Attached is a copy of a letter to this office from City Attorney Bonacina
relating to the above subject.
I am also attaching a copy of the use permit granted by the Planning
Commission which sets forth certain terms and conditions as a part of
the agreemen t.
Mr. Bonacina would like this information so that he could prepare a letter
of extension to the current agreement as authorized by the City Council on
May 25, 1970.

Dear ~tr. Stephens:
This acknowledJes your memorandum of May 26, 1970 with
reference to the above matter, toget~l.er \vith the a.sreement
enclosed.
If you will review the agreement, you will note that no
reference is made in the recital as to the period of time
that the applicants \-Jill be permitted to C1.llovl the use of
the property for administrative function by the Campbell
Union High School District. The time element is probably
set fortJ.1 in the Use Permit granted by the Planning Commission
of the City Council, and any renewal letter in compliance
with the direction of the City Council on May 25, 1970
should refer to the Use Permit as granted.
It seems to me to be important to determine \'Ihether or not
the terms and conditions of the agreement relative to (1)
dedication; (2) construction of improvements; (3) the
posting of a bond for performance of the improvements; (4)
removal of improvements; and (5) the postin6 of a faithful
performance bond are being adhered to.
The Public Horks Department should supply some information
as to whether or not contractual requirements have been met
before a letter of extension of the time is submitted to

the improving of the appearance of the building with appropriate
siding. I would require clearance of these matters and the
effective date of the previous Use Permit ~iven.

Subject: Property located at 275 E. Campbell Avenue, Campbell
As legal owners of the above subject property, we accept the
following conditions for the granting of an extension of time,
as agreed to at the City of Campbell Council meeting of
Ma r chi 3, I 967 :
1. All requirements of the Building Department, as stated in
the plan correction sheet for Permit #4604.
2. All conditions outlined in Use Permit 67-3 issued by the
Planning Department.
3. A certificate of insurance, holding the City free and harm-
less to third parties, shall be given to the City.
4. That at the end of three years, the building shall be
removed without any legal processes.
As legal owners, we accept these conditions attached to the
grant of time extension and do hereby agree to abide by the
same. We acknowledge for ourselves, our heirs, successors and
assigns that all lawful procedures have been followed in order-
ing the demolition of said building, and that upon our default
in carrying out the conditions imposed as herein noted, the City
may proceed to summarily remove and demolish said building at
our cost and expense, without the requirement of any court order
therefor.

Campbell nunicipal Code of the City of Campbell, California,
CAMPBELL UNION HIGH SCHOOL DISTRICT
is hereby granted a use permit to allow sundry administrative functions
of the Campbell Union High School District in the building known as
275 East Campbell Avenue, Campbell, California. subject to the condi-
tions as follows:

1. Dedication to Plan Line on Campbell Avenue (40' half-street)
and dedication to 30' half-street on North First Street
frontage.
2. Enter into agreement and post Faithful Performance BonG for
future street improvements on North Fi rst Street......
3. Payment of storm drainage fee in the amount of $170.00~
4. Compliance with all applicable sections of the Campbell
Municipal Code.
s. ^ definite time limit on the proposed use is determined to
be 3 years - at expiration of lease.
6. Parking to be approved by the Planning Director.
7. Plans for development of parking lot to be submitted for
architectural approval.
