CC Resolution 12707 RESOLUTION NO. 12707 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING A TENTATIVE PARCEL MAP TO ALLOW CREATION OF A FOURTH PARCEL CREATED FROM THE EXISTING OFFICE PARCEL OF THE PRUNEYARD SHOPPING CENTER AND OFFICES, ON PROPERTY LOCATED AT 1901 S. BASCOM AVENUE AND 777 E. CAMPBELL AVENUE. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. The City Council finds as follows with regard to File No. PLN-2020-54: Environmental Finding 1. Approval of the Tentative Parcel Map is categorically exempt from environmental review pursuant to CEQA Guidelines Section 15315, since the lot split is in conformance with the General Plan and Zoning Code, no variances or exceptions are required, all services and access to the proposed parcel to local standards are available, the parcel was not involved in a division of a larger parcel within the previous two years, and the parcel does not have an average slope greater than 20 percent. Evidentiary Findings 1 . The Project Site is The Pruneyard Shopping Center and Offices, a 27 acre multi-use property encompassing three professional office buildings, a hotel, a multi-building retail shopping center, and a multi-level parking garage. The property is bounded by Bascom and Campbell Avenues to the east and south, Highway 17 to the west, and the Pruneridge Plaza Apartments and the Campisi Way terminus to the north. 2. The Project Site is within the C-2-O (General Commercial/Overlay) Combining Zoning District as depicted on the Campbell Zoning Map adopted pursuant to Campbell Municipal Code Section 21.040.030. 3. The Project Site is designated by the General Plan Land Use Diagram as General Commercial, which corresponds with the above referenced Zoning District designations. 4. On October 18, 2016, the City Council adopted Resolution Nos. 12068-12071 and introduced Ordinance Nos. 2212 and 2213, approving the Pruneyard Shopping Center and Offices Expansion Project ("Proposed Project") consists of the following components: • Zoning Map Amendment (PLN2015-357): To amend the Campbell Zoning Map to rezone a portion of The Pruneyard from the C-2 (General Commercial) Zoning City Council Resolution 12707 Page 2 Approval of a Tentative Parcel Map District to the C-2-O (General Commercial / Overlay) Combining Zoning District for a consistent zoning designation over the entire property. • Master Use Permit (PLN2015-358): To allow the construction of a 100,000 square- foot (5-story) office building, four retail buildings constituting 18,600 square-feet, a 30,000 square-foot fitness facility or a 12,000 square-foot retail/office building, expansion of the existing parking structure (3 or 5 stories), various site improvements, alterations to existing buildings, establishment of a new land use program including specifying permitted and conditional uses, continued allowance of a shared parking program, and implementation of a transportation demand management program (TDM). • Tentative Vesting Parcel Map (PLN2015-77): To allow division of the property into three parcels. • Tree Removal Permit (PLN2015-335): To allow removal of on-site "protected" trees. • Master Sign Plan with a Freeway Oriented Sign (PLN2015-78): To allow a new comprehensive signage scheme including a freeway-oriented sign, an increase in sign area, height, and number. • Zoning Text Amendment (PLN2015-76): To revise various sections of the Campbell Zoning Code (Title 21 of the Campbell Municipal Code) to reference the land use program created by the Master Use Permit and to allow the signage proposed by the Master Sign Plan. 5. The Pruneyard Master Use Permit was "established" upon issuance of a Building Permit Phase 1 (A/B) on January 17, 2017, pursuant to CMC Section 21 .56.030.B.1, at which time the Master Use Permit became controlling upon The Pruneyard. 6. The approved subdivision was effectuated by recordation of Parcel Map 904 M, as recorded with the Santa Clara County Office of the Clerk Recorder on May 18, 2017. 7. The Proposed Project is a subsequent application for a Tentative Parcel Map to allow creation of one additional parcel from the existing office parcel, submitted in conjunction for an Amendment to the Pruneyard Master Use Permit. 8. The Tentative Parcel Map is consistent with the C-2-O (General Commercial/Overlay) Combining Zoning District and the General Plan Land use designation. 9. Recordation of the Parcel Map will be contingent on issuance of a Building Permit for the new office building approved in Phase 3. 10.The existing Declaration of Restrictions and Common Parking Easements ("Pruneyard Declaration") will be revised to account for a new ownership interest. Based upon the foregoing findings of fact, the City Council further finds and concludes that: City Council Resolution 12707 Page 3 Approval of a Tentative Parcel Map 1. The Tentative Parcel Map is consistent with the General Plan and Zoning Ordinance of the City; 2. The proposed development will aid in the harmonious development of the immediate area; 3. The development and uses that will be facilitated by the Tentative Parcel Map will be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area; 4. There is a reasonable relationship and a rough proportionality between the Conditions of Approval and the impacts of the project; 5. There is a reasonable relationship between the use of the fees imposed upon the project and the type of development project; and 6. No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented and subject to the required conditions of approval, will have a significant adverse impact on the environment. THEREFORE, BE IT RESOLVED that the City Council approves of a Tentative Parcel Map to allow creation of a fourth parcel created from the existing office parcel of the Pruneyard Shopping Center and Offices, on property located 1901 S. Bascom Avenue and 777 E. Campbell Avenue, subject to the attached recommended Conditions of Approval (attached Exhibit A). Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT 1. Approved Project: Approval is granted for a Tentative Parcel Map to allow creation of a fourth parcel created from the existing office parcel of the Pruneyard Shopping Center and Offices, on property located 1901 S. Bascom Avenue and 777 E. Campbell Avenue. The Parcel Map shall substantially conform to the Tentative Parcel Map, included within the Revised Development Plans (Sheet TM-1), dated as received by the Planning Division on October 27, 2020 except as may be modified by the Conditions of Approval herein and as necessary to maintain consistency with the amended Pruneyard Master Use Permit. 2. Approval Expiration: The Tentative Parcel Map approval is valid until December 31, 2026. Recordation of a Parcel Map, in compliance with the provisions of the amended Master Use Permit, shall occur before this expiration date. 3. Building Permit: In compliance with Campbell Municipal Code Section 21.56.030.A.3.b(2) and the amended Pruneyard Master Permit (Part I, Section E (Property Subdivision), the Parcel Map shall not be recorded until a Building Permit for construction of Office Building '01' has been issued. PUBLIC WORKS DEPARTMENT 4. Referenced Conditions: The Conditions of Approval provided in the City Council Resolution approving the amended Master Use Permit are herein incorporated by reference.
