A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
ADOPTING THE RESOLUTION AUTHORIZING THE PUBLIC WORKS DIRECTOR
TO AMEND THE CONSULTANT SERVICES AGREEMENT BETWEEN THE CITY
AND VERDE DESIGN, INC., AND AUTHORIZING THE FINANCE DIRECTOR TO
PERFORM A BUDGET ADJUSTMENT FOR JOHN D. MORGAN PARK (BUDD
AVENUE SIDE) IMPROVEMENT PROJECT 18-PP
WHEREAS, the City Council adopted Resolution No. 12409 authorizing the Public
Works Director to execute a Consultant Services Agreement for design and construction
management with a not to exceed amount of $430,000; and
WHEREAS, the City and Verde Design, Inc. entered into a Consultant Services
Agreement in the amount of $420,000; and
WHEREAS, the COVID-19 pandemic had adverse impacts on the supply chain of
various material and thereby lengthening the construction period; and
WHEREAS, unanticipated site conditions encountered during construction warranted
field adjustments to the design requiring evaluation and review by Verde Design, Inc.,
and
WHEREAS, Verde Design, Inc. and their sub -consultants were called upon to provide
additional information regarding play equipment footings and address the location of
underground utilities; and
WHEREAS, due to the substantial amount of additional hours required of Verde Design,
Inc. and sub -consultants to address unforeseen items during construction, the original
contract amount has been exhausted; and
WHEREAS, an Amendment to the Consultant Services Agreement is necessary to
allow Verde Design, Inc. to continue to provide construction management and
engineering support; and
WHEREAS, Staff recommends the City Council authorize the Public Works Director to
amend the Consultant Services Agreement to increase it by $60,000 and authorize the
Finance Director to perform a budget adjustment (Exhibit A and incorporated by
reference) transferring $50,000 from the Park Dedication Fund; and
WHEREAS, there is sufficient funding in the Park Dedication Fund.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Campbell
hereby authorizes the Public Works Director to amend the Consultant Services
Agreement with Verde Design, Inc., and authorizes the Finance Director to perform a
budget adjustment for John D. Morgan Park (Budd Avenue Side) Improvement Project
18-PP.
