PERMITTEE MUST MAINTAIN A COpy OF THIS PERMIT AND APPROVED PLANS ON JOB SITE FOR DURATION
OF CONSTRUCTION PERIOD.
All work shall be constructed in accordance with approved plans and to the satisfaction of the District's Inspec-
tor. The work area must restored to the satisfaction of the District's Inspector.
The quality of water passing through or below the site shall be maintained at all times and the addition of silt or other
deleterious material to the water will not be permitted.
All backfill within District right of way shall be compacted to at least 90% relative compaction in accordance with
California Test Method 216.
Obstructions to the existing waterway between October 15 and April 15 will not be allowed except by special permit to
be applied for at least 15 days in advance and requiring District approval of detailed plans and provisions for emer-
gency flows.

l~is District will not be liable or responsible for any disruption to motel
operations resulting from maintenance operations on the Central Pipeline or
Los Gatos Creek.
7.
The property owners or their successors shall not be entitled to compensation
for the replacement costs of any improvements within District rights of way
which are removed by the District during periods of pipeline construction,
maintenance operations, removal or replacement by the District of the water
transmission pipeline and appurtenant structures. Notwithstanding any other
provision hereof, all activities carried on by District hereunder shall be
conducted in accordance wit!] Qood engineering and construction practice and
with due regard for property owner's interests.
8.
The District will accept no liability concerned with public use of the bike
path or motel facilities.
9.
Additional improvements within District rights of way shall not be installed
without a permit from the District.
10.
A removable fence at least 42 inches high should be installed between the
bike path and creek.

RESERVING UNTO GRANTOR the ~ight to install. use and maintain su~f'ace

said easement. subject to District approval (which shall not be unreasonably
withheld) and issuance of Permit.
Said easement shall be kept clear of any type of building, fences,
structure. pavement or trees. other than as specified herein. unless prior
written approval is obtained from District.

The easement shall include the right to construct. reconstruct. inspect.
maintain and repair a channel. protectioü works and appurtenant structures,
together with the right to trim or remove such tr~es or brush within the
easement area as may constitute a hazard to person~ or property or may in-

It also shall include the right to enter upon said land with vehicles.
tools. implement9. and other materials for the construction. maintenance and
repa~r of said channel, protection works and appurtenant structures by said
District. its officers. agents. and employees. and by persons under contract

or storm drainage purposes.

expense. claim or liability by reason of injury (including death) to persons
or damage to property. arising out of Grantor's use of said land.

District by its acceptance of this easement. with said reservation. does
not accept and shall not be deemed to accept responsibility in any degree for
the ~aintenance in a condition not dangerous or defective of landscaping.
paving. tennis courts. walkways or other surfacing. lighting or similar
amenities installed by Grantor. itG successo~s and assigns; no~. for the
repair of damages to any such installations by erosion and bank failure) or by
lawful District operations upon or adjacent to or affecting the parcels which
contain the said installations.
Loss of value. if any. at ~ime of creek improvement construction due to
damage of paving. landscaping and structures placed by Grantor within the
afore-described parcel will be borne by Grantor.
Notwithstanding any other ~rovision hereof. all activities carried on by
District hereunder shall be conducted in accordance with good engineering and
~onstruction practice and with due regard for Grantor's interests.

EASEMENT
Deed made August /~, 1983 by FRED N. SAHADI, of 1901 South
Bascom Avenue, Campbell, California, Grantor, to the CITY OF CAMP-
BELL, State of California, Grantee.
Gran tor gran ts to Gran tee,
its successors and assigns, an
easement ("Easement") for purposes of bicycle and pedestrian access
by the public, on and through the land of Grantor, said land being
situated in the City of Campbell and described on Exhibit A (the
"Property") .
Said Easement is situated as more particularly des-
cribed on Exhibit B and includes the right of Grantee to construct
and maintain a pathway thereon and the right of Grantee of ingress
,and egress over and across the Property insofar as such access is
necessary to construct and maintain the Easement. Grantee shall have
the further right to install and maintain a fence running the length
of the Easement on the Los Gatos Creek side of the Easement.
Said
Easement is subject to the following covenants of Grantee:
1.
Construction of the pathway once commenced shall be car-
ried out wi th due diligence and wi thout interference or delay, except
for causes beyond the control of Grantee.
2.
During construction of the pathway, there shall be no
interference with construction of the motel to be located on the
Property or,
if the motel
is in operation,
there shall be no
unreasonable interference or disruption of the use and operation of
the motel.

