BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT SETTING
FORTH TERMS UNDER WHICH THE CITY OF CAMPBELL MAY ACCEPT THE 2022
TRAFFIC RECORDS IMPROVEMENT PROJECT GRANT FROM THE STATE OF
CALIFORNIA - OFFICE OF TRAFFIC SAFETY; DISPENSE WITH THE BIDDING
PROCEDURES SPECIFIED IN CAMPBELL MUNICIPAL CODE SECTION 3.20.050;
AND INITIATE A BUDGET ADJUSTMENT TO APPROPRIATE $82,276 FOR E-
CITATION PROGRAM COSTS AND TO RECOGNIZE GRANT REVENUE FROM THE
CALIFORNIA - OFFICE OF TRAFFIC SAFETY, TRAFFIC RECORDS IMPROVEMENT
PROJECT GRANT IN THE AMOUNT OF $77,476 IN FISCAL YEAR 2022
WHEREAS, the National Highway Traffic Safety Administration (NHSTA) provides
Federal grant funds to the State of California — Office of Traffic Safety (OTS) for education,
enforcement programs, and technologies designed to make California's roadways safer;
and
WHEREAS, OTS evaluates potential programs to make effective use of the
Federal grant program funds; and
WHEREAS, the City of Campbell applied for an OTS Traffic Records Improvement
Project grant to alleviate time-consuming repetitive data entry, improve staff efficiency,
provide better analysis and clarity of traffic needs and allow for improvements towards
roadway safety; and
WHEREAS, the City of Campbell was awarded up to $77,500 by OTS to
implement an E-Citation program and upgrade the current Crossroads traffic collision
database, and
WHEREAS, the interested parties have negotiated a proposed agreement to
address their respective obligations and liabilities; and
WHEREAS, the City of Campbell Municipal Code authorizes the City to dispense
with the formal bidding process if certain conditions are met, and
WHEREAS, the purchasing procedures outlined in the City's Municipal Code
(CMC) Section 3.20.050 state that purchases and contract for 'supplies, services, and
equipment of estimated fair market value greater than fifty thousand dollars' shall be
made according to specified bidding procedures; and
WHEREAS, CMC Section 3.20.030 provides that the bidding procedures may be
dispensed with when any one of eight potential circumstances are found to exist; and
WHEREAS, the City Council has found the following circumstances from CMC
3.20.030 to exist, thereby warranting the bidding procedures to be dispensed with. -
The City Council, by a majority vote, determines that it is in the best interest
of the public to dispense with the requirements of Section 3.20.050, in which
case the City Council shall prescribe the appropriate method of purchase.
WHEREAS, approval of the attached Request for Budget Adjustments form shown
as Exhibit C to this resolution is necessary to support the proposed program expenditures.
THEREFORE BE IT RESOLVED, that the City Manager is authorized to execute an
agreement setting forth terms under which the City of Campbell may accept the 2022
Traffic Records Improvement Project grant from the State of California — Office of Traffic
Safety set forth in the Agreement and Exhibits attached to this Resolution; dispense with
the bidding procedures specified in Campbell Municipal Code Section 3.20.050; and
initiate a budget adjustment to appropriate $82,276 for E-Citation program costs and to
recognize grant revenue from the Office of Traffic Safety (OTS) Traffic Records
Improvement Project Grant for $77,476 in Fiscal Year 2022.
