BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL, RECOMMENDING APPROVAL OF PLANS,
ELEVATIONS, AND DEVELOPMENT SCHEDULE TO ALLOW
CONSTRUCTION OF PARKING LOT IMPROVEMENTS ON PROPERTY
KNOWN AS 275 E. CAMPBELL AVENUE (APPLICATION OF
HR. HILES S. TULLY, UP 78-13).
After notification and public hearing as specified by law on the
application of Hr. Hiles S. Tully for a use permit and approval of plans
to improve a parking lot located on property known as 275 E. Campbell
Avenue In a P-D (Planned Development/Commercial) Zoning District, as
per the application of Hr. Hiles S. Tully filed in the office of the
Planning Director on September 18, 1978, and after presentation by the
Planning Director, proponents and opponents, the hearing was closed.
After due consideration of a11 the evidence presented, the Commission
did find as follows:
That the establishment, maintenance, and operation
of the proposed use will not be detrimental to the
health, safety, peace, morals, comfort or general
welfare of the persons residing or working In the
neighborhood of such use, or be detrimental or
Injurious to property and Improvements In the
neIghborhood or the general welfare of the City.
Based on the above findings, the Planning Commission does hereby
grant the requested use permit subject to the following conditions:
Property to be fenced and landscaped as indicated and/or
added in red on plans.
Landscaping plan indicating type and sIze of plant
meterlal, and locatIon of sprinkler system to be
submitted for approval of the Planning Director prIor
to application for building permit.
Landscaping and fencIng shall be maintained In accordance
with the approved plan.
Applicant to either (I) post a faithful perfonmance bond
In the amount of $5,000 to Insure landscaping, fencing,
and striping of parking areas within three .onths of
completion of construction, or (2) file wrItten agreement
to complete landscaping, fencing or striping of parking
areas prior to final 8ulldlng Department clearance.
The applicant Is notified as part of this application that he Is
required to meet the following conditions In accordance with Ordinances
of the City of Campbell:

All parking and driveway areas to be developed In compliance
with Section 21.50 of the Campbell Hunlclpal Code. All
parking spaces to be provided with appropriate concrete
curbs or bumper guards.

RESOLUTION NO. 1740
Underground utilities to be provided as required by
Section 20,16.070 of the Campbell Municipal Code.
Ordinance No. 782 of the Campbell Municipal Code
stipulates that any contract for the collection and
disposal of refuse, garbage, wet garbage and rubbish
within the limits of the City of Campbell shall be
made with Green Valley Disposal Company. This
requirement applies to all single-family dwellings,
multiple apartment units, to all commercial, business,
Industrial, manufacturing, and constructIon
estab li shments.
(D) Trash container(s) of a size and quantity necessary to
serve the development shall be located in area(s)
approved by the Fire Department. Unless otherwise
noted, enclosure(s) shall consist of a concrete
floor su rrounded by a so I I d we II or fence and have
self-closIng doors of a size specified by the Fire
Department. All enclosures to be constructed at
grade 1 eve 1 .

The applicant is notified that he shall comply with all applicable
Codes or Ordinances of the City of Campbell which pertain to this
development and are not herein specified.
USE PERMIT SHALL NOT BECOME EFFECTIVE UNTIL RATIFIED BY
THE CITY COUNCIL.

The parking lot improvements required by you of Mr. Miles S. Tully have been
completed in accordance with the plans that you approved. The quality of work
on the paving is very poor. Mr. Tully is looking for some kind of release -
perhaps from you.

Gentlemen:
Subject plan as submitted is approved with one revision. That is the A.C.
overlay shall be two-inch (2") nominal thickness with three inches (3") at the
most easterly southeast corner of the lot. Please make these revisions on the
plan and have the contractor or owner obtain a permit from the Public Works
Department for the construction work. The permittee will need to submit three
(3) sets of plans with their permit request.
