THIS AGREEMENT made and entered into this 14th day of
AU2"ust , 19 67 ,by and between ROBERT and GERALDINEi
RAFFANTI, ~ husband and wife, hereinafter
referred to as "Owners", and the CITY OF CAMPBELL, a municipal
corporation, situate in the County of Santa Clara, state of California,
hereinafter referred to as "City";
WITNESSETH:
'WHEREAS, OWners did heretofore on June 12, 1967, apply to
Planning Commission of City for a permit to remodel an existing
structure situate upon those certain parcels of land described
upon that certain instrument recorded September 18, 1963, and filed
in Book 6195 of Official Records, at page 325, in the office of the
County Recorder of said County of Santa Clara, and upon that certain
instrument recorded March l~, 1958, and filed in Book 4033 of
Official Records at page 329, in said office of said County Recorder,
and to provide parking upon said lands, which permit was granted
on July 3, 1967, subject to certain conditions; and
NOW, THEREFOR, IT IS MUTUALLY AGREED TO by and between the
parties hereto as follows:
1. "OWners" shall construct and/or install street improvements
consisting of, but not limited to, Portland Cement concrete curbs and
gutters, sidewalk, driveway approaches, asphaltic concrete pavement
with underlying crushed rock base, street lighting facilities with
underground electrical conduit, sanitary sewers, water, storm water,
gas, electrical, and telephone conduits, of any type or size and
any and all appurtenances to the above, all in accordance with the
lines, grades, standard details, standard specifications of "City"
and to the satisfaction of the City Engineer of "City" and the
respective public utility company which improvements shall be
constructed and/or installed upon the public right of way throughout
said parcells entire frontage on Campbell Avenue and which construction
and/or installation shall be initiated and faithfully prosecuted
to its completion when "OWnersll are so called upon to s:o construct
and/or install by "Ci~y".
2. OWners shall concurrent herewith file with City a faithful
performance born in the amount of TWO THOUSAND FIVE HUNDRED DOLLARS
($2,500.00) to insure the terms and con~i~ions of this aqreement.
The term of said bond shall be for a per10d of two year~.
3. OWners shall indemnify and save harmless the City of
Campbell, its City Council, its City Engineer, and any and all other
officers, employees or agents of City from any suits, claims, or actions
brought by any person or persons for or on account of any injuries
or damages to any person or property sustained during or arising out
of the construction of the on-site work due to any acts, omissions,
or negligences of Owners, their officers, employees, agents or
contractors.

Section 9319 of the Campbell Municipal Code.

S. Storm drainage area fee in the amount of $205.00.
The applicant is also notified that he shall comply with all other
applicable codes or ordinances of the City of Campbell which pertain
to this development and are not herein specified.
Section 9316.1 of the Campbell Municipal Code reads as follows:
Any approval granted under this section shall expire one hundred eighty
(180) days after the date upon which such approval was granted, unless
an extension for such approval is obtained by making written application
for same to the Planning Commission at least fifteen (15) days prior to
the expiration date of such approval.
No building permit shall be issued after the expiration date of any
approval until a new approval has been obtained in the manner provided
for in this chapter.