3.
During construction of the pathway, there shall be no
equipment storage or stock piling of materials upon the Property that
would interfere with the use or operation of the motel, and said
storage shall be limited to locations agreed to by Grantor which
agreement shall not be unreasonably wi thheld.
During pathway
construction, access and egress to and from the
Easement shall be
restricted to the routes agreed to by Grantor and Grantee.
Con-
struction equipment shall be restricted to a size and weight that
will not damage the Property. Grantor agrees that agreement will not
be unreasonably wi thheld for Grantee to enter upon the Property wi th
a suff icient quanti ty of personnel, materials and equipment to
accomplish construction of a bicycle and pedestrian pathway in a
timely manner within the Easement area.
4.
The location of the fence is restricted to the Los Gatos
Creek side of the Easement.
Its type and design shall be subject to
review by Grantor, and shall provide Grantor, its successors and
assigns with access to that portion of the Property belonging to
Grantor on the Los Gatos creek side of the Easement.
5.
Grantor shall retain the right to use of the Easement for
purposes of pedestrian and non-vehicular access to, from and within
the Property, and for vehicular access only as necessary for turning
movements in the motel parking lot.
Until such time as Grantee
constructs the pathway, Grantor shall have the right of improving and
landscaping it, provided that Grantor agrees to remove any such
landscaping or any other improvement at Grantor's expense, upon 60
days notice by Grantee.
6.
Grantee shall repair at no cost to Grantor any damage to
Grantor's Property arising out of the installation, use, maintenance
and/or operation of the Easement.

Grantee shall indemnify, defend and hold Grantor harmless
from and aga~nst any and all obligations, losses, costs, expenses,
claims, demands, attorney's fees and costs, investigation costs or
liabilities on account of or arising out of the installation, use,
maintenance and/or operation of the Easement.
Grantor makes no
express or implied warranty or representation that the Easement area
can be improved in the manner intended by Grantee, nor does Grantor
make any warranty or representation with respect to the accuracy or
reliability of any drawings or plans pertaining to the improvement
of the Easement that may have been provided to Grantee by Grantor or
Grantor's agents, and Grantee releases Grantor from any liability
therefrom.

RECOMMENDATION: That the City Council authorize the installation of modi-
fications to the campbell Avenue-Union Avenue intersection.
DISCUSSION: With the development of the Campbell Inn on East campbell
Avenue adjacent to Highway 17, it was necessary to construct a median
island on the Campbell Avenue frontage of the motel, which eliminated
left-turn ingress and egress from both the Campbell Inn site and Andy's
Restaurant.
It is the staff's feeling that it would be advantageous for overall traffiq
safety, efficiency, and the elimination of confusion if a modification!
be made to the Campbell Avenue-Union Avenue intersection. The modification
would allow eastbound traffic to make a u-turn on Campbell Avenue.
In order to provide this capability, it is necessary to relocate the
median island on the westerly side of the intersection, relocate the
traffic signal standard, and realign the face of curb along the
Prune Yard frontage of the intersection. These improvements have been
discussed with the developer of the Campbell Inn and he has agreed to
provide these improvements at his expense.
The staff will be prepared to review the details of this installation
at the Council meeting of May 7.

RECOMMENDATION: That the City Council take minute action to authorize
staff to negotiate a bid for construction of a bike path on the Campbell
Inn site.
DISCUSSION: The developer of the Campbell Inn site on Campbell Avenue ad-
jacent to Los Gatos Creek was required to dedicate an easement along the
westerly bank of the creek for the entire length of the site, in order that
a bicycle-pedestrian pathway could be constructed. Due to the imminent
finalization of construction activities related to the motel, it would be
highly desirable to construct the bikeway throughout the length of this
site at this time in order to avoid future conflict with users of the
motel during pathway construction. Also the paving contractor operating
on the site on behalf of the developer has offered to provide construc-
tion of the bicycle pathway at the time of the paving of the motel site
at a minimum cost to the City. It is the staff's feeling that this con-
tractor is in a position to offer substantial savings to the City for this
construction over that of any other outside contractor that would have to
move equipment in for this relatively small project.
It is the staff1s feeling that Section 3.20.030 of the Purchasing Pro-
ceduresCode allows for a negotiated bid with that contractor under these
circumstances because of the limitation of vendors that could effectively
perform the work.
It is requested, therefore, that the City Council authorize the staff to
negotiate with the onsite contractor for the construction of the bicycle
pathway for an amount not to exceed $10,000. The amount of $100,000 is
currently appropriated for bicycle pathway construction work on the Los
Gatos Creek project.

San Jose Water Company is in the process of preparing plans and an estimate of
cost for the installation of water facilities for the above-referenced project.
Our original proposal to provide fire protection to the site involved an 8"
main installation on Campbell Ave. from the intersection of Campbell Ave. and
Union Ave., west to the project.
At the present time, however, we are entertaining the idea of connecting the
existing water mains in Campbell Ave. via the crossing of the Los Gatos Creek.
It is our understanding that the bridge over the creek belongs to the City of
Campbell and, therefore, we would like to know if the City would allow a water
main to be attached to the structure. In addition, we would appreciate veri-
fication that the bridge is capable of supporting an 8" water main weighing
approximately 60 pounds per linear foot. Present thought would hang the main,
if feasible, from the sidewalk structure.

