BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL AUTHORIZING THE CITY
MANAGER TO DISPENSE WITH THE BIDDING
PROCEDURES SPECIFIED IN CMC SECTION 3.20.050,
AND NEGOTIATE, AWARD, AND EXECUTE A CONTRACT
WITH DE NOVO PLANNING GROUP FOR THE
COMPLETION OF THE ENVISION CAMPBELL GENERAL
PLAN AND ENVIRONMENTAL IMPACT REPORT, AND
METROPOLITAN PLANNING GROUP FOR THE
PREPARATION OF THE 2023-2031 HOUSING ELEMENT AND
AUTHORIZING A CORRESPONDING BUDGET ADJUSTMENT
After notification and public hearing, as specified by law and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
The City Council finds as follows with regard to dispensing with the bidding procedures,
as set forth in Campbell Municipal Code (CMC) Section 3.20.050 and pursuant to
Municipal Code Section 3.20.030 negotiate, award, and execute a contract with De
Novo Planning Group for the preparation of the 2023-2031 Housing Element and
completion of the Envision Campbell General Plan:
WHEREAS, the City of Campbell is required by the State to certify its Housing Element
by January 15, 2023; and
WHEREAS, the City of Campbell desires the services of qualified consultants
for completion of the General Plan and for the preparation of the 2023-2031
Housing Element; and
WHEREAS, the City has a General Plan update under development by De Novo
Planning Group, which went through a competitive RFP and vetting process prior to
selection; and
WHEREAS, De Novo Planning Group has in-depth knowledge and familiarity with City
operations, documents, and the Goals, Policies, and Strategies set forth in the City of
Campbell General Plan and Draft Envision Campbell General Plan; and
WHEREAS, Metropolitan Planning Group has their familiarity with local policies
and regulations and experience preparing the City's last three Housing Elements,
WHEREAS, the City circulated an RFP from March 17, 2021 to April 15, 2021 for
the preparation of the Housing Element and received no proposals; and
WHEREAS, the City of Campbell Municipal Code authorizes the City to dispense with
the formal bidding process if certain conditions are met; and

WHEREAS, the purchasing procedures outlined in the City's Municipal Code (CMC)
Section 3.20.050 state that purchases and contract for `supplies, services, and
equipment of estimated fair market value greater than fifty thousand dollars' shall
be made according to specified bidding procedures.
WHEREAS, the consultant services associated with the preparation of the
2023-2031 Housing Element and completion of the Envision Campbell General Plan
shall have a combined value of $808,846 dollars inclusive of Optional Task 2.6 from
the Housing Element Proposal; and
WHEREAS, CMC Section 3.20.030 provides that the bidding procedures may be
dispensed with when any one of eight potential circumstances are found to exist.
WHEREAS, the City Council has found the following circumstances from CMC
3.20.030 to exist, thereby warranting the bidding procedures to be dispensed with:
No acceptable bids were received from any responsible bidder, after following
the procedures set forth in Section 3.20.050 of this chapter for the preparation of
the 2023-2031 Housing Element;
The city seeks the special services, consultation or advice in financial, economic,
accounting, engineering, legal, administrative or other matters from persons
specially trained, experienced and competent to perform the special services
required;
The City Council, by a majority vote, determines that it is in the best interest of
the public to dispense with the requirements of Section 3.20.050, in which case
the City Council shall prescribe the appropriate method of purchase.
WHEREAS, approval of the attached Request for Budget Adjustments form shown as
Exhibit A to this resolution is necessary to support the proposed contract expenditures.
THEREFORE, BE IT RESOLVED that the City Council hereby authorizes the
City Manager to dispense with the bidding procedures, as set forth in CMC
Section 3.20.050, and negotiate, award, and execute a contract with De Novo
Planning Group for the completion of the Envision Campbell General Plan and
Environmental Impact Report, and Metropolitan Planning Group for the preparation of
the 2023-2031 Housing Element and authorizing a corresponding budget adjustment as
set forth in Exhibit A.

REASON FOR REQUEST - BE SPECIFIC:
To appropriate an additional $563,618 to fund agreements with De Novo Planning Group to prepare the General Plan, and
associated environmental impact report and Metropolitan Planning Group to prepare the 2023-2031 Housing Element. De Novo
has an active PO with a projected remaining balance of $245,228. The additional $563,618 is funded by the general plan update
reserve account, general plan maintenance fees, and the LEAP/REAP Grants. $808,846 Total Contract Cost.
