EV FANTI, husband and wife, hereinafter referred to as
Jlownerslt and the CITY OF CAMPBELL, a municipal corporation of
the State of California, hereinafter referred to as JlCityJl;
AGREEMENT
WITNESSETH:
WHEREAS, Owners are securing ItSIt Approval from City in
order to construct a parking lot to be located at 250 East
campbell Avenue; and,
WHEREAS, certain conditions of approval were stipulated
by the Planning Commision at their meeting on January 3, 1966.
IT IS HEREBY MUTUALLY AGREED by and between the parties
hereto as follows to wit:
(1) Owners agree to enter into and to participate in
any Local Improvement District which may be formed for the
express purpose of constructing public Lffiprovements in the
area concerned; including storm and sanitary sewers, street
and sidewalk improvements, utility installations, and/or any
installation which may be prescribed by such proceedings
within the public right of way.
(2) Owners further agree that they will execute a petition
for the formation of a Local Improvement District as described
in (1) above, said petition to be signed at the time of
execution of this agreement.
(3) Owners further agree to enter into and participate
in an Off-Street Parking District which may be formed for the
purpose of acquiring, constructing, maintaining, and operating
parking lots, garages, and other improvements for the parking
of motor vehicles in the area concerned.
(4) Owners further agree that they will execute a
petition for the formation of an Off-Street Parking District
as described in (3) above, said petition to be signed at the
time of execution of this agreement.
(5) Owners agree to post a bond in the amount of Four
Hundred Dollars ($400.00) to insure the performance of
conditions as described in (1) above.

(6) Owners agree to pay to City One Hundred Seventy
Dollars ($170.00) pursuant to Resolution No. 921 of the
City of Campbell for storm drainage fees.
(7) It is further agreed that Owners shall indemnify
and save harmless the City of Campbell, the City Council,
and the City Engineer and other officers or employees of the
City of Campbell fram any suits, claims, or actions brought
by any persons for or on account of any injuries or damages
to persons or property sustained or arising in the construction
of the on-site work do to any acts, omissions or negligence
of Owners, his officers, agents, employees, or contractors.
(8) It is further agreed that the above-named terms and
conditions shall bind the heirs, successors, administrators,
or assigns of the Owners.

hereunto affixed by its Mayor and City Clerk thereunto duly

WHEREAS, there has been submitted to the City Council
by Anthony Raffanti an agreement for the development of
his real property in accordance with prescribed conditions; and
WHEREAS, by the terms of said agreement, and
concurrently herewith he has submitted grant deeds of certain
portions of his property for street purposes;
