Building Sewer Location

Gentlemen
It has been brought to my attention that the building
sewer to the Assessor's Parcel Number 279-43-019,
situated at 471 East Campbell Avenue cannot be located
behind the new Campbell Avenue property line and the
existing sidewalk and concrete parkway. However, there
is a surface cleanout box for the building sewer located
approximately 8 feet out from the property line. Both
you and the District have explored for the building
sewer at a point on the property line directly opposite
the existing cleanout without finding the building sewer.
Our records and conversation with Dave Valkenaar, Public
Works Department, City of Campbell, indicates that the
building sewer did run behind the property line to an
unused service station building located on the parcel at
the time Campbell Avenue was widened and improved. The
City's contractor at that time brought the building sewer
cleanout to its present surface location. Mr. Valkenaar
also reports that no major utilities were constructed in
a location that would have crossed the building sewer
behind the surface clean out.
Therefore, it is reasonable to assume that the building
sewer still runs from the cleanout to the location of
the former service station building. I would suggest that
you excavate behind the property line to a depth of approxi-
mately 6 feet for a distance at least 10 feet on either
side of the point opposite the existing cleanout.

If you do not find the building sewer at a point behind
the property line it will be the responsibility of the
property owner to extend the building sewer from the
existing cleanout.
Since the District did not have any reason for assuming
that the building sewer was not extended into the property
at the time Campbell Avenue was widened and improved,
there appears to be no basis for the District standing
any part of the expense of extending the building sewer
if it is found to be short of the property line.
If you find it necessary to excavate within the improved
sidewalk and parkway area in order to extend the building
sewer from the existing cleanout it will be necessary for
you to obtain a encroachment permit from the City of
Campbell, Department of Public Works and Dave Valkenaar
should be able to assist you.
Please advise if the District can be of further assistance
in either locating the existing building sewer or its
extension to the property line.

BEING A RESOLUTION ACCEPTING STREET IMPROVEMENTS
ON FOOTE AVENUE NORTH OF CAMPBELL AVENUE
WHEREAS, the City Council has been advised by the City
Engineer that all improvements on Foote Avenue north of
Campbell Avenue have been completed in accordance with that
agreement entered into on October 9, 1978, concerning said
area; and,
WHEREAS, the City Engineer recommends acceptance of all
improvements on Foote Avenue north of Campbell Avenue;
NOW, THEREFORE, BE IT RESOLVED by the City Council that
all street improvements thereon, be and the same are hereby
accepted and that the City Engineer is hereby ordered to
record a Notice of Completion of said improvements.

Any plans or surface markings furnished by Pacific Gas
and Electric Co~pany to show the location of its underground
facilities in any specified public street, highway, Company
right-of-way, or on private property furnished at the request
of any public agency, contractors or other person engaged.
in work upon such public street, highway, Company right-of-way~
or private property can only be furnished upon the understanding
that such is done solely as an acco~odation to such agency,
contractor, or individual and without any representation to
guarantee that the same is complete or accurate. The Company
will, of course~ exercise due care to make this information as.
complete and accurate as reasonably possible; but, because of
the very nature of ùnderground installations, such marking is
only a suggestion as to possible locations, and the person
responsible for excavating or other activities near our under-
ground installations shall take such precaution as necessary
to protect the Company's property, irrespective of the information
furnished.
We call your attention to:
Section l540(a) (1) of the Construction Safety.Orders (Title 8
California Administration Code Section 1540), issued by the
Occupational Safety and Health Standards Board pursuant tq the
California Occupational Safety and Health Act of 1973. whic!l
states:
(1) "Prior to opening an excavation, effort shall
be madè to determine ~hether underground installations;
i.e., sewer, water, fuel, electric lines, etc., will be
encou~tered and, if so, where such underground installa-
tions are located. ~TIen the excavation approaches the
approxim~te location or such an installation. the exact
location shall be determined by careful probing or hand
digging; and, when it is uncovered, adequate protection
shalJ be provided for the existing installation. All
knowL owners of underground fad J.ities iT! the area
~oncerned shall be advised or proposed ~ork.a~ least
48 hours prior to the start of actual excavation."

BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CAMPBELL ADOPTING PLANS, ELEVATIONS, AND DEVELOPMENT
SCHEDULE FOR A PORTION OF THE PLANNED DEVELOPMENT ZONE
ESTABLISHED BY ORDINANCE NO. 983, ADOPTED ON THE
9TH DAY OF JUNE, 1975. (Application of Donald F. Imwalle).

The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That the Zoning Map of the City of Campbell is hereby
changed and amended by adopting the attached "Exhibit A" entitled "Plans
and Elevations," "Exhibit B" entitled "Development Schedule" and "Exhibit C"
entitled "Map of said Property," as per application of Mr. Donald F. Imv/alle
to allow construction of a retail commercial building on property known
as 471 East Campbell Avenue in a P-D (Planned Development/Commercial and
Commercial and/or Industrial) Zoning District. Copies of said exhibits
are on file in the office of the Planning Department.
Said approval granted subject to the following conditions:
A. Property to be fenced and landscaped as indicated and as added
in "redll on plans.
B. landscape plan indicating type of plant material, location of
hose bibs, or sprinkler system and type of fencing to be submitted for
approval of the Planning Director at time of application for building
permit .
C. Landscaping shall be maintained in accordance with the approved
l~ndscape plan. '
D. Faithful performance bond in the amount of $5,000 to be posted
to insure landscaping, fencing and striping of parking area within three
(?\ months of completion of construction, or applicant may file written
eqreement to complete landscaping, fencing and striping of parking area
prior to final Building Department clearance.
E. All mechanical equipment located on roofs shall be screened as
approved by the Planning Director.
F. All parking and driveway areas to be developed in compliance
with Section 21.50 of the Campbell Municipal Code. All parking spaces
to be provided with appropriate concrete curbs or bumper guards.
G. Underground utilities to be provided as required by Section
20.16.070 of the Campbell Municipal Code.
H. Plans submitted to the Building Department for plan check shall
indicate clearly the location of all connections for underground utilities,
including water, sewer, electric, telephone and television cables, etc.

I. Sign application to be submitted in accordance with provisions
of the sign ordinance for all signs. No sign to be installed until
application is approved and permit issued by the Building Department.

J. Ordinance No. 782 of the Campbell Municipal Code stipulates that
any contract for the collection and disposal of refuse, garbage, wet garbage,
and rubbish produced within the limits of the City of Campbell shall be
made with Green Valley Disposal Company. This requirement applies to all
single family dwellings, multiple apartment units, to all commercial,
business, industrial, manufacturing, and construction establishments.
K. Trash container(s) of a size and quantity necessary to serve
the development shall be located in area(s) approved by the Fire Department.
Unless otherwise noted, enclosure(s) shall consist of a concrete floor
surrounded by a solid wall or fence and have self-closing doors of a size
specified by the Fire Department. All enclosures to be constructed at
grade level. '
