CC Resolution 12683 RESOLUTION NO. 12683 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING THE PLANS AND SPECIFICATIONS; AUTHORIZING THE PUBLIC WORKS DIRECTOR TO ADVERTISE FOR BIDS AND AWARD THE PROJECT; AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONSTRUCTION CONTRACT WITH THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER IN AN AMOUNT NOT TO EXCEED $2,470,000 AND ENCUMBER A 10% CONSTRUCTION CONTINGENCY WITH A TOTAL CONSTRUCTION CONTRACT AMOUNT OF $2,717,000; AUTHORIZING THE CITY ENGINEER TO NEGOTIATE AND EXECUTE CONTRACT CHANGE ORDERS UP TO AND WITHIN THE ALLOCATED CONSTRUCTION CONTINGENCY; AUTHORIZING THE PUBLIC WORKS DIRECTOR TO REJECT BIDS AND REBID THE PROJECT, SHOULD BIDS RECEIVED HAVE UNAMENABLE IRREGULARITIES; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND ENTER INTO A COST SHARE AGREEMENT WITH THE CITY OF SAN JOSE IN THE AMOUNT OF $178,000; AND AUTHORIZING THE FINANCE DIRECTOR TO PERFORM ASSOCIATED BUDGET ADJUSTMENTS. WHEREAS, on April 7, 2020, Council adopted Resolution #12574 authorizing the use of FY 20/21 Road Maintenance and Rehabilitation Account (RMRA or SB-1) Funds for a candidate list of streets in the FY 20/21 Annual Street Maintenance - Collector & Residential Street Resurfacing Project (Project 21-BB), and WHEREAS, the final engineer's cost estimate for the construction contract is $2,717,000 including a 10% contingency; and WHEREAS, City of San Jose is planning to resurface two streets that shares jurisdiction with the City of Campbell and has offered to include these streets in its construction contract and the two cities would enter into a cost share agreement whereby Campbell will compensate San Jose the estimated amount of$178,000; and WHEREAS, staff recommends combining the pedestrian improvement work at the intersection of Second Street and Orchard City Drive with Project 21-BB; and WHEREAS, sufficient funding sources have been identified for Project 21-BB; and WHEREAS, the plans and specifications for Project 21-BB have been completed. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell hereby approves the plans and specifications; authorizing the Public Works Director to advertise for bids and award the project; authorizes the City Manager to enter into a construction contract with the lowest responsive and responsible bidder in an amount not to exceed $2,470,000 and encumber a 10% construction contingency with a total construction contract amount of $2,717,000; authorizes the City Engineer to negotiate and execute contract change orders up to and within the allocated construction contingency; authorizes the Public Works Director to reject bids and rebid the project, should bids received have unamenable irregularities; BE IT FURTHER RESOLVED, that the City Council of the City of Campbell hereby authorizes the City Manager to negotiate and enter into a cost share agreement with the City of San Jose in the amount of $178,000; and, authorizes the Finance Director to perform associated budget adjustments.