Thi s correspondence is in reference to the proposed ei ght inch heavy duty
water line to be installed on the Campbell Avenue bridge across the Los Gatos
Creek.
I discussed the problem with Mr. Bill Helms of the Campbell City offices and
Mr. Helms agreed that a check on the structural adequacy of the cantilever
sidewalk would suffice. In addition I have shown, in my calculations, the
small proportional increase of dead load created by the propose water line.
These girders were first constructed about 1917 for a railroad bridge,
reworked in 1940 for the present structure and have passed all inspections
since, therefore I feel the small increase in dead load would not be injurious
to their present capacity.

on the westerly side of Route 17 at Campbell Avenue, and
offer the following comments:

As related to Mr. Thomas ~2son, before we can issue
a permit for this work, the final environmental
document must be submitted for our review.

Presently, the highway drainage flows across the
parcel to Los Gatos Creek. Some provision must
be made to accommodate this drainage.

No portion of the structure, including roof over-
hang, shall be within State's right of way.
4.
Before we will permit any grading within the Stat~
right of way, your plans must include sections at
100' interval showing the existing ground and the
proposed grading.

Enclosed is a copy of the deed, with a plat, for the proposed conveyance of the
easement required along Los Gatos Creek from Lands of Sahadi in conjunction with
the motel complex.
Although the original deed with plat was received by Mr. Russ Matesso, who
represents the developer, in mid-February, 1979, and our staff has been in
contact with Mr. Matesso numerous times dùring the year, the promised delivery
of the executed deed has not materialized.
Please withhold your final clearance of this project until we advise you that
the easement requirements are met with our usual "clearance letter".

This afternoon I received a phone call from Gene Sullivan of the Water
District. He was interested in knowing if he would receive a response
from the letter sent to you under Bill Carlsen's signature. I told him
that you had referred this matter to our City Attorney for his advice
on how to proceed, and that some type of communication would very likely
be forthcoming in the not too distant future.

Dear Mr. Matesso:
This is in reference to your letter of November 9, 1978 regarding
development of the property between Los Gatos Creek, Highway 17
and northerly of Campbell Avenue.
The plan appears generally satisfactory except the trash container
should be moved back about nine feet and parking area southerly
of it should be moved back about five feet further from the top
of bank. (See attached marked plan.) This is so that all improve-
ments are set back at least at a 2 horizontal to 1 vertical slope
from the toe of bank. We normally require a 22-foot access road
back from where the 2:1 slope intersects the top of bank; however,
since this is going to be a parking area it could be jointly used
for parking and District access. The District could accept no
responsibility for maintenance of any landscaping or for any
damage in this area due to erosion or bank failure. The District
will need an easement over the creek and parking area over to the
existing pipeline right of way. Please contact Mr. Don Lawrie of
our Real Estate Division regarding this matter.
Use of District Central Pipeline right of way is satisfactory as
shown. The District, however, could accept no responsibility
for maintenance of the landscaping. The District could also
accept no responsibility for repair and replacement of any paving
or landscaping that would need to be removed in order to do any
repair work on the Central Pipeline.

BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL ADOPTING PLANS, ELEVATIONS, AND DEVELOPMENT
SCHEDULE FOR THE PLANNED DEVELOPMENT ZONE ESTABLISHED
BY ORDINANCE OF THE CITY OF CAMPBELL. (Application of
Marvin A. Bamburg, A.I.A.).
The City Council of the City of Cambpell does ordain as follows:
SECTION ONE: That the Zoning Map of the City of Campbell is hereby
changed and amended by adopting the attached IIExhibit All entitled IIPlans
and Elevationsll, IIExhibit BII entitled IIDevelopment Schedule", and IIExhibit CII
entitled IIMap of said Property'l as per the application of Marvin A. Bamburg,
A.I.A., for approval of plans, elevations, and development schedule to
allow construction of a 100-unit motel complex on property known as
675 East Campbell Avenue in a Planned Development Zoning District. Copies
of said exhibits are on file in the office of the Planning Department.
Said approval subject to the following conditions:
A.
Approval of amendment to Land Use Element.
B.
Approval of zone change to Planned Development.
C. The interior of the units must conform to minimum State standards
and an accompanying report must be furnished by a certified noise consultant
certifying that there will be acceptable standards of noise attentuation.
D. Property to be fenced and landscaped as indicated and as added in
'Ired" on plans.
E. Landscape plan indicating type of plant material, location of hose bi s
or sprinkler system and type of fencing to be submitted for approval of the
Planning Director at time of application for building permit.
F. Landscaping sahlI be maintained in accordance with the approved
landscape plan.
G. Faithful performance bond in the amount of $5,000 to be posted to
insure landscaping, fencing and striping of parking area within three (3) mont s
of completion of construction, or applicant may file written agreement to com-
plete landscaping, fencing and striping of parking area prior to final buildin
department clearance.
H. All mechanical equipment located on roofs shall be screened as
approved by the Planning Director.
I. Grading plans and fence details to be approved by the Santa Clara
Valley Water District.
J. All parking and driveway areas to be developed in compl iance with
Section 21.50 of the Campbell Municipal Code. All parking spaces to be
provided with appropriate concrete curbs or bumper guards.
K. Underground util it,es to be provided as required by ~ection 20.16.070
of the Campbell Municipal Code.
, L. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including water,
sewer, electric, telephone and television cables, etc.
M. Sign application to be submitted in accordance with provisions of the
sign ordinance for all signs. No sign to be installed until application is
approved and permit issued by the Bui Iding Department.
N. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage, and
rubbish produced within the limits of the City of Campbell shall be made with Green
Valley Disposal Company. This requirement applies to all single family dwellings,
multiple apartments units, to all commercial, business, industrial, manufacturing,
and construction establishments.
O. Trash container(s) of a size and quantity necessary to serve the development
shall be located in area(s) approved by the Fire Department. Unless otherwise noted,
enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence
and have self-closing doors of a size specified by the Fire Department. All enclosures
to be constructed at grade level.
P.
Applicant shall meet all State requirements for the handicapped.
Q. On-site parking and circulation to be reviewed after motel is in operation for
six (6) months. Additional parking to be provided in the area shown on plans for tenni
courts if required, as determined by th~ City Council.
R. Tennis courts need not be installed until the City Council has determined the
need for additional parking. If no additional parking is required, after this six
mo~h period, tennis courts to be installed.

This is in reference to plans for a motel complex to be constructed
at 675 East Campbell Avenue (APN 279-46-001). This site is adja-
cent to Los Gatos Creek.
The area above the high bank is not subject to flooding from the

This easement would___ext.enk_Qy~.r' the creek ~o the westerly side
of the District's Central Pipeline right of way. Please contact
Don Lawrie of our Real Estate Division regarding transfer of this
easement. The District would rather have this area clear of park-
ing areas, driveways, etc., however, use of the area from the high
bank (or a two horizontal to one vertical slope from the toe of
slope whichever is greater) back to pipeline right of way for
motel parking is satisfactory if the District is not held liable
for any damages to these improvements from bank erosion. It
appears from the plan that.a portion of the parking area is over
the high bank which cannot be allowed as there should be no fill-
ing of the creek. The approximate high bank is shown on the
attached plan. The creek may be a potential hazard to small
children in the motel area, therefore, we recommend that a fence
be installed~etween the high bank and the motel development.
In the area of the District's Central Pipeline right of way, the
paving, landscaping, and tennis courts shown are satisfactory.
However, no trees should be planted in the right

proposed easement and existing District fee property subject
to the conditions that the District will not be liable for any
accidents, damages, or injuries of any kind as a result of the
use of this property by the motel development.

Traffic Considerationss
In accordance with the Council's recommendation, a meeting was held on
Monday, August 1,1977, withtthe residents in the Page-Poplar area in
order to explore the probable impact on future traffic conditions resulting
from the proposed motel development, and to review other neighborhood
concerns regardingprevailing traffic conditions.
The staff reviewed, at that meeting, an analysis of the vehicular volumes,
speeds, and accident experience on the neighborhood streets and on Campbell
Avenue between Highway 17 and Foote Street. Significantly, there have
been no accidents on this portions of Campbell Avenue involving turning
movements at the residential street intersections 3ince the improvements
provided with the South Loop Project were construtced. It was explained
that in order to provide for the restoration of left turn movements at
Poplar Avenue and to significantly modify the right turn exit from Campbell
Avenue to Poplar Avenue, it would require the expenditure of approximately
$1,100,000. This represents the preliminary estimate for the reconstruction
of a wider bridge across Los Gatos Creek and for the widening of the Highway
17 overpass.
The staff agreed that a study would be made of the area to insure that on-
street parking near the residential intersections would be prohibited
where necessary to provide adequate sight distance and maneuverability.
Additionally, a review of the existing speed control signs would be done.
The specific impact of the proposed motel was generally understood, after
a discussion of the trip generation characteristics of various types of
land uses, that the additional traffic movement on Campbell Avenue resulting
from the development would probably not be significant. Concern was expressed,
however, that the proposed on-site parking for the motel might be inadequate
with a resulting overflow into the abutting residential neighborhood. A
request may be made to the Council from the residents that some provisions
be made for the review of the parking adwquacy after an initial period of
operation.
