276 E. Campbell Ave. (S67-36) RESOLUTION NO. 2379 BEING A RESOLUTION AUTHORIZING EXECUTION OF TRUSTEES FOR MORNING LIGHT LODGE #42, I . 0 . 0 . F. OF CAMPBELL, A FRATERNAL ORGAN- IZATION AGREEMENT. WHEREAS, there has been submitted to the City Council by the Trustees for Morning Light Lodge #42, I.O.O.F. of Campbell, a fraternal organization,. an agreement for the development of their real property in accordance with prescribed conditions; and, WHEREAS, by the terms of said agreement, and concurrently here- with they have submitted grant deeds of certain portions of their property for street purposes; NOW, THEREFORE, BE IT RESOLVED by the City Council that the Mayor be and he is hereby authorized to execute the said agreement on behalf of said City; and, BE IT FURTHER RESOLVED that the grant deed submitted in connection therewith be and the same is hereby accepted. San Jose, California Re: City of Campbell - Morning Light Lodge, IOOF Dear Sir: Attached hereto is copy of a proposed agreement between the City of Campbell and Morning Light Lodge #42, IOOF. The Lodge pro- pose. to erect a new building on its property on Campbell Avenue and the city has required execution of the attached agreement. The lodge has no object to doing any necessary work as called for in the agreement provided it can be made definite what the work i. that will be required and when it will have to be done. It is my understanding that this work would be in connection with propo.ed widening of Campbell Avenue. It is also my under- standing that the lodge has dedicated the required portion of their property for future widening and is making the required setback of ita building. However, by the attached agreement, the city is requiring the lodge to agree to do an unspecified amount of work to unspecified standards at some unspecified time in the future, and, in addition, is agreeing that the lodge will keep in force for an unspecified time a bond to assure the performance of the work. I presume that in fixing the bond at $5,000, the city is implying and representing that the work to be required will not cost more than $5,000. However, bonds require a premium and the lodge may be required to pay annual premiums on this bond for an indefinite time which may run into many years. It seems too bad that the persons who are willing to venture their money to improve the downtown portion of the city should be pena- lized in this fashion. If the lodge, as a property owner, should let the land lie vacant as a vacant lot in the heart of the down- - 2- J o.eph A.
