A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
APPROVING THE TRACT MAP FOR TRACT NO. 10559 AND ACCEPTING THE
PUBLIC STREET AND PUBLIC SERVICE EASEMENTS OFFERED FOR
DEDICATION, AND ABANDONING A REDUNDANT STREET EASEMENT ALONG
EAST MOZART AVENUE FOR THE PROPERTY LOCATED AT
16179 EAST MOZART AVENUE
WHEREAS, On November 17, 2020, the City Council adopted Resolution No. 12654
approving a Vesting Tentative Subdivision Map (PLN2019-148) for the property located
at 16179 East Mozart Avenue;
WHEREAS, a prior public street easement dedication (8951 O.R. 703) along a portion
of the East Mozart Avenue frontage is made redundant by the fee simple street
dedication shown on the Tract Map; and
WHEREAS, the new fee simple street dedication completely encompasses the area of
the prior street easement, thereby preserving all rights and protections for any public
utilities /facilities within this area; and
WHEREAS, public street dedication and public service easements are necessary to
accommodate the approved use of the property and have been offered for dedication on
the Tract Map; and
WHEREAS, the Tract Map has been prepared, reviewed by staff, and found to be in
compliance with the Tentative Map, the Subdivision Map Act and Title 20 of the
Campbell Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell
that Tract Map 10559 is hereby approved and the Public Street and Public Service
Easements offered for dedication as shown on said map are hereby accepted in
conformity with the terms for which they are offered, and that the redundant street
easement as detailed on said map is hereby Abandoned.
