearance, and to identify the City boundaries along the trail alignment; and
WHEREAS, the Initial Study/Mitigated Negative Declaration prepared for the Project
concluded that the implementation of the Project could result in significant effects on the
environment, and mitigation measures identified in the Mitigation Monitoring and Reporting
Program were incorporated into the Project or are required as a condition of project
approval; and
WHEREAS, in May 2020, residents within a 500-foot radius of the Project were notified of
the upcoming publishing and public comment period via the Notice of Intent. The
announcement was also posted on the City website. Additionally, the document was
distributed to all public agency stakeholders; and
WHEREAS, all comments were received during the public review and comment period
have been compiled and the Responses to Public Comments were generated; and
WHEREAS, the preliminary design provided insights and highlighted areas of potential
challenges and cost implications for the Project including utility relocation, property
acquisitions, impacts to school grounds during construction, jurisdiction boundary, and that
these items will need to be addressed during the final design phase; and
WHEREAS, the TDA Grant reimbursement is contingent on completion of the preliminary
design and adoption of the environmental documents; and
WHEREAS, should the project advance to the next phase, additional funding would be
required to complete final design and construction; and
WHEREAS, with the completion of preliminary design and obtaining environmental
clearance, the Project is in a better state of readiness for future grant opportunities; and
WHEREAS, the anticipated project cost based on the preliminary design will increase from
$4.09 to $4.96 million; and
WHEREAS, adding on the costs for land acquisition, easements, permitting, and project
management, the cost estimate for final design and construction will well exceed $5 million;
and
WHEREAS, an unspent fund balance of approximately $151,000 is projected.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby adopt the Initial Study and Mitigated Negative Declaration, and approve the
preliminary design for the San Tomas Aquino Creek Trail Project No. 15-NN
